RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR CONDITIONAL USE PERMIT CUP89-1
WHEREAS , an application for a Conditional Use
Permit entitled CUP89-1 made by Edco Products , Inc . , 845
East Excelsior Avenue , to construct a warehouse and light
manufacturing building is approved .
WHEREAS , the procedural history of the application
is as follows :
1 . That an application for Conditional Use Permit
CUP89-1 was filed with the City of Hopkins on
January 3 , 1989 •
2 . That the Hopkins Planning Commission reviwed
such application on January 31 , 1989 .
3 . That the Hopkins Planning Commission , pursuant
to published and mailed notices , held a public
hearing on January 31 , 1989 ; all persons
present at the hearing were given an
opportunity to be heard .
� � . That the written comments and analysis of the
City Staff and the Planning Commission were
considered .
NOW THEREFORE BE IT RESOLVED , that the Hopkins
City Council makes the following Findings of Fact in respect
to CUP89-1 :
1 . That the proposed building complies with the I-1
requirements .
2 . That the use of the proposed building is
allowed in the I-1 district .
BE IT FURTHER RESOLVED , that application for
Conditional Use Permi CUP8g-1 is hereby approved subject to
the following Conditions:
1 . That the 10 parking spaces along Tyler Avenue
are removed .
2 . That the loading berths shall not be in the
front yard setback .

Proposed Aetion .
Staff recommends the following motion : "Adopt Resolution No . 89-$
approvin� Conditional Use Permit CUP89-1 to allow construction of an
18 ,710 square foot buildin� for warehouse and li�ht manufacturin� of
metal buildin� products at 41 Tyler Avenue North
Approval of this motion will allow the applicant to construct an
18 ,710 square foot building .
The Commission unanimously voted to recommend approval of Resolution
No . 89-8 which will allow construction of a 18 ,710 warehouse and light
manufacturing building .
Overview.
The applicant is requesting to construct an 18 ,710 square foot
building . The site to be used currently is used for parking
recreational vehicles . The applicant also owns the existing building
to the northeast and the building to the south .
� The proposed building will be used by the applicant for the
manufacturing of inetal building products and also manufacturing . The
existing building is used for the same purpose .
David Krischt , representing Edco Products , appeared before the
Commission . Mr. ICirseht explained that the plan had been changed to
meet the eoncerns of the staff. It was noted that the proposed
building meets all of the ordinance requirements .
The Commission was concerned with the exterior of the building and
that it would not be ehanged prior to construction . Staff assured the
Commission that if the exterior was ehanged it would be broght back
before the Commission . Mr. Kirscht stated that Edco does have a
building similar to the proposed exterior on their property on Tyler .

Site Charaeteristics .
The west part of the site currently is used for parking recreational
vehicles . The east part of the southerly portion is used as a parking
area . The north lot is paved , but the south lot is gravel . The
parking areas are lower than the west part of where the proposed
building will be built . The subject site is surrounded by industrial
and business uses .
The applicant has notified Custom Coach , the owners of the
recreational vehicles , that they must remove their vehicles .
Access .
Aceess to the new site will be from Tyler and Polk Avenues . Parking
areas are available for use from both access points . Tyler and Polk
Avenues are dead ends .
Current ZoninA .
The site is currently zoned I-1 . The uses as proposed are a permitted
use in an I-1 district .
Comprehensive Plan
^ The Comprehensive Plan has designated this site as industrial . The
proposed plan will comply with the Comprehensive Plan .
Loading Docks .
The building is required one loading dock 50 feet or more in length .
This requirements is met with the loading dock on the east side of the
building . The site plan also shows two more loading doeks on the west
side of the building . The loading docks to the west are in the front
yard setback and not allowed . The applicant will revise the site plan
to reflect the proper setbacks .
Parking.
The site plan shows 167 parking spaces not including the 10 parking
spaces along Tyler. These 10 parking spaces are not allowed because
they are in the front yard setback . The site as a whole is required
to have 136 parking spaces . The two parking areas abutting the
proposed building are currently used as parking areas . Both lots will
be improved with the construction of the proposed building .
The applicant has stated the 10 parking spaces will be removed .

Landscapin� .
The site requires 18 plantings . The landscape plan submitted meets
this requirement . The landscape plan shows landscaping throughout the
site .
Utilities .
Utilities for the proposed building are available from Tyler. The
Director of Engineering does not see a problem with the utilities .
DrainaAe .
The Director of Engineering has reviewed the drainage plan and found
it acceptable .
Exterior Surface .
The exterior surface will be decorative concrete block . The proposed
building will also have a panel around the top of the building . The
block will be a white color and the panels will be brown in color.
Fire Marshal .
The Fire Marshal has reviewed the proposed plans and found them
acceptable . He noted that the building will have to be sprinkled .

- Is the proposed building an improvement to the area?
This part of the City is older and hence many buildings that were
constructed do not have the amenities that the new construetion has .
Both sides of Tyler look like a parking lot , with cars on the west
side and recreational vehicles to the east .
This building will be an improvement to the area . A new building will
be built that will be heavily landscaped . The parking areas to the
proposed building are somewhat hidden because of the difference in
elevation .

Staff recommends the following motion: "Move that the 18 ,710 square
foot building for warehouse and li�ht manufacturin� of inetal buildin�
products at �41 Tyler Avenue North is approved" .
Approval of this motion will allow the applicant to construct an
18 ,710 square foot building .
Overview.
The applicant is requesting to construct an 18 ,710 square foot
building . The site to be used currently is used for parking
reereational vehicles . The applicant also owns the existing building
to the northeast and the building to the south .
The proposed building will be used by the applicant for the
manufaeturing of inetal building products and also manufacturing . The
existing building is used for the same purpose .

Detailed Background .
Site Characteristics .
The west part of the site currently is used for parking recreational
vehicles . The east part of the southerly portion is used as a parking
area . The north lot is paved , but the south lot is gravel . The
parking areas are lower than the west part of where the proposed
building will be built . The subject site is surrounded by industrial
and business uses .
The applicant has notified Custom Coach , the owners of the
recreational vehicles , that they must remove their vehicles .
Aecess .
Access to the new site will be from Tyler and Polk Avenues . Parking
areas are available for use from both access points . Tyler and Polk
Avenues are dead ends .
Current Zoning .
The site is currently zoned I-1 . The uses as proposed are a permitted
use in an I-1 distriet .
Comprehensive Plan .
�.�, The Comprehensive Plan has designated this site as industrial . The
proposed plan will comply with the Comprehensive Plan .
Loading Doeks .
The building is required one loading dock 50 feet or more in length .
This requirements is met with the loading dock on the east side of the
building . The site plan also shows two more loading docks on the west
side of the building . The loading docks to the west are in the front
yard setback and not allowed . The applicant will revise the site plan
to reflect the proper setbacks .
Parking.
The site plan shows 167 parking spaces not including the 10 parking
spaces along Tyler . These 10 parking spaces are not allowed because
they are in the front yard setback . The site as a whole is required
to have 136 parking spaces . The two parking areas abutting the
proposed building are currently used as parking areas . Both lots will
be improved with the construction of the proposed building .
The applicant has stated the 10 parking spaces will be removed .

Utilities .
Utilities for the proposed building are available from Tyler. The
Director of Engineering does not see a problem with the utilities .
Drainage .
The Direetor of Engineering has reviewed the drainage plan and found
it acceptable ,
Exterior Surface
The exterior surface will be decorative concrete block . The proposed
building will also have a panel around the top of the building . The
block will be a white color and the panels will be brown in color.
Fire Marshal .
The Fire Marshal has reviewed the proposed plans and found them
aeceptable . He noted that the building will have to be sprinkled .

Phis part of the City is older and hence many buildings that were
constructed do not have the amenities that the new construction has . ,
Both sides of Tyler look like a parking lot , with cars on the west
side and recreational vehicles to the east .
This building will be an improvement to the area . A new building will
be built that will be heavily landscaped . The parking areas to the
proposed building are somewhat hidden because of the difference in
elevation .
