SUBJECI': Conditional Use Permit for a five foot fence

This item was continued from the last meeting. The following are the options the Council
considered at the last meeting:
- approve the five foot fence as is
- move the five foot fence even with the home
--�. - deny the five foot fence
The Zoning Ordinance rec�uires that the fence is necessary to protect, buffer or improve
the premises. If the Council approves the 5 foot height, the Council has to state findings of
fact that support those requirements.
The Zoning and Planning Commission determined that the fence met none of the
requirements for a special purpose fence and denied the applicants request.
A few years ago the Council denied a 6 foot fence in Park Valley between homes because
the fence met none of the requirements.
The staff has had no feedback from Mr. Lewis or the neighbors since the last meeting.

CONDITIONAL USE PERMIT - FENCE
Proposed Action.
Staff recommends the following motion: "Move to adopt Resolution R89-
82 denvinct the conditional use permit to allow a 5 foot fence in the
front and side yards at 324 lOth Avenue North. "
Adoption of this motion will not allow the existing 5 foot fence in
the front and side yards.
The Commission unanimously denied the conditional use permit to allow
a five foot fence in the front side yard.
Overview.
The applicant is requesting a conditional use permit to allow a 5 foot
fence in his front yard and side yard. The applicant constructed a 5
foot fence in his front and side yard without receiving a fence
� permit. 5 foot fences are not allowed in the front yard and between
homes in the side yard.
The ordinance provides that a conditional use permit may be granted
for a fence differing in construction, height or length.
Staf f is recommending denial because the subj ect �fence does not meet
the requirements for a special purpose fence.
Tim Lewis, the applicant, appeared before the Commission. Mr. Lewis
stated he built the fence to keep his children and dogs in his yard.
The Commission was concerned that the fence did not fit with the
character of the neighborhood. Several neighbors appeared stating
their objections to the fence. -

Backqround.
In August 1988 a resident of Park Valley applied for a conditional use
permit to construct a 6 foot fence between the homes on the side yard.
This conditional use permit was denied by the Planning Commission and
the City Council. The reason given by the resident for the fence was
to buffer the home from the abutting home to the north.
The following are the finding of fact that were given at the time of
the denial:
l. That the neighborhood was constructed with the homes close
together.
2 . That a 6 foot fence would have an adverse affect on the
abutting neighbor.
3 . That the granting of the Conditional Use Permit for this
fence would set a precedent for all of Park Valley to have 6
� foot fences between homes.
Primary Issues to Consider.
o Does the applicant meet the �requirements for a special purpose
fence?
Ordinance 520.13 subd. 9. states fences for special purposes and
fences differing in construction, height or length may be permitted in
any district in the City by the issuance of a conditional use permit
by the Council upon proof and reasons submitted by the applicant and
upon the signing by said bodies that such special purpose is necessary
to protect, buffer or improve the premises for which such fence is
intended. The special fence permit, if issued, may stipulate and
provide for the height, location, construction and type of special
fence thereby permitted.
This situation is similar to the Park Valley fence. The reasons given
for denial would apply to this situation. Much of Hopkins was built
with the homes close together and if the residents start putting up 5
or 6 foot fences in the front yards, the openness of the residential
areas in Hopkins will change.
The ordinance states that the fence is necessary to protect, buffer
-- and improve the premises. The subject fence was not constructed for
any of those reasons. Having a large dog is not a special situation.
The granting of this conditional use can set a precedent in Hopkins.
Other residents may have larger dogs and want a 6 foot fence in the
front yard.

The applicant has submitted a list of neighbors that do not object to
his fence. However, by allowing the subject fence the City would have
a difficult time refusing other residents the same request. I do not
believe that the neighbors who signed the list thought of what could
happen in the future. Other residents could construct higher or
similar fences and their neighborhood could become totally fenced.

RESOLUTION MAKING FINDINGS OF FACT AND DENYING
APPLICATION FOR CONDITIONAL USE PERMIT CUP89-15
WHEREAS, an application for a Conditional Use Permit
entitled CUP89-15 made by Timothy Lewis, 324 lOth
Avenue North, to construct a five foot fence in
the front and side yards is hereby denied.
WHEREAS, the procedural history of the application is as
follows:
1. That an application for Conditional Use
Permit CUP89-15 was filed with the City of
Hopkins on August 28, 1989.
2 . That the Hopkins Planning Commission reviewed
such application on September 26, 1989.
3 . That the Hopkins Planning Commission,
pursuant to published and mailed notices,
"� held a public hearing on September 26, 1989:
all persons present at the hearing were given
an opportunity to be heard.
4 . That the written comments and analysis of the
City Staff and the Planning Commission were
considered.
NOW THEREFORE BE IT RESOLVED, that application for
Conditional Use Permit CUP89-15 is hereby denied
subject to the following Findings of Fact:
l. That the applicant does not have a special
purpose to justify a 5 foot fence in the
front and side yard.
2 . That the granting of the Conditional Use
Permit for the subject fence would set a
precedent for all of Hopkins to have higher
than allowed fences in the front and side
yards.

Backqround.
In August 1988 a resident of Park Valley applied for a conditional use
permit to construct a 6 foot fence between the homes on the side yard.
This conditional use permit was denied by the Planning Commission and
the City Council. The reason given by the resident for the fence was
to buffer the home from the abutting home to the north.
The following are the finding of fact that were given at the time of
the denial:
1. That the neighborhood was constructed with the homes close
together.
2 . That a 6 foot fence would have an adverse affect on the
abutting neighbor.
3 . That the granting of the Conditional Use Permit for this
fence would set a precedent for all of Park Valley to have 6

foot fences between homes.
Primarv Issues to Consider.
o Does the applicant meet the requirements for a special purpose
fence?
Ordinance 520. 13 subd. 9. states fences for special purposes and
fences differing in construction, height or length may be permitted in
any district in the City by the issuance of a conditional use permit
by the Council upon proof and reasons submitted by the applicant and
upon the signing by said bodies that such special purpose is necessary
to protect, buffer or improve the premises for which such fence is
intended. The special fence permit, if issued, may stipulate and
provide for the height, location, construction and type of special
fence thereby permitted.
This situation is similar to the Park Valley fence. The reasons given
for denial would apply to this situation. Much of Hopkins was built
with the homes close together and if the residents start putting up 5
or 6 foot fences in the front yards, the openness of the residential
areas in Hopkins will change.
The ordinance states that the fence is necessary to protect, buffer
and improve the premises. The subject fence was not constructed for
-� any of those reasons. Having a large dog is not a special situation.
The granting of this conditional use can set a precedent in Hopkins.
Other residents may have larger dogs and want a 6 foot fence in the
front yard.

The applicant has submitted a list of neighbors that do not object to
his fence. However, by allowing the subject fence the City would have
a difficult time refusing other residents the same request. I do not
believe that the neighbors who signed the list thought of what could
happen in the future. Other residents could construct higher or
similar fences and their neighborhood could become totally fenced.
