GENERAL PROVISIONS
1 . This permit is not valid until it has been recorded at the Office of the
County Recorder . A true and correct copy of the full legal description of
the affected property must be attached to this document .
2 . This permit does not constitute a building permit , sewage system permit ,
grading permit , land alteration permit , well permit or the like . Separate
permits may have to be applied for and obtained in order to accomplish all
the goals of the project authorized herein .
3 . The issuance of this permit does not negate the need to secure other permits
from other local units of government , state agencies or federal agencies who
may also have jurisdiction over portions of your project .

That the 20 foot buffer area is only used for parking.

E%PIRATION.
A Conditional Use Permit expires one year after it has been issued unless the
use for which the permit has been granted is in effect . Extensions may be
granted provided the applicant submits a letter to the Zoning Administrator
requesting an extension 30 days before the expiration of said approval . The
letter shall state the facts of the request , shoWing a good-faith attempt to
utilize the Permit , and it shall also state the additional time being requested
to begin the proposed construction. The City Council may grant extensions not
to exceed one year.

Proposed Action .
Staff recommends the following motion : "N�ove that the request to allow
parking in the 20 foot green area adiacent to the East 1 /2 of the
Downtown Park is allowed "
This action will allow the applicant to use the 20 foot green area
adjacent to the Dotantown Park .
The Commission unanimously recommended approval of Resolution No . $9-U
to allow parking on the 20 foot buffer area between the Downtown Park
and parking area for the Hopkins Office Center .
Overview.
The applicant , Mr . Hagen , is one of the owners of the Hopkins Office
Center at 33 10th Avenue South . The Hopkins Office Center and the old
Schoell & Madson building at 50 9th Avenue South currently share 9y
existing parking spaces . Eoth office buildings are alnost at 100%
--� occupancy and are ex_perienciriL a �horta.�e of parking .
When the Hopkins Office Ruilding Conditional Use Permit was approved
on September 2 , 1980 , one condition was that a 20 foot green area be
retained as a buffer zone adjacent to the East 1 /2 of the Downtown
Park . Mr . Hagen is requesting this condition be removed to allow
parking in this 20 foot �reen area .
The site plan submitted by Nr . Hagen shows 34 new spaces will be added
to the site . The site is zoned B-2 which does not have any parking
requirements or landscaping requirements . Staff is recommending
approval because the area will be used for parking only which will
allow sunlight into the park .
Mr . Don Hagen appeared before the Commission . Mr . Hagen explained the
additional parking area and the parking shortage he is experiencing
for the tenants . It was noted that because Mr . Hagens property is in
the B-2 district no parking is required .

Detailed Background
Existing Site Characteristies :
The existing parking lot has 91 spaces which are shared by the Hopkins
Office Center and the building at 50-9th Avenue South . The existing
parking lot stops approximately 4�1 feet from the City Park . This area
is currently green space .
The parking lot currently has access from First Street SouLh and 9th
Avenue . The access will remain the same witk� the additional parking .

Avenue . The existing parking lot will be remarked slip;htly to move
the spaces further south . Tt1e existing entrance/exits will be changed

The Director of En�ineerin� has reviewed the pr•oposed site plan and
found it a.cceptabl.e .

Staff Analvsis of Issues -
- 4Jhat was the purpose of the 20 foot buffer?
In researching the past actions , the buffer area was renuired because
any construction would block sunlight into the park . In looking at
the existing conditions , it appears that the existing hill serves as a
buffer and will block the sight line of the cars frou� the park . The
parking area will not affect the park .
- Is the additional parking needed?
One of the reasons the parking ramp was needed was a lack of parking .
The applicant has stated that one of the leasin� features of his
building is free parking . Thirty-four additional spaces can be added
to the site which will take considerable parkin� pressure away from
the site .
- Is there any other alternative for the applicant?
There is the alternative of allowing only one row of parking on the
� south end of the 4�4 foot strip . This would increase the parking area
by 17 spaces . Sixteen feet would remain as green space with one row
of parking .

ATTACHED NARRATIVE
When Ll�� [Iopkir�� Office Center, (Ii.O_C. ), was starLed in ttie fall of 1981 ,
we desil;r�ed a parkin� lot which we wa��ted to be jointly shared with the
old Schoell and Madson building on the corner at 50-9th Avenue South.
Twenty parking spaces were laid out on the south end of the H.O.C_ building,
and 70 on the east side, and 7 behind 50-9th Avenue South for a total of
87 spaces.
The stri� of land from the building east to 9th Avenue was left as undeveloped.
Discussion from the city suggested that this could be a future site for an
additional of'fice building at sometime_ We su�,gest ttiat at some point it
might be needed for additional parl<ing but we would not do anything with it
until the need was shown. One person on the council wanted an open strip
between our parking lot and the ciyt park so that the changes to other uses
could come before the council for appr�oval and ttiat was the way it was
approved_
Both office buildings have been at almost 100% occupancy for some time and
parking for� our tenants has become a problem. At times our lot is 100%
� full and some tenants cannot park in our lot when they leave and return to
their of'fices during the day. The 2 hour parking on lOth Avenue South and
on the or�e side of 9th Avenue South eliminates the street parking for workers •
who do not leave the building during the course of the day. We do not expect
the new city ramp to help our situation because we already discourage outsiders,
(past off'ice employees and tenants of the Norwest Bank Building) , by threatening
to tow their cars.
Plenty of free adjacent parking to a tenants office has been one of the great
incentives of all suburban office buildings. We need the extra parking spaces
to hel� 1<eep the H.0_C. and 50--9th Avenue South building filled.
