GENERAL PROVISIONS v
1 . This permit is not valid until it has been recorded at the Office of the
County Recorder. A true and correet copy of the full legal description of
the afFected property must be attached to this document .
2 . This permit does not constitute a building permit , sewage system permit ,
grading permit , land alteration permit , well permit or the like . Separate
permits may have to be applied for and obtained in order to aceomplish all
the goals of the projeet authorized herein .
3 . The issuance of this permit does not negate the need to secure other permits
from other local units of government , state agencies or federal ageneies who
may also have jurisdiction over portions of your project .
SPECIAL PROVISIONS
That the applicant comply with the conditions set forth in Resolution No/ 87-90.

E%PIRATION.
A Conditional Use Permit expires one year after it has been issued unless the
use for whieh the permit has been granted is in effect . Extensions may be
granted provided the applicant submits a letter to the Zoning Administrator
requesting an extension 30 days before the expiration of said approval . The
letter shall state the facts of the request , showing a good-faith attempt to
utilize the Permit , and it shall also state the additional time being requested
to begin the proposed construction . The City Couneil may grant extensions not
to exceed one year.

CONDITIONAL USE PERMIT AMENDMENT - DICK'S TOWING
Proposed Action.
Staff recommends approval of the following motion: Move to approve
Resolution 90-110 approvina the amendment to Dick Hughes Conditional
Use _Permit to move his auto storacre lot 60 feet to the east
Approval of this motion will allow Dick's Towing auto lot to move his
auto storage lot 60 feet to the east.
The Commission unanimously approved the resolution to amend Mr. Hughes
Conditional Use Permit to move his auto storage lot 60 feet to the
east.
Overview.
In 1987 Dick Hughes was granted a Conditional Use Permit for a 80, 000
square foot auto storage lot. There were several conditions attached
to the conditional use permit. The resolution is attached. The land
which Mr. Hughes leases has been sold by Massey Ferguson to Edco
Products. The new owners want Mr. Hughes to rearrange the boundaries
of his auto storage area. The ordinance allows review of conditional
use permits if there is a significant change.
The change in boundaries would be the following: move the fence 60
feet to the east along the east side of the property and also move the
fence 248 feet to the east on the south side of the lot. The auto
,.� storage lot will increase by 2316 square feet. The property to the
east of Mr. Hughes operation is vacant and was leased by Medalist for
parking in the past.
Staff is recommending approval because the applicant will comply with
the conditions as previously granted.
Staff reviewed the background on the original Conditional Use Permit
by Dick Hughes. Mr. Hughes appeared before the commission and stated
it was a mutual decision with Edco Products and himself to move his
auto storage lot. Jon Schwartzman representing the property to the
east appeared before the Commission. Mr. Schwartzman stated he was
against Mr. Hughes operation moving closer to his property.

The applicant has complied with all the conditions of his conditional
use permit. Attached is the resolution with the conditions.

The applicant will continue the berming and the landscaping along the
front of the site as required by the conditional use permit.
Mr. Hughes stated that he was not planning to fence all of the east
side along the Medalist building at this time. There would be a 60
foot gap where the Medalist building is located. Staff is
recommending that the east side be fenced entirely as required by the
original conditional use permit.
o Have there been any problems in the past with the auto storage
area?

To my knowledge there have been no complaints about the operation of
the auto storage area. Mr. Hughes has had a problem with the
evergreens in the front of the property dying, but has replaced all
the dead plantings.
Alternatives.
1. Approve the new boundaries of Dick's Towing auto storage area.
By approving the new boundaries the applicant will be able to
move his auto storage area to the east.
2 . Deny the new boundaries of Dick's Towing auto storage area.
By denying the new boundaries of the applicant he will not be
able to move the auto storage area, but will be able to keep
the area as is.
3 . Continue for further information. If the Commission feels
further information is needed, the item should be continued.

Gentlemen;
This is to reply to your notice of a hearing to be held on September 25,
1990. The hearing is to consider an application by Dick Hughes for an
amendment to his conditional use permit at 900 Second St . N.E.
This is to inform you that we are strongly opposed to Mr. Hughes moving
his operation to the East of its present location(closer to our buiiding) .
The storage and towing operation, even in its present location is an
eyesore and not in keeping with the commercial use of other businesses in
� the area. It has been detrimental to our building and will be even more
so if it comes closer to us.
We have a very large investment in our property and the building is now
for sale. Having this type of operation so close to us will cause
us great damage in our ability to sell the building for a good commercial
use.
It is also our understanding that Mr. Hughes has already moved his fence
to the East and begun using the property he is asking for a hearing on.
On September ]3, I spoke to Nancy Anderson to register a complaint that
in our opinion Mr Hughes has moved onto property he has no permission to
use.
Again, we feel this use of the property will do us great damage.

WHEREAS, an application for a Conditional Use Permit
Amendment entitled CUP90-5 made by the Dick

2 . That the Hopkins Planning Commission reviewed
such application on September 25, 1990.
3 . That the Hopkins Planning Commission,
pursuant to published and mailed notices,
held a public hearing on September 25, 1990:
all persons present at the hearing were given
an opportunity to be heard.
4 . That the written comments and analysis of the
� City Staff and the Planning Commission were
considered.
NOW THEREFORE BE IT RESOLVED, that application for
Conditional Use Permit Amendment CUP90-5 is hereby
recommended for approval subject to the following
Findings of Fact:
1. That the applicant comply with the conditions
set forth in Resolution No. R87-89
