This permit is not valid until it has been recorded at the Office of the County Recorder . Staff recommends approval of the following motion: Move to adopt Resolution No: 90-68 approvinq the Conditional Use Permit to allow construction of a 6600 square foot buildinct at 302 Blake Road. Approval of this motion will allow the construction of a 6000 square foot building at 302 Blake Road. overview. On January 9, 1990, the City Council designated the subject site as surplus property. The City Council also directed staff to solicit proposals. Requests for Proposals were mailed to 5 developers. Two proposals were received by the City at the end of March. The proposal from Marcus Corporation was selected. On February 27, 1990 the rezoning of the site from R-4 residential to B-3 business became effective. The applicant, Marcus Corporation, is in the process of purchasing the well site on Second Street and Blake Road from the City. The applicant is proposing to construct a 6600 square foot building for .--� retail. Staff is recommending approval because the applicant meets the ordinance requirements. Mark Senn appeared before the Commission. The Commission had reviewed the proposal at the previous meeting. Mr. Senn showed the Commission samples of the exterior material for the proposed structure. The Commission discussed the landscaping, fencing, heating and air conditioning units, and the access to the property. The Commission unanimously approved Resolution No. Z90-il approving the Conditional Use Permit with conditions. The site will require 30 spaces for retail. 7 spaces are designated as compact. The site is allowed to have 25% of the spaces as compact. Staff is recommending that the one parking space near the entrance on Second Street be eliminated. Access. Access to the site is proposed from Blake Road and Second Street. The access from Blake Road will have to be approved by Hennepin County. If access is not granted by the County on Blake Road, the site will have only one access point which is acceptable to staff. The access point from Second Street is lined up with the access point to Fina. Staff has reviewed the access point on Second Street with Mitch Wonson of Benshoof and Associates. The plan reflects the design from Mitch Wonson. One concern of the staff's is the traffic flow behind the building. ^ There maybe a problem with traffic coming from both sides since the road will be narrow. Staff is recommending that the applicant work with staf f to determine which traf f ic f low wi 11 work the best and to designate the road 'ONE WAY' . The following are the B-3 requirements and the proposed site plan: B-3 Proposed front yard 20 feet 74 feet rear yard 25 feet 25 feet side yard south 10 feet 45 feet north 15 feet 25 feet height 45 feet 16 feet Landscaping. The site plan shows a variety of plantings. The site is required to have 15 trees. The site plan shows 4 trees of the required size plus additional shrubs throughout the site. The applicant has stated that he will add additional trees on the site. However, the applicant will not be able to add 11 trees to the site. Probably only two or three additional trees will be added to the site. The Commission can grant a waiver where compliance restricts off-street parking. The Engineering Supervisor has reviewed the plans and found them acceptable. The site will drain to a catch basin on the southeast corner of the site. The applicant will have to receive permission from Hennepin County to connect to the existing catch basin. Fire Marshal. The Fire Marshal has reviewed the plans and found them acceptable. If the access from Blake Road is not granted from the County the plan is still acceptable. FencinQ. The plans have detailed a 6 foot chain link fence/vinyl slat. The applicant will bring a picture of the fence. However, if the Commission indicates that a wood fence would buffer the residential area better, the applicant will construct a wood fence. The staff is recommending a wood fence. The fence along the north side of the site will be extended. The ordinance requires a 3 1/2 foot fence between the residential ^ districts and parking lots. The applicant has agreed to extend the f ence. Exterior Materials. The proposed building will have a variety of materials. The building will have a band around the top with a mixture of inetal and cement plaster. Rockface material will be on the back of the building and in a few areas on the front. The building will have earth tone colors. The applicant will bring samples of the materials to the meeting. Trash. The trash container is located on the northwest corner of the site. The container is enclosed on three sides with a six foot fence. Access to the trash container will be from the rear of the site. Staff is recommending enclosing the container on four sides. Primary Issues to Consider. o Is the proposed use allowed in the B-3 district? The applicant is proposing retail uses. The B-3 district is a general business district which allows most retail uses. This type of fence is being proposed because the fence does not look as bulky. However, the applicant will erect a wood fence if the Commission indicates a wood fence is preferred. The staff would recommend a wood fence. The fence on the north side of the property will have to be extended which the applicant has indicated he will do. Most of the activity on the site occurs away from the residential areas. The apartments to the west are buffered by the building and a fence. The nearest apartment building to the west is oriented to the north and south not in the direction of the site. The residential area to the north also does not have any apartments looking into the site. The fence along the north lot line will block .�. any activity on the site. Alternatives. 1. WHEREAS, the procedural history of the application is as follows: 1. That an application for Conditional Use Permit CUP90-3 was filed with the City of Hopkins on June 1, 1990. 2 . That the Hopkins Planning Commission reviewed such application on June 26. 3 . That the Hopkins Planning Commission, pursuant to published and mailed notices, held a public hearing on June 26 and continued to July 31, 1990: all persons present at the hearing were given an opportunity to be heard. 4 . That the written comments and analysis of the City Staff and the Planning Commission were considered. ^ NOW THEREFORE BE IT RESOLVED, that application for Conditional Use Permit CUP90-3 is hereby recommended for approval subject to the following Findings of Fact: 1. That the proposed building meets the requirements for the B-3 district. 2 . That retail uses are allowed in the B-3 district. Staff recommends the following motion: Move that the conditional use permit for Marcus Corporation be continued to the July 31, 1990 meetina. The applicant will be asking for final approval next month. The site plan is for the Commission's preliminary review and comments. Approval of this action will allow the applicant to return to the July meeting for final action. Overview. The applicant, Marcus Corporation, had wanted to get all the information required for the June meeting, but was unable to do so.
