GENERAL PROVISIONS _,
1 . This permit is not valid until it has been recorded at the Office of the
County Recorder . A true and correet copy of the full legal description of
the affected property must be attached to this document .
2 . This permit does not constitute a building permit , sewage system permit ,
grading permit , land alteration permit , well permit or the like . Separate
permits may have to be applied for and obtained in order to accomplish all
the goals of the project authorized herein .
3 . The issuance of this permit does not negate the need to secure other permits
from other local units of government , state agencies or federal agencies who
may also have jurisdiction over portions of your project .
SPECIAL PROVISIONS
That the temporary building is allowed to remain for 12 months. At that
time the building will again be reviewed to consider a 12 month extension.

E%PIRATION.
A Conditional Use Permit expires one year after it has been issued unless the
use for whieh the permit has been granted is in effect . Extensions may be
granted provided the applicant submits a letter to the Zoning Administrator
requesting an extension 30 days before the expiration of said approval . The
letter shall state the faets of the request , showing a good-faith attempt to
utilize the Permit , and it shall also state the additional time being requested
to begin the proposed construction . The City Couneil may grant extensions not
to exeeed one year.

CONDITIONAL USE PERMIT - RUDY LUTHERS HOPKINS HONDA
Proposed Action.
Staff recommends approval of the following motion: Move to approve
Resolution R91-64 which will allow the temporary buildina to remain
for an additional 12 months.
Approval of this motion will allow the temporary storage building to
remain for an additional 12 months.
The Commission on a 6-0 vote approved Resolution RZ91-13 approving the
temporary building for an additional 12 months. Mr. Pavelka abstained
from voting.
Overview.
On May 15, 1987 Rudy Luther's Hopkins Honda was granted a conditional
use permit for an auto sales lot on the southwest corner of 5th Avenue
& Mainstreet. At that time, two variances were also approved. The
variances that were approved were the following:
o a variance for the square footage of the sales lot
o a variance for the front yard setback.
^ In 1988 the conditional use permit was amended to allow a temporary
building on the site. The applicant was allowed to use the building
for two years. The reason for the temporary building was the uncertain
future of the south side of the site. The south portion of the site
is leased from the HCRRA and in the future may be used for light rail
transit.
The two years have expired and now the applicant is asking to continue
the use of the building on the site.
Gordon Nelson representing Hopkins Honda appeared before the
Commission. Mr. Nelson reviewed the history of the site. Mr. Nelson
also requested that the temporary building is allowed to remain for an
additional 24 months. The Commission decided to allow the temporary
building for an additional 12 months. At that time, the building will
again be reviewed to consider an additional 12 month extension.

Detailed Backqround.
The building is 10'x 12 ' and approximately 8 feet in height and is
situated on the south side of the site.
Primary Issues to ConsiBer.
o How lonq should the temporary buildinq be allowed to remain?
The subject building is temporary and should not become a permanent
fixture on the used car lot. However, the downtown grocery/retail
project proposed by Ryan Construction could have an impact on the
design and operation of Rudy Luthers business. If the grocery store
project proceeds it is proposed their used car/body shop operation now
located between 6th and 8th Avenue would be redeveloped for the
grocery store development. Hopkins Honda would then be in a position
to acquire additional property adjacent to their new car operation.
As a result they could possibly change the design of their used auto
lot. It would not be logical to have them assume a major expense for
construction of a permanent building at this time.
^ Staff is recommending that the applicant is allowed to use the
temporary building for an additional 12 months. This additional 12
months should be sufficient time to determine if the Ryan project will
proceed.
o Has the applicant considered constructinq a permanent buildinq?
In 1989 Rudy Luthers Hopkins Honda was granted a conditional use
permit to construct a permanent building. This building was never
constructed.
Alternatives.
1. Approve the amendment to the conditional use permit with the
condition that the temporary building is used for an
additional 12 months.
2 . Deny the amendment to the conditional use permit. By denying
the amendment to the conditional use permit, the applicant
will be required to remove the temporary building.
3 . Continue for further information. If the City Council
indicated that further information is needed, the item should
be continues.

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
AN APPLICATION FOR A CONDITIONAL USE PERMIT CUP91-3
WHEREAS, an application to amend CUP88-2 entitled CUP91-3 made
by Rudy Luthers Hopkins Motors, Inc. is approved.
WHEREAS, the procedural history of the application is as
follows:
1. That an application for Conditional Use Permit
CUP91-3 was filed with the City of Hopkins on
April 4, 1991.
2 . That the Hopkins Planning Commission reviewed such
application on April 30, 1991.
3 . That the Hopkins Planning Commission, pursuant to
published and mailed notices, held a hearing on
April 30, 1991: all persons present at the hearing
were given an opportunity to be heard.
4. That the written comments and analysis of the City
Staff and the Planning Commission were considered.

NOW THEREFORE BE IT RESOLVED, that application for Conditional
Use Permit CUP91-3 which amends CUP88-2 is hereby
approved subject to the following Findings of Fact:
1. That the status on the subject property is uncertain
and the construction of a permanent building is not
logical at this time.
BE IT FURTHER RESOLVED, that application for CUP91-3 which amends
CUP88-2 is hereby approved subject to the following
Conditions:
1. That the temporary building is allowed to remain for 12
months. At that time the building will again be

The Hopkins Zoning and Planning Commission will hold a
public hearing on Tuesday, April 30, 1991, at 7 : 30 p.m. , in the
Council Chambers of City Hall to consider an application by Rudy
Luther Hopkins Honda for an amendment to his conditional use
permit to continue the use of a temporary building on the
southwest corner of 5th Avenue and Mainstreet.
The legal description is as follows:
Lot A West Minneapolis and that part of 100 foot
railroad right-of-way lying northeasterly of a line parallel with
and 22 . 58 feet northeasterly from center line of said right-of-
way and lying southerly of Excelsior Avenue and westerly of 5th
