CONDITIONAL USE PERMIT
GENERAL PROVISIONS
1 . This permit is not valid until it has been recorded at the Office of the
County Recorder . A true and correct copy of the full legal deseription of
the affected property must be attached to this document .
2 . This permit does not constitute a building permit , sewage system permit ,
grading permit , land alteration permit , well permit or the like . Separate
permits may have to be applied for and obtained in order to accomplish all
the goals of the project authorized herein .
3 . The issuance of this permit does not negate the need to secure other permits
from other local units of government , state agencies or federal agencies who
may also have jurisdiction over portions of your project .
SPECIAL PROVISIONS
1. That a landscaping of ivy is planted to screen the fence and 5 evergreens , with the
size to be approved by staff, are planted on the south and southwest corner of the
� tower base.
That all conditional use requirements pertaining to comrr�ercial transmission towers, as
outlined in the Zoning Ordinance, are adhered to.
E%PIRATION.
A Conditional Use Permit expires one year after it has been issued unless the
use for whieh the permit has been granted is in effect . Extensions may be
granted provided the applicant submits a letter to the Zoning Administrator
requesting an extension 30 days before the expiration of said approval . The
letter shall state the facts of the request , showing a good-faith attempt to
utilize the Permit , and it shall also state the additional time being requested
to begin the proposed construetion . The City Couneil may grant extensions not
to exceed one year.

CONDITIONAL USE PERMIT - CELLULAR ONE OF MINNESOTA
Pro�osed Action.
Staff recommends the following motion: Move to approve
Resolution R92-1 approving a conditional use permit for a
commercial transmission tower at 215 Excelsior Avenue East.
The Commission unanimously approved Resolution RZ91-26
recommending approval of locating a commercial transmission
tower at 215 Excelsior Avenue East.
Overview.
Cellular One of Minnesota is experiencing an overloading
problem in the areas around Hopkins. To correct this
problem they are proposing construction of a tower.
The proposed site for the new tower is on the west part of
the old Red Owl site abutting Highway 169. The tower will
be a 75' high self-supporting monopole. Also on the site
will be a 12' x 38' building. This building will have an
exterior of exposed aggregate.
'� Commercial transmission towers are allowed in industrial
districts with a conditional use permit. The proposed site
is located in an I-2 zoning district.
Warren Dunlap representing Cellular One appeared before the
Commission. Mr. Dunlap explained the need for a tower in
the area. The Commission was concerned with the landscaping
near the base of the tower. The Commission decided that ivy
and 5 evergreens would screen the base sufficiently.

Primary Issues to Consider.
o What type of tower will be aonstructed?
The tower will be a self-supporting monopole with panel type
antennas placed on top of the pole. The monopole will look
similar to the light pole along the highway.
o Does the proposed tower meet the conditions of the
commercial tower ordinance?
Attached to the report are the conditions for a commercial
transmission tower.
The applicant has complied with all the requirements
outlined in the Zoning Ordinance relating to commercial
transmission towers.
The proposed tower is 75 feet from the right-of-way of State
Highway 169.
o Will the tower have enough screeninq around the base?
"� The tower will be located 15 feet lower than Highway 169.
Between the tower and 169 is a grassy area with trees. The
applicant will be constructing a 2 foot timber wall at the
base of the tower to blend in with the existing topography
and vegetation.
The applicant did state they would be willing to do more
landscaping. Staff is recommending that landscaping is
added in the area of the tower base to screen the base of
the tower. The applicant did submit 3 landscape plans. The
Commission recommended ivy and evergreens to screen the area
around the base of the tower.
Alternatives.
1. Approve the conditional use permit to allow a
commercial transmission tower. By approving, the
applicant will be able to construct a commercial
transmission tower.
2 . Deny the conditional use permit to allow a commercial
transmission tower. By denying the conditional use
permit, the applicant will not be able to construct the
commercial transmission tower
3 . Continue for further information. If the City Council
' ^ indicates that further information is needed, the item
should be continued.

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN
APPLICATION FOR A COMMERCIAL TRANSMISSION TOWER
WHEREAS, an application for a conditional use permit
entitled CUP 91-8 made by Cellular One of
Minnesota is approved.
WHEREAS, the procedural history of the application is as
follows:
1. That an application for a conditional use
permit CUP 91-8 was filed with the City of
Hopkins on November 12 , 1991.
2 . That the conditional use permit for a
commercial transmission tower is located on
the following described property:
Tracts A, B and C, RLS No. 1465 and SEly 20 ft of
Lots 5, 6 and 7, Blk 12, West Minneapolis Center,
Also Lots 16 thru 26, incl, Block 4 , last said
addition and that part of Lots 14 and 5, said
Block 4 lying west of East 16 feet thereof, also
Block 13, including adjacent 1/2 of streets and
^ alleys vacated except street and that part of Lots
1, 2 and 3, Block 9, West Minneapolis Center and
that part of former r/w of Burlington Northern

4. That the Hopkins Planning Commission,
pursuant to published and mailed notice, held
a public hearing on December 30, 1991: all
persons present at the hearing were given an
opportunity to be heard.
5. That the written comments and analysis of the
City Staff and the Planning Commission were
considered.
NOW THEREFORE BE IT RESOLVED, that application for CUP 91-8
is hereby approved subject to the following
Findings of Fact:
1. That a commercial transmission tower is permitted
with a conditional use permit in the industrial
districts.
2 . That the proposed tower meets the requirements for
a commercial transmission tower as outlined in the
zoning ordinance.
BE IT FURTHER RESOLVED, that application for CUP 91-8 is
