Staff recommends the following motion: "Move to adopt Resolution No• 89-110 approvinct a Conditional Use Permit to operate an auto sales lot with conditions at 420 Mainstreet". Approval of this Conditional Use Permit will allow Trakup Corporation to operate an auto sales lot for used and collectible automobiles at 420 Mainstreet. overview. Last July Dexis Corporation was granted a Conditional Use Permit to operate an auto sales lot at this 420 Mainstreet. Dexis Corporation did not go through with their proposed plan. Now the owner of the building, Trakup Company, is applying for a Conditional Use Permit to operate an auto sales lot similar to the one previously granted. The applicant, in conjunction with Minnetonka Motors, proposes to establish an auto sales business. Since the business does not sell the average type cars, a large display lot is not needed. The display lot that is on the site plan shows a car display area for 24 cars. This number may vary depending on the turnover of the cars. � The applicant is proposing 2500 square feet for office and showroom and 5000 square feet for vehicle cleanup/storage. There will be no major repair or body work done on the site. Staff is recommending approval because the applicant meets the requirements for a Conditional Use Permit for an auto sales lot. Bill Traiser and Don Soukup, owners of the property, appeared before the Commission and explained that a CUP was granted to another applicant for an auto sales lot at this location last summer but they decided not to move in. As owner of the building they are applying for the CUP for the auto sales lot. The application remains the same as previously approved. The Zoning and Planning Commission unanimously approved Resolution No. Z89-32 recommending approval of an auto sales lot at 420 Mainstreet. The following are the requirements for an auto sales lot in a B-3 district: 1. the sales lot shall not be larger in square footage than the square footage of the building devoted to the related business; 2 . the 20 feet required front yard shall be landscaped and should the front yard be less than 20 feet due to non-conforming use, a permanent barrier at least 18 inches high shall separate the sales lot from the public walk; 3. lighting of the sales lot shall be totally from indirect lighting; 4. should the lot abut an R district, an acceptable design of screening fence five feet in height shall be constructed along the abutting lot line; 5. the auto sales lot shall not include vehicles over a 9, 000 lb. rated weight. --� Surrounding IIses. The subject site is surrounded on three sides by auto related uses. Rudy Luthers Hopkins Honda is to the north, the Hopkins Car Wash and Walser Chrysler Plymouth are to the east, and a business to the west. The rear of the site is a wholesale/distribution company. Site Improvements. The exterior of the building is brick and in good repair. The applicant will clean up and trim the landscaping in the front. No exterior remodeling except that new front glass windows will be installed. Also, a side drive-in door will be added on the west. Primary issues to consider. o Does the proposed auto sales lot meet the requirements for a Conditional Use Permit? The applicant meets all the requirements as outlined in the detailed background. The applicants business is blocked from the residential district to the south by another building and a railroad right-of-way. � I •� DEXIS CORPORATION - CONDITIONAL USE PERMIT CR:89-283 Page 3 o Does the site have adequate parking spaces for all of the businesses occupying the site? , One of the concerns of the staff is the parking situation with the proposed auto lot and the wholesale/distribution company to the rear. The business in the rear has not been a problem in the past, but we do not know how the new use and the existing operation will function together on the site. The applicants operation is required to have 8 off-street parking spaces. The site plan shows 12 off-street parking spaces and 24 spaces for car displaying. The business to the rear is required to have 6 parking spaces. The parking area for the rear business is south of the applicants parking. The applicants parking lot is divided with the parking area to the east with curb stops. This will prevent the parking lots from sharing parking and allow the applicants parking lot to function on its own. The applicant is required to mark the parking area. The staff is recommending that the customer parking be clearly marked for the � customers. One nice feature of the applicants type of business, is that additional parking can always be obtained by reducing the number of display cars. I would recommend that six months after the applicants occupy 420 Mainstreet that the Planning Commission review the parking situation on the site, and if changes are needed, the applicant be required to provide more off-street parking. Alternatives. 1. Approve the Conditional Use Permit for an auto sales lot at 420 Mainstreet. By approving the Conditional Use Permit the applicant will be able to operate an auto sales lot. 2.
