GENERAL PROVISIONS
1 . This permit is not valid until it has been recorded at the Office of the
County Recorder . A true and correct copy of the full legal description of
the affected property must be attached to this document .
? . This permit does not constitute a building permit , sewage system permit ,
grading permit , land alteration permit , well permit or the like . Separate
permits may_ have to be applied for and obtained in order to accomplish all
the goals of the project authorized herein .
3 . The issuance of this permit does not negate the need to secure other permits
from other local units of government , state agencies or federal agencies xho
may also have jurisdiction over portions of your project .
SPECIAL PROVISIONS
1. That Hennepin County grants a driveway permit
2. That the Watershed District approved the proposed drainage.
3. That the proposed fence around the track must be reviewed by the City Council
prior to issuance of a fence permit.

E%PIRATION.
A Conditional IIse Permit expires one year after it has been issued unless the
use for which the permit has been granted is in effect . Extensions may be
granted provided the applicant submits a letter to the Zoning Administrator
requesting an extension 30 days before the expiration of said approval . The
letter shall state the facts of the request , shoWing a good-faith attempt to
utilize the Permit , and it shall also state the additional time being requested
to begin the proposed construction . The City Couneil may grant extensions not
to exceed one pear. '

Proposed Action.
Staff recommends the following motion: "Move that the Conditional Use
Permit to re-arade Blake athletic fields be approved "
The Commission voted unanimously to approve Resolution 89-27 which
will allow Blake Schools to upgrade their athletic fields.
overview.
Blake School is proposing to up-grade their existing athletic
facilities. This upgrading will consist of re-grading and re-
surfacing the existing fields. A new parking lot will be added along
with an access point on Blake Road. A conditional use permit is
required for the moving of 400 cubic yards of earth material.
Staff is recommending approval of the Conditional Use Permit because
it is an upgrading of the site and will have limited impact on the
surrounding area.
Mr. Gary Roller representing Blake Schools appeared before the
� Commission. Mr. Roller explained the proposed up-grading of the
athletic fields.
The Commision was concerned with dust control during the project. The
staff has discussed this with the applicant, and they will use dust
control measures during the project.
It was noted the internal road will be wide enough for parking and
access for emergency vehicles.
Two neighbors to the west of Blake School were concerned about the
wooded area on the west side of the school. The west side will not be
part of the project area.

Detailed Backqround.
Access to site.
Access on Blake Road will remain the same, only the internal road will
be moved to the north to provide a better use of the site. An
additional access point will be added on Excelsior Boulevard. The
applicant will have to secure a driveway permit from Hennepin County
for the new access.
Dra inac�e.
The Director of Engineering has reviewed the drainage and found it
acceptable. The site will drain to the north. A new detention pond
will be created adjacent to Excelsior Boulevard. The applicant has
been in contact with the Watershed District and will follow any
recommendations they require.
Landscapinq.
The site will be re-graded, an underground sprinkling system
installed, and re-seeded. The trees along the existing internal road
� will be transplanted within the site. Since the athletic fields
already exist, many of the trees and shrubs are already in place.
Parkinq Internallv
Lack of parking on the Blake site has been a problem in the past. The
site plan shows a new parking area with the capacity for approximately
100 cars. Also, the new internal road will be wide enough to
accommodate parking along the road. This additional parking should
keep the Blake parking on the site.
Site Characteristics
The site will remain basically the same, but all the fields will be
up-graded. Most noticeably will be the football and track area, which
after the up-grade will have a 6 foot fence around this area. No
bleachers or lights will be added to the football/track area.
Five tennis courts will be removed from the south end of the site and
replaced on the north end. Also removed from the site will be the
house and the maintenance building. A new building on the south side
of the site will be constructed at a later date.
Work Schedule
The applicant would like to start as soon as possible. Because of the
limited time in the summer available to do this type of work and have
it ready for the teams in the fall, it is very important that the
applicant start immediately. The work will begin on the south side of
� the property and move north.

Dust Control
The applican� will be using dust control during the grading operations
and will continue until the sod has been stabilized.
Primarv Issues to Consider
The Commission has the following issues to consider:
- Will the up-grading of the Blake athletic fields have an impact on
the surrounding area?
If anything, the up-grading of the Blake athletic fields should lessen
any impact that Blake has on the surrounding area. I believe that
traffic has had the most impact on the surrounding area. Now with the
additional access point, all of the traffic will not use the Blake
Road access point. The parking situation should be greatly improved
with the new parking lot and the wider road that will accommodate
parking along the road.
^ The athletic fields exist already so it is not a change of use for the
area. No lights will be added to the football field which will only
allow Blake to play their football games in the afternoon. Not that
much is changing on the site because almost all of the facilities
already exist.
Alternatives.
1. Approval of the Conditional Use Permit. By approving the
Conditional Use Permit, Blake will be able to up-grade
their existing athletic facilities.
2 . Deny the Conditional Us Permit. By denying the
Conditional Use Permit, Blake will not be able to up-
grade their athletic facilities.
3 . Continue for further information. It is recommended that
the item not be continued because of the relatively short
time the applicant has to work in the summer.

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR CONDITIONAL USE PERMIT CUP89-4
WHEREAS, an application for a Conditional Use Permit
entitled CUP89-4 made by Blake School, 110 Blake
Road South, to up-grade the athletic fields is
approved.
WHEREAS, the procedural history of the application is as
follows:
1. That an application for Conditional Use
Permit CUP89-4 was filed with the City of
Hopkins on March 31, 1989.
2. That the Hopkins Planning Commission reviewed
such application on April 25, 1989.
3 . That the Hopkins Planning Commission,
pursuant to published and mailed notices,
held a public hearing on April 25, 1989 : all
persons present at the hearing were given an
opportunity to be heard.
^ 4. That the written comments and analysis of the
City Staff and the Planning Commission were
considered.
NOW THEREFORE BE IT RESOLVED, that application for
Conditional Use Permit CUP89-4 is hereby approved
subject to the following Findings of Fact:
1. That the up-grading of the Blake athletic
facilities will allow more on-site parking.
2 . That the up-grading of the Blake athletic
facilities will provide a second access point
to the site.
BE IT FURTHER RESOLVED, that application for Conditional Use
Permit CUP:89-4 is hereby approved subject to the
following Conditions:
1. That Hennepin County grants a driveway
permit.
2 . That the Watershed District approved the
proposed drainage.
3 . That the proposed fence around the track must

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR CONDITIONAL USE PERMIT CUP89-4
WHEREAS, an application for a Conditional Use Permit
entitled CUP89-4 made by Blake School, 110 Blake
Road South, to up-grade the athletic fields is
approved.
WHEREAS, the procedural history of the application is as
follows:
l. That an application for Conditional Use
Permit CUP89-4 was filed with the City of
Hopkins on March 31, 1989.
2 . That the Hopkins Planning Commission reviewed
such application on April 25, 1989.
3 . That the Hopkins Planning Commission,
pursuant to published and mailed notices,
held a public hearing on April 25, 1989: all
persons present at the hearing were given an
opportunity to be heard.
_� 4. That the written comments and analysis of the
City Staff and the Planning Commission were
considered.
NOW THEREFORE BE IT RESOLVED, that application for
Conditional Use Permit CUP89-4 is hereby approved
subject to the following Findings of Fact:
1. That the up-grading of the Blake athletic
facilities will allow more on-site parking.
2. That the up-grading of the Blake athletic
facilities will provide a second access point
to the site.
BE IT FURTHER RESOLVED, that application for Conditional Use
Permit CUP:89-4 is hereby approved subject to the
following Conditions:
1. That Hennepin County grants a driveway
permit.
2. That the Watershed District approved the
proposed drainage.
3 . That the proposed fence around the track must
be reviewed by the City Council prior to
issuance of a fence permit.

Gary Roller, representing Blake School, appeared before the
Commission. Mr. Roller stated that the lights on the parking
area and along the roadway are for safety. The lights would be
25 feet high and use both a timer and photo cells.
� Mr. Roller stated that the athletic field lights will use 90 and
70 foot poles. The reason for the high poles is that there is
less impact on the surrounding area because the light is more
� direct. The Commission was concerned about the height of the
poles and asked Mr. Roller to show the Council an example of a 90
foot pole. _ �
� An example to compare the height of the light poles is the Blake
water tower which is approximately 113 feet high.
Mr. Roller stated that the shortest distance from the residential
neighborhood to the lights is 500 feet.

residents on June 14. The issue of putting lights on the site

residents did not object to adding lights on the Blake site.
The Zoning Ordinance does not address lights on athletic fields,
only lights in parking lots. The only requirement for lighting
in parking lots is that the light be shaded or diffused from
adjoining property and away from abutting traffic.
The staff would recommend the following additional Condition:

RESOLUTION NO: 89-27
RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR CONDITIONAL USE PERMIT CUP89-4
WHEREAS, an application for a Conditional Use Permit entitled
CUP89-4 made by Blake School, 110 Blake Road South, to
up-grade the athletic fields is approved.
WHEREAS, the procedural history of the application is as follows:
l. That an application for Conditional Use Permit
CUP89-4 was filed with the City of Hopkins on
March 31, 1989.
2. That the Hopkins Planning Commission reviewed such
application on April 25, 1989. --
3 . That the Hopkins Planning Commission, pursuant to
published and mailed notices, held a public
hearing on April 25, 1989: all persons present at
the hearing were given an opportunity to be heard.
4. That the written comments and analysis of the City
Staff and the Planning Commission were considered.
-� NOW THEREFORE BE IT RESOLVED, that application for Conditional
Use Permit CUP89-4 is hereby approved subject to the
following Findings of Fact:
,� 1. That the up-grading of the Blake athletic
facilities will allow more on-site parking.
2. That the up-grading of the Blake athletic
facilities will provide a second access point to
the site.
BE IT FURTHER RESOLVED, that application for Conditional Use
Permit CUP:89-4 is hereby approved subject to the
following Conditions:
1. That Hennepin County grants a driveway permit.
2. That the Watershed District approved the proposed
drainage.
3. That the proposed fence around the track must be
reviewed by the City Council prior to issuance of a
fence permit.
4. That the lighting is confined to the site and will not
negatively impace the surrounding area. *
