RESOLUTION NO: RZ95-4
RESOLUTION MAKING FINDINGS OF FACT AND RECOMNIENDING
APPROVAL OF A PRELIMINARY/F1NAL PLAT AT THE SOUTHEAST CORNER OF
11TH AVENUE AND COUNTY ROAD 3
WHEREAS, an application for a subdivision, SUBD94-4, has been made by Wendy's for a
preliminary/final plat at the southeast corner of County Road 3 and l lth Avenue; and
WHEREAS, the procedural history of the application is as follows:
1. That an application for a subdivision, SUBD94-4, was filed with the City of Hopkins on
November 29, 1994.
2. That the Hopkins Planning Commission, pursuant to published and mailed notices, held a
public hearing on the application and reviewed such application on December 27, 1994
and January 31, 1995; all persons present were given an opportunity to be heard.

3. That the written comments and analysis of the City staff and the Planning Commission
were considered.
NOW THEREFORE, BE IT RESOLVED that the application for subdivision SUBD94-4 is
hereby recommended for approval based on the following Findings of Fact:
l. That the applicants application for a preliminary/final plat meets the requirements
of the Subdivision Ordinance:
2. That the applicants application for a preliminary/final plat meets the requirements
of the Zoning Ordinance.
BE IT FURTHER RESOLVED, that application for SUBD94-4 is hereby recommended for
approval based on the following conditions:
1. That there is a 12 foot drainage and utility easement on the east, west and south sides of
Lot 1.
2. That the triangular lot east of the water tower is an outlot.
