Staff recommends the following motion: "Move to adopt Resolution No• 89-56 apt�rovinq Conditional Use Permit to operate an auto sales lot at 420 Mainstreet with conditions". Approval of this Conditional Use Permit will allow Dexis Corporation to operate an auto sales lot for used and collectible automobiles at 420 Mainstreet. The Commission approved the Conditional Use Permit on a 5-1 vote. Overview. The applicant, Dexis Corporation, operates and sells collectible automobiles. The applicant is proposing to locate in an existing vacant building at 420 Mainstreet. Since the business does not sell the average type cars, a large display lot is not needed. The display lot that is on the site plan _ shows a car display area for 24 cars. This number may vary depending on the turnover of the cars. The applicant is proposing 2500 square feet for office and showroom and 5000 square feet for vehicle cleanup. There will be no major . repair or body work done on the site. Jim Burnett, representing Dexis Corporation, appeared before the Commission. He stated that the existing building lends itself to auto sale. Mr. Maxwell was concerned about the parking in the area and the tenant in the rear of the building not having enough parking. There was considerable discussion about the parking in the area and on the site. It was noted that the applicant has met the parking requirements and if other businesses in the area are currently using the applicants parking area they have no permission to use. it. Staff is recommending approval because the applicant meets the requirements for a Conditional Use Permit for an auto sales lot. The following are the requirements for an auto sales lot in a B-3 district: 1. the sales lot shall not be larger in square footage than the square footage of the building devoted to the related business; 2. the 20 feet required front yard shall be landscaped and should the front yard be less than 20 feet due to non-conforming use, a permanent barrier at least 18 inches high shall separate the sales lot from the public walk; 3 . lighting of the sales lot shall be totally from indirect lighting; 4. should the lot abut an R district, an acceptable design of screening fence five feet in height shall be constructed along the abutting lot line; ---� 5. the auto sales lot shall not include vehicles over a 9,000 lb. rated weight. _ Surroundinq IIses The subject site is surrounded on three sides by auto related uses. Rudy Luthers Hopkins Honda is to the north, the Hopkins Car Wash and Walser Chrysler Plymouth are to the east, and a business to the west. The rear of the site is a wholesale/distribution company. Site Improvements The exterior of the building is brick and in good repair. The applicant will clean up and trim the landscaping in the front. No exterior remodeling is planned at this time. Primarv issues to consider o Does the proposed auto sales lot meet the requirements for a Conditional Use Permit? The applicant meets all the requirements as outlined in the detailed background. The applicants business is blocked from the residential ^ district to the south by another building and a railroad right-of-way. —� DEXIS CORPORATION - CONDITIONAL USE PERMIT CR:89-179 Page 3 o Does the site have adequate parking spaces for all of the businesses occupying the site? One of the concerns of the staff is the parking situation with the proposed auto lot and the wholesale/distribution company to the rear. The business in the rear has not been a problem in the past, but we do not know how the new use and the existing operation will function together on the site. The applicants operation is required to have 8 off-street parking spaces. The site plan shows 12 off-street parking spaces and 24 spaces for car displaying. The business to the rear is required to have 6 parking spaces. The parking area for the rear business is south of the applicants parking. The applicants parking lot is divided with the parking area to the east with curb stops. This will prevent the parking lots from sharing parking and allow the applicants parking lot to function on its own. � The applicant is required to mark the parking area. The staff is recommending that the customer parking be clearly marked for the customers. One nice feature of the applicants type of business, is that additional parking can always be obtained by reducing the number of display cars. I would recommend that six months after the applicants occupy 420 Mainstreet that the Planning Commission review the parking situation on the site, and if changes are needed, the applicant be required to provide more off-street parking. Alternatives. 1. Approve the Conditional Use Permit for an auto sales lot at 420 Mainstreet. By approving the Conditional Use Permit the applicant will be able to operate an auto sales lot. 2. Approve the Conditional Use Permit for an auto sales lot at 420 Mainstreet with conditions. By approving the Conditional Use Permit with conditions the applicant will be required to return to the Planning Commission in six months for a review of the parking situation. 3. Deny the Conditional Use Permit for an auto sales lot at 420 Mainstreet. By denying the Conditional Use Permit the '-` applicant will not be able to operate an auto sales lot. The Commission will have to state findings of fact which support the denial. 4. Continue for further information. The main business will be the sales of collectible automobiles such as Corvettes, and cars of the 50' s, 60 ' s and 70's . In Minnesota, this type of car sales is seasonable, and therefore, during the off season other types of more conventional vehicles will be sold. The corporation's owners have previous experience in this type of business, and view a Hopkins � Mainstreet location as very desirable. BUILDING AND SITE UTILIZATION: The site is located in an area of other car dealers, a carwash, and a Burger King. The building contains an office area and showroom area of approximately 2500 square feet, and a warehouse/car cleanup area of approximately 5000 square feet. Vehicle cleanup and minor repair will be done on site, however, no body or paint work will be done. Proposed are a display lot for 24 vehicles, and off street parking for 6 customers, and 6 employees . These are consistent with zoning and site requirements. The rear bay is occupied by a whosale / distribution company and presents no conflict in site usage. � � -2- BUILDING AND SITE AESTHETICS: The site is currently landscaped in a desirable manner, however, due to vacancy, trimming and minor replanting are required, and will be accomplished. The building exterior is brick and block, and is in good repair. The interior is also in good repair, however, minor redecorating will be required. No exterior building modifications are planned. Signs and lighting will be in conformance with applicable requirements . The reqUirement of a conditional use permit in connection with any use in any B district is indicated in subsection 535.01 by appropriate capital letters (A, B� C etc) � which letters refer to the appropriate paragraph in this subsection bearing the same capital letter. Subd. 2. Conditional uses within B district. A) Auto sales including sales lot and major auto repair provided: 1 . the sales lot shall not be larger in square footage [han the square footage of the building devoted to the related business; 2. the 20 feet required front yard shall be landscaped and should the front yard be less t1�an 20 feet due to non-conforming use, a permanent barrier at least 18 inches high st�all separate the sa)es lot from the public walk; 3. lig}�ting of the sales lot shall be totally from indirect 1ig11tin�,; 4, should the lot abutt an F district an acceptable design of screening fence five feet in }ieight shall be constructed along the abutting lot line; '� 5. the auto sales lot shall not include vehicles over a 9.00� lb. rated weigiit. B) Ar�orv, auditorium or exhibit hall in the B-2 busine�s zone provided: 1, it is an accessory use to an ex.isting permitted business; 2. one off-street loading dock is provided and in the B-3 business zone; " 3. the facilit�• }ias frontage on a major thoroughfare as shok-n on the adopted ttioroughfare plan; 4. has one parking space for each five seats of rated capacity; 5. has an off-street loading dock for the first 5,000 sq. ft. and another for each additional 10,000 sq. ft. up to three docks; 6. has an off-street traffic design for droppins off and picking up pedestrians outside of the required yards and public right-of-wa}�; 7. all frontage on a public street shall be considered as front yard. i� JCITY OF HOPKINS _ Hennepin County, Minnesota RESOLUTION NO: Z89-10 RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF APPLICATION FOR CONDITIONAL USE PERMIT CUP89-10 WHEREAS, an application for a Conditional Use Permit entitled CUP89-10, made by Dexis Corporation, to allow an auto sales lot at 420 Mainstreet is recommended for approval. WHEREAS, the procedural history of the application is as follows: l. That an application for Conditional Use Permit CUP89-10 was filed with the City of Hopkins on June 30, 1989. 2 . That the Hopkins Planning Commission reviewed such application on July 25, 1989. 3. That the Hopkins Planning Commission, pursuant to published and mailed notices, held a public hearing on July 25, 1989: all persons present at the hearing were given an opportunity to be heard. _...-, 4 . That the written comments and analysis of the City Staff and the Planning Commission were considered. NOW THEREFORE BE IT RESOLVED, that application for Conditional Use Permit CUP89-10 is hereby recommended for approval subject to the following Findings of Fact: l. That an auto sales lot is a conditional use within a B-3 district. 2. That the proposed auto sales lot meets the conditions for an auto sales lot BE IT FURTHER RESOLVED, that application for CUP89-10 is hereby recommended for approval subject to the following Conditions: 1. That the parking situation at the applicants auto sales lot be reviewed in six (6) months after occupancy. 2. That the sales lot be limited to a maximum of 24 cars. 3.
