This permit is not valid until it has been recorded at the Office of the County Recorder . A true and correct copy of the full legal description of the affected property must be attached to this document . 2 . This permit does not constitute a building permit , sewage system permit , grading permit , land alteration permit , well permit or the like . Separate permits may have to be applied for and obtained in order to accomplish all the goals of the project authorized herein . 3 . Staff recommends approval of the following motion: "Move approval of Resolution No: 89-33 to construct five townhouses within a PUD" . Approval of this motion will allow construction of five townhomes. The Commission unanimously approved the Conditional Use Permit to construct five townhomes with a P.U.D. overview. The applicant is proposing to extend the West Oaks Townhomes into Hopkins. Currently all the townhomes are in Minnetonka. When this development was first approved, the Hopkins land was to be used as a holding pond for water. Since this project was approved by Minnetonka, the applicant has made changes in the drainage so the Hopkins land is no longer needed totally for a holding pond. We have talked to the Minnetonka staff ^ about this site and they have no objection to the construction of the townhomes. Most of the west end of the site will remain as a holding pond for water. Staff is recommending approval because the project conforms to the ordinance and will also provide a quality development in Hopkins. At the Zoning & Planning meeting a Minnetonka resident was concerned about the traffic on North Oakvale Road turning onto County Road #73. He stated that this intersection has had many accidents. The proposed road to the townhomes will be opposite North Oakvale Road. Staff was instructed to have the Director of Engineering review the situation and report to the City Council. Staff will update the Council at the meeting. The west part of the site is lower than the east and is and will continue to be used as a water holding pond. The walking path to the south will remain. Access Access to the site will be from County Road #73. The applicant will have to receive permission from the County for this access. The internal road will also continue north into the Minnetonka Townhomes. Gradinq/Drainaqe The Director of Engineering has reviewed the grading/drainage plan and found them acceptable. Drainage will flow toward the west. � The applicant has talked with the Minnehaha Watershed District but has not yet received approval. Any approval should be contingent on watershed approval. IItilities � The utility plan has been reviewed by the Director of Engineering. He has recommended that, if possible, all utilities be supplied by Hopkins. The proposed plan shows sanitary sewer from Minnetonka. Service is available from Hopkins on County Road #73. The applicant will see if it is possible to get the sanitary sewer from Hopkins. Current ZoninqlGuide Plan The current zoning is R-3. The R-3 district allows townhomes. The current guide plan designates this site as R-4 and the new guide plan as mediwn density multiple family. Both of these plans are consistent with the proposed plan. Fire Marshal The Fire Marshal has reviewed the plans and found them acceptable. Landscapin.g The site is required to have five trees. The landscaping plan "` reflects landscaping throughout the site. The walking path will be separated from the townhomes by a green area with trees. Trees will surround the holding pond. When the West Oaks development was proposed, the Hopkins site was to be used as a holding pond for water. During construction other things were done so the Hopkins site was not totally needed for a holding area. The proposed development will still allow for a holding pond on the west side of the site. The Minnetonka staff has no objection to the Hopkins site being ^ developed. o Will the development have an affect on the surrounding area? The proposed development should not affect any of the surrounding area. The traffic from the townhomes will be minimal and will not have access to the residential area to the south. If there were to be an impact on an area, it would be the residential area to the south. This area will be separated from this development by a great deal of landscaping. WHEREAS, the procedural history of the application is as follows: 1. That an application for Conditional Use Permit CUP89-5 was filed with the City of Hopkins on May 8, 1989. 2 . That the Hopkins Planning Commission reviewed such application on May 30, 1989. 3 . That the Hopkins Planning Commission, pursuant to published and mailed notices, held� a public hearing on May 30, 1989: all persons present at the hearing were given an opportunity to be heard. 4. That the written comments and analysis of the City � Staff and the Planning Commission were considered.
