Staff recommends adoption ofthe following motion: Move that Council adopt Resolution 2002- 92, Resolution for Adoption of Assessment Roll, 2002 Miscellaneous Special Assessments. Overview. The proposed special assessments as described in Exhibit A are for delinquent utility bills, citations, and invoices. Also included is parking ramp maintenance. Notices of this hearing have been published, and both notices and assessment statements have been mailed to all affected owners. Primary Issues to Consider. . Assessment items Refer to attached Exhibit A. Property owners who have paid their proposed assessment between the time of notification and the Assessment Hearing date have been deleted from the assessment roll. . . Appeal process If residents have not waived their rights to appeal, they are given the opportunity to approach Council during the public hearing. Standard appeal forms have been available at City Hall and need to be submitted no later than the public assessment hearing date. . CITY OF HOPKINS HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 2002-92 ADOPTION OF THE ASSESSMENT ROLL 2002 MISCELLANEOUS SPECIAL ASSESSMENTS WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for delinquent utility bills, citations, and delinquent invoices, all as more fully set forth and described in Exhibit A as attached to this resolution, and has amended such proposed assessment as it deems just, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HOPKINS, MINNESOTA: e 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessments shall be payable in equal, annual installments extending over the periods of years set forth in Exhibit A, the first ofthe installments to be payable on or after the first Monday in January of2003. Any deferred installments shall bear interest at the rate set forth in said Exhibit A from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from October 15, 2002, until December 31, 2003. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. It is hereby declared to be the intention ofthe Council to reimburse itself in the fUMe for the portion of the cost ofthis improvement paid for from municipal funds by levying additional assessments, on notice and hearing as provided for the assessments herein made, upon any properties abutting on the improvement but not made, upon any properties abutting on the improvement but not herein assessed for the improvement, when changed conditions relating to such properties make such assessment feasible. 4. To the extent that this improvement benefits nonabutting properties which may be served . by the improvement when one or more later extensions or improvements are made, but which are not herein assessed, therefore, it is hereby declared to be the intention of the Council, as . authorized by Minnesota Statutes Section 420.051, to reimburse the City by adding any portion of the cost so paid to the assessments levied for any of such later extension or improvements. 5. The clerk shall forthwith transmit a certified duplicate ofthis assessment to the County Auditor to be extended on the property tax lists of the County, and such assessments shall be collected and paid over in the same manner as other municipal taxes. CITY OF HOPKINS Hennepin County, Minnesota NOTICE OF ASSESSMENT HEARING NOTICE IS HEREBY GIVEN that the City Council of Hopkins, Minnesota, will meet in the Council Chambers of the Hopkins City Hall, 1010 1st Street South, Hopkins, Minnesota at 7:30 p.m. on Tuesday, October 15, 2002, to pass upon the proposed special assessments for the costs of delinquent utility bills, for delinquent invoices, for delinquent citations, and for the costs of maintenance of a parking ramp. Please see the enclosed Statement of Assessment for your property. Except for petitioners who have waived their right to notice or objection, all persons who wish to be heard, or to object with reference to this matter may present their cases at this hearing either orally or in writing. No appeal may be taken as to the amount of any assessment adopted unless a written objection signed by the property owner is filed with the Assessment Clerk prior to the assessment hearing or presented to the presiding officer at the hearing. Even though appeals are due by the hearing date on October 15, 2002, the City Clerk strongly recommends that appeals be submitted to the Assessment Clerk's office by October 11,2002. Appeal forms . will be available at the assessment hearing or at the Assessment Clerk's office at the Hopkins City Hall, 1010 1st Street South, Hopkins, Minnesota. An owner may appeal an assessment to district court pursuant to MSA Section 429.081 by serving notice of the appeal upon the Mayor or City Clerk of the City of Hopkins within thirty (30) days after the adoption of the assessment and by filing such notice with the district com1 within ten (10) days after service upon the Mayor and City Clerk. Under provisions of Mimlesota Statutes Section 435.193 to 435.195 the City may, at its discretion, defer the payment of assessments for any homestead property owned by a person 65 years of age or older for whom it would be a hardship to make the payments. The procedures to apply for such deferment are available from the Assessment Clerk. Deferment applications should be submitted to the Assessment Clerk by October 11,2002. The following information shall also apply: 1. The property owner shall have the right to prepay the entire assessment. Your assessment may be paid without interest from October 15,2002 to November 14,2002, to the Assessment Clerk at City Hall, 1010 1st Street South, Hopkins, Minnesota. You may at any time thereafter and prior to November 30, 2002 pay to the Assessment Clerk the entire amount of the assessment remaining unpaid, with interest accrued fTOm October 15, 2002 to the date in which such payment is made. Such payment must be made prior to November 30, 2002 or interest will . be charged through December 31 of the succeeding year. -..---.-...-..-. . 2. Partial prepayment of the assessment in excess of 25 percent of the total assessment has been authorized by ordinance. A partial prepayment can only be made prior to November 30, 2002 with interest accrued to the payment date, except that no interest shall be charged if such partial payment is made by November 14, 2002. 3. In the case where accrued interest applies, the rate of interest to be accrued, if the assessment is not prepaid within the required time period, is proposed to be 7 percent commencing on the date of adoption by the City Council. Assessments shall be payable in one annual installment. 4. The amount to be specially assessed against your property is shown on the enclosed Statement of Assessment. 5. A $50.00 service charge has been added to the amount to be assessed for all delinquent bills. ASSESSMENT HEAIUNG 2002 ALLEY RECONSTRUCTION PROJECT PROJECT 00-12 Proposed Action Staff recommends the following motion: "Move that Council adopt Resolution 2002-93, Resolution Adopting Assessment RolL 2002 Alley Reconstruction Proiect City Proiect 00-12." This action continues an assessable project for street upgrading. Overview The 2002 Alley Reconstruction Project is essentially complete and only minor punch list items remain. Council awarded the project on June 18, 2002, following the public hearing for the project, which was held the previous month. Assessment calculations have been prepared based on the estimated final project quantities and the awarded low bid costs. On September 17, 2002, Council ordered an assessment hearing for the project to be held on October ] 5. 2002. This assessment hearing sets in motion levying of assessments against benefiting propeliies. A public hearing notice has been published and mailed, along with an assessment statement to every affected propeliy owner. As of this writing, no written objection contesting the proposed assessments has been submitted. Standard forms for written objections have been . available at City Hall and need to be submitted no later than the hearing date. Staff is recommending adoption of the assessment TOJI as proposed. Project costs, fundin~, and assessments: Based on the low bid, engineering costs, admin/legal fee and estimated final project quantities, the total estimated project cost is $33,229.07. This amount is below the $50,000 estimated in the 2002 CIP. The amount proposed to be assessed is $ ] 4,345.10. This amount equates to $2,049.30 per property, which is 3% higher than the approved pending amount of $1,993.00. This slightly higher assessment amount is due primarily to the fact that the low bid for the project had a unit price amount for the alley concrete that was a little higher than the engineer's estimate. Staff will be recommending adoption of these assessments at a proposed assessment interest rate 7% for the duration of 10 years. Both the recommended assessment amount and duration is consistent with many recent alley assessments in Hopkins. The recommended interest rate was just reduced this year by the finance director from 8% to 7% based on several considerations. It is proposed that the concrete pavement project be assessed in accordance with the City of Hopkins' current assessment policy, wherein 80% of the cost is assessed to abutting properties and 20% is funded as a City cost. It is further proposed that the City's portion of the costs be paid entirely from the storm sewer utility fund, in accordance with City policy. Additional drainage improvements at Hilltop Park at the n011h end of the alley dead end would also be paid from the storm sewer utility fund. . Because there are such unique circumstances surrounding this project site, including the unusual "L" shaped functional nature of this alley, staff teels that the fairest method to assess this project is on a per-unit basis rather than on an abutting linear footage basis as is usually done with aIley assessments, and that each abutting propeJiy be assessed the same. as they all have equal eligibility to use the alleyway. This assessment methou is consistent with past assessments for Hopkins alley projects by assessing each abutting propeliy in the same malmer even though every property doesn't currently use the alleyway for their primary driveway access. As mentioned above, each property has the same eligibility to use the alley and the potential for future reueveiopmcnt or changes to each of the properties means each propeliy should be assessed in the same malmer. The City staff is also of the opinion that the computation for the costs eligible for assessment should be based off a 10-foot-wide alley section for the entire length of the functional alleyway because the additional 8-foot width for the east west portion is needed to benefit tbe City for maintenance and refuse pickup purposes. The proposed assessment amounts were computed in accordance with the per-unit 10-foot alley method outlined above to come up with $2,049.30 per unit. Tl1is amount is consistent with assessment amounts for other recent alley projects in the City of Hopkins. The costs associated with this additional width are proposed to come out of the PIR Fund. This improvement . project includes the reconstruction of the alleyway including concrete pavement, concrete curb, miscellaneous drainage improvements, and all necessary appurtenances pursuant to Minnesota Statutes, Section 429.011 to 429.111 (Laws 1953, Chapter 398, as amended). Written or oral objections will be considered at the hearing. The total project amount of the proposed assessment is $14,345.10. Following the hearing, the Council will decide whether any adjustments in the roll are necessary and will, by resolution, adopt the roll. The first installment will appear on the 2003 tax statement and shall include interest at the rate of 7 % per year from the date of the resolution adopting the assessment roll until December 31, 2003. Assessments shall be payable in annual installments . over a period of 10 years. If a property owner pays the full assessment on his or her property prior to November 30, 2002, interest due on that payment would be calculated to the date of payment. If such payment is made after November 30, 2002, interest will be charged to December 31, 2003. If a property owner pays his assessment in full from October 15, 2002 to . November 14, 2002, no interest will be charged. Such payment should be made to the Assessment Clerk at Hopkins City Hall, 1010 1"t Street S, Hopkins, Minnesota 55343. Partial prepayment of the assessment in excess of 25 percent of the total assessment has been authorized by ordinance. A partial prepayment can only be made prior to November 30, 2002 with interest accrued to the payment date, except that no interest shall be charged on the partial payment if such partial payment is made by November 14, 2002. You may appeal any assessment to the district Court pursuant to Minnesota Statutes Section 429.081 by serving notice of the appeal upon the Mayor or the City Clerk within 30 days after the adoption of the assessment roll and filing such notice with the Clerk of District Court within ten (10) days after service upon the Mayor or City Clerk. No such appeal as to the amount of an assessment as to a specific parcel of land may be made unless the owner has either filed a signed written objection to that assessment with the City Clerk prior to the hearing or has presented the written objection to the presiding officer at the hearing. Under provisions of Minnesota Statutes Section 435.193 to 435.195 the City may, at its discretion, defer the payment of assessments for any homestead property owned by a person 65 years of age or older for whom it would be a hardship to make the payments. The procedures to apply for such deferment are available from the Assessment Clerk. RESOLUTION NO. 2002-93 RESOLUTION ADOPTING ASSESSMENT ROLL 2002 ALLEY RECONSTRUCTION PROJECT CITY PROJECT 00-12 WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for the al/ey reconstruction located along the 200/300 block between 19th Avenue N and 20th Avenue N, as described in the files of the City Clerk as Project 00-12. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hopkins, Minnesota: 1. Such proposed assessment, as may be amended and a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of ten years, the first of the installments to be payable on or after the first Monday in January 2003, and shall bear interest at the rate of 7 percent per annum from the date of the adoption of this assessment resolution. To the first installment shaff be added interest on the entire assessment from October 15, 2002, until December 31, 2003. To each subsequent . installment when due shall be added interest from one year on all unpaid installments. It is hereby declared to be the intention of the Council to reimburse itself in the future for the 3. portion of the cost of this improvement paid for from municipal funds by levying additional assessments, on notice and hearing as provided for the assessments herein made, upon any properties abutting on the improvement but not made, upon any properties abutting the improvement but not herein assessed for the improvement, when changed conditions relating to such properties make such assessment feasible. 4. To the extent that this improvement benefits non-abutting properties which may be served by the improvement when one or more later extensions or improvements are made, but which are not herein assessed, therefore, it is hereby declared to be the intention of the Council, as authorized by Minnesota Statutes Section 420.051, to reimburse the city by adding any portion of the cost so paid to the assessments levied for any of such later extension or improvements. 5. The clerk shall forthwith transmit a certified duplicate of the assessment to the County Auditor to be extended on the property tax lists of the County, and such assessments shall be collected and paid over in the same manner as other municipal taxes. HENNEPIN COUNTY, MINNESOTA RESOLUTION NO, R02-94 A RESOLUTION CORRECTING PREVIOUS CITY COUNCIL RESOLUTIONS APPROVING THE V ACATION OF ALLEYS LOCATED WITHIN BLOCK 3, WEST MINNEAPOLIS, AND APPROVING THE VACATION OF SUCH ALLEYS WHEREAS, on October 17,1995, the Hopkins City Council approved and adopted Resolution No. 95-90, which was recorded as Hermepin County Recorder Document No. 6512290, approving the vacation of all of the north/south alley in Block J, West Mimleapolis, that had not previously been vacated by the City of Hopkins. WHEREAS, on June 4, 2002, the Hopkins City Council approved Resolution No. R02-55 approving the vacation of that part of the 14 foot alley originally dedicated in Block 3, West Minneapolis, which lies northerly of the north line of Lot 7 in said Block 3 and its westerly extension. WHEREAS, the Helmepin County Examiner of Titles Office has objected to the legal descriptions of the vacated alleys in Block 3, West Minneapolis, stated in said City Council Resolutions No. 95-90 and No. R02-55. WHEREAS, the Hopkins City Council determined at the time of adoption of said Council Resolutions No. 95-90 and No. R02-55 that said nOlth/south alley and said east/west alley in Block 3, West Minneapolis, are no longer needed for a public purpose and should be vacated. WHEREAS, the Hopkins City Council has determined that this Resolution should be adopted for the purpose of correcting the legal descriptions of the alleys in Block 3, West Mirmeapolis, vacated by Council Resolutions No. 95-90 and No. R02-55. WHEREAS, all of the conditions of approval of the vacation of the north-south alley in Block 3, West . Minneapolis, stated in City Council Resolution No. 95-90 have been satisfied. WHEREAS, all of the conditions of approval of the vacation of the east-west alley in Block 3, West Minneapolis, stated in City Council Resolution R02-55 will have been satisfied at such time as the City of Hopkins has executed the plat of Marketplace Addition. NOW, THEREFORE, the City Council of the City of Hopkins, Mirmesota hereby approves the above findings and adopts the following Resolutions: Resolved, Lhat City Council Resolution No. 95-90, recorded as Hennepin County Recorder Document No. 6512290, and City Council Resolution No. R02-55 are hereby corrected to describe the alleys vacated pursuant to such resolutions as follows: All of the nortlHouth alley in Block 3, West Minneapolis, according to the recorded plat thereof, lying south of a line drawn across said alley from the n0l1hwest corner of Lot 7 to the northeast comer of Lot 46, and lying north of a line drawn across said alley ham the southwest comer of Lot 10 to the southeast comer of Lot 43, all in said Block 3, West Minneapolis.
