RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
AN APPLICATION FOR A CONDITIONAL USE PERMIT
WHEREAS, an application for a conditional use permit entitled CUP
91-7 made by Central Contractors Supply is approved.
WHEREAS, the procedural history of the application is as follows:
1. That an application for conditional use permit CUP
91-7 was filed with the City of Hopkins on October
28, 1991.
2 . That the Hopkins Planning Commission reviewed such
application on November 26, 1991.
3 . That the Hopkins Planning Commission, pursuant to
published and mailed notices, held a hearing on
November 26, 1991; all persons present at the
hearing were given an opportunity to be heard.
4. That the written comments and analysis of the City
Staff and the Planning Commission were considered.
NOW THEREFORE BE IT RESOLVED, that application for CUP 91-7 is
hereby approved subject to the following Findings of
Fact:

1. That an outside storage area is allowed in the I-2
zoning district.

BE IT FURTHER RESOLVED, that application for CUP 91-7 is hereby
approved subject to the following Conditions:
1. That an opaque fence is constructed on the site in
accordance with a plan acceptable to staff.
2 . That only building materials and trailers are stored in
the storage area.
3 . That a revised landscaping plan with be submitted by
the applicant for review by the Commission on or before
the March Zoning and Planning meeting.
4 . That the applicant comply with all of the requirements
of an open sales lot as outlined in the zoning
ordinance.
5. That the storage of material in the storage
area is limited to 10 feet in height.
6. That the landscaping is completed by July 1, 1992 .

CONDITIONAL IISE PERMIT - OIITSIDE 3TORAGE
Proposed Action.
Staff recommends the following motion: Move to approve
Resolution RZ91-22 recommending approval of an outside
storaQe area at 620 12th Avenue South.
Overview.
Central Contractors is proposing to relocate to Hopkins at
620 12th Avenue South. This building was the former site of
Crown Fixtures. This site has a vacant area to the south
of the building. The applicant is proposing to level this
area, construct a fence, and use it for an outside storage
area. The site is zoned I-1 Industrial.
The Zoning Ordinance requires that in an industrial
district, any use not within a building requires a
conditional use permit.
-� The applicant is not proposing any improvements to the
exterior of the existing building.

Primar� Issues to Consider.
o what improvements to the site is the applicant proposing?
The applicant is proposing to fence the storage area with a
6 foot chain link fence and barbed wire. Section 435 of the
City Code states the following: "Open outdoor storage yards
or areas located and used on premises zoned for commercial
or industrial purposes shall be enclosed by a durable,
permanent fence which shall be of dense, sturdy materials
and be not less than six feet in height and maintained as
may be needed or required to prevent any unauthorized
entrance into or on such premises. " The chain link fence
as proposed by the applicant does not meet this requirement.
A chain link fence is not a dense type material as required
by the ordinance. The applicant is concerned with security
of the site. However, staff is recommending an 8-foot chain
link fence with slats and barbed wire on the top should
provide adequate security. Access to the storage area is
from the west side of the site.
The applicant is also proposing to put additional
landscaping on the south and east sides. The plan submitted
--� shows only two additional trees planted on the east side.
The staff is recommending that additional trees and
landscaping be planted on the east and south sides outside
of the fenced area in accordance with a plan acceptable to
staff.
The applicant is proposing to use compacted gravel as a
surface for the storage lot.
o Is staff recommendinq any other conditions?
Staff is recommending that the storage area be used for the
storage of building supplies and trailer parking. A trailer
parking lot is also detailed in the southwest corner of the
lot. The applicant has identified only building supplies on
his site plan. The staff is concerned that this storage and
trailer parking area will become used for something other
than what is identified on the site plan.
Also, because there will be sales occurring in the storage
lot, staff is recommending that the applicant comply with
all the requirements of an open sales lot. These are as
follows:
1. The lot is graded and surfaced according to a plan
submitted and approved by the city engineer that
— "� will adequately provide for drainage and dust
control.

2 . That the storage on such lot be so organized that
a space of 15 feet of vehicular accessible open
space remain between storage area with such areas
not to exceed 40 feet in width.
3 . That the height of such open storage shall not
exceed 15 feet.
4 . That the storage area shall be fenced in such a
way as to screen from the street right-of-way.
5. That the area shall be landscaped and maintained
according to a plan submitted and approved by the
building inspector.
Alternatives.
1. Recommend approval of the conditional use permit to
allow a storage area. By recommending approval of the
conditional use permit, the applicant will be able to
use the south side of the site for an outside storage
area if approved by the City Council.
2 . Recommend denial of the conditional use permit to allow
'� an outside storage area. By recommending denial of the
conditional use permit, the applicant will not be able
to use the south side of the site for an outside
storage area if denied by City Council.
3 . Continue for further information. If the Commission
indicates that further information in needed, the item
should be continued.
