RZ95-04 � CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: RZ95-4 RESOLUTION MAKING FINDINGS OF FACT AND RECOMNIENDING APPROVAL OF A PRELIMINARY/F1NAL PLAT AT THE SOUTHEAST CORNER OF 11TH AVENUE AND COUNTY ROAD 3 WHEREAS, an application for a subdivision, SUBD94-4, has been made by Wendy's for a preliminary/final plat at the southeast corner of County Road 3 and l lth Avenue; and WHEREAS, the procedural history of the application is as follows: 1. That an application for a subdivision, SUBD94-4, was filed with the City of Hopkins on November 29, 1994. 2. That the Hopkins Planning Commission, pursuant to published and mailed notices, held a public hearing on the application and reviewed such application on December 27, 1994 and January 31, 1995; all persons present were given an opportunity to be heard. ---. 3. That the written comments and analysis of the City staff and the Planning Commission were considered. NOW THEREFORE, BE IT RESOLVED that the application for subdivision SUBD94-4 is hereby recommended for approval based on the following Findings of Fact: l. That the applicants application for a preliminary/final plat meets the requirements of the Subdivision Ordinance: 2. That the applicants application for a preliminary/final plat meets the requirements of the Zoning Ordinance. BE IT FURTHER RESOLVED, that application for SUBD94-4 is hereby recommended for approval based on the following conditions: 1. That there is a 12 foot drainage and utility easement on the east, west and south sides of Lot 1. 2. That the triangular lot east of the water tower is an outlot.
