ZONING ORDINANCE AMENDMENTS
Proposed Action.
Staff recommends the following motion: Move to adopt Resolution 02-81. approving
Ordinance 02-882, making an amendment to the definition of a porch for first reading.
At the Zoning and Planning meeting Mr. Szuba moved and Mr. Rudolph seconded a motion
to adopt Resolution RZ02-21, recommending approval of Ordinance 02-882, making an
amendment to the definition of a porch. The motion was approved unanimously,

At various times the staff assembles sections of the zoning ordinance that need to be updated.
These amendments are to correct inconsistencies or problems the staff has identified or just
to update the ordinance. In this case it is the definition of a porch.

Porch: a one story, covered area adjoining an entrance to a building with a separate roof, that
mayor may not have a railing or partial wall extending no more than 42 inches from the
floor, and that is not used for livable space.
Clarifying what a porch is.
. What was the discussion at the Zoning and Planning meeting?
Ms, Anderson reviewed the proposed amendment with the Commission. Ms, Anderson
noted that there was a change from last month. Language was added that a porch mayor
may not have a rail. There was no one at the public hearing regarding this issue.
Altern atives.
1. Approve the amendment to the zoning ordinance. By approving the amendment to the
. zoning ordinance, the definition of a porch will be changed,
2. Deny the amendment to the zoning ordinance. By denying the amendment to the zoning
ordinance, the Zoning Ordinance will not be amended. If the City Council considers this
alternative, findings will have to be identified that support this alternative.
3. Continue for further information. If the City Council indicates that further information is
needed, the item should be continued,

RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING AN ORDINANCE AMENDMENT
WHEREAS, an application for Zoning Amendment ZN02-7 has been made by the City of
Hopkins;
WHEREAS, the procedural history of the application is as follows:
1. That an application for zoning amendment was made by the City of Hopkins;
2. That the Hopkins Zoning and Planning Commission published notice, held a
public hearing on the application and reviewed such application on August 27,
2002: all persons present were given an opportunity to be heard;
3, That the written comments and analysis of City staff were considered,
. NOW, THEREFORE, BE IT RESOLVED that the application for Zoning Amendment ZN02-7
is hereby approved based on the following Findings of Fact:
1. That the proposed amendment to protect the health, safety, and welfare of the
community.

AN ORDINANCE AMENDING THE ZONING ORDINANCE
BE IT ORDAINED by the City Council of the City of Hopkins as follows:
That the Hopkins City Code Section 551-570 be, and the same is hereby amended, as
follows:
515 - Zoo in!! code: policy; definitions
Porch: a one story, covered area adjoining an entrance to a building with a separate roof, that
mayor may not have a railing or partial wall extending no more than 42 inches from the floor,
and that is not used for livable space.
. Other definitions listed in Sections 515, are to be renumbered accordingly.
