GENERAL PROVISIONS
1 . This permit is not valid until it has been recorded at the Office of the
County Recorder . A true and correct copy of the full legal description of
the affected property must be attached to this document .
2 . This permit does not constitute a building permit , sewage system permit ,
grading permit , land alteration permit , well permit or the like . Separate
permits may have to be applied for and obtained in order to accomplish all
the goals of the pro�ect authorized herein .
3 . The issuance of this permit does not negate the need to secure other permits
from other local units of government , state agencies or federal agencies Kho
may also have jurisdiction over portions of your pro�ect .

E%PIRATION.
A Conditional Use Permit expires one year after it has been issued unless the
use for which the permit has been granted is in effect . Extensions may be
granted provided the applicant submits a letter to the Zoning Administrator
requesting an extension 30 days before the expiration of said approval. The
letter shall state the facts of the request , shoKing a good-faith attempt to
utilize the Permit , and it shall also state the additional time being requested
to begin the proposed construction . The City Council may grant extensions not
to exceed one year.

RESOLUTION MAKING FINDINGS OF FACT AND DENYING
APPLICATION FOR CONDITIONAL USE PERMIT CUP88-14
WHEREAS , an application for a Conditional Use
Permit entitled CUP88-14 made by Gregory & Rebecca Wellens ,
533 East Park Valley Drive , to construct a 6 foot high
special purpose fence is denied .
WHEREAS , the procedural history of the application
is as follows :
1 . That an application for Conditional Use Permit
CUP88-14 was filed with the City of Hopkins on
August 5 , 1988 .
2 . That the Hopkins Planning Commission reviewed
such application on August 30 , 1988 .
3 • That the Hopkins Planning Commission , pursuant
to published and mailed notices , held a public
^ hearing on August 30 , 1988; all persons present
at the hearing were given an opportunity to be
heard .
�+ . That the written comments and analysis of the
City Staff and the Planning Commission were
considered .
NOW THEREFORE BE IT RESOLVED , that the Hopkins
City Council makes the following Findings of Fact in respect
to CUP88-14:
1 . That the neighborhood was constructed with the
homes close together .
2 . That a 6 foot fence would have an adverse
affect on the abutting neighbor.
3 . That the granting of the Conditional Use Permit
for this fence would set a precident for all of
Park Valley to have 6 foot fences between
homes .

Proposed Action .
Staff recommends approval of Resolution No: 88-76A Approvin�
Conditional Use Permit CUP88-14 for a special purpose fence to be
located between two homes .
Approval of this motion will allow the applicants to construct a 6
foot cedar fence between two homes .
On a �-1 vote the Commission recommended approval of Resoltuion No •
88-76B Denying Conditional Use Permit No: 88-14 to construet a 6 foot
high special purpose fence . Mr . Denny abstained .
Overview.
The applicants want to build a 6 foot cedar fence between their home
and their neighbors home . This fence would start at the front of the
applicants home and run the distance of the sideyard . The applicants
� are proposing to place the fence �0" from their home .
The ordinance alloWs a 3 1 /2 foot fenee between homes (this is
currently proposed to be 4 feet) .
Staff is recommending approval because the fence will protect and
buffer the applicants home . The proposed fence will be close to the
applicants home and is at a lower elevation than the neighbors
property.
The Wellens appeared before the Commission . They stated they want
this fence to buffer them and for privacy.
There was considerable diseussion about this fenee and the
appropriateness for this neighborhood . �
John Hutchison , neighbor to the north , appeared before the Commission .
He stated that he objects to privacy fences .
The Commission noted that if this fence was alloxed it would open the
door for all of Park Valley to have 6 foot fencing between homes .

Detailed Background
The ordinance states "fences for special purposes and fences differing
in construction, height or length may be permitted in any district in
the City by the issuance of a Conditional Use Permit and by the
Council upon proof and reasons submitted by the applicant and upon the
signing by said bodies that such special purpose is necessary to
protect, buffer or improve the premises for which such fence is
intended. The special fence permit, if issued, may stipulate and
provide for the height, location, construction and type of special
fence thereby permitted. "
The subject fence will run in line with the eaves of the applicants
home. The original building permit shows a 5 foot setback from the
side lot line. The fence will be 20" from the property line.
--� The applicants neighbors home is at an elevation of approximately 1
foot above the applicants home.
o Does the subject fence meet the requirements for a special purpose
fence?
The ordinance requires that a special purpose fence may be permitted
if the fence is necessary to protect, buffer or improve. The proposed
fence will protect and buffer the applicants home. The homes are
close together in Park Valley. The applicants home is situated in
such a way that the bedrooms and bathroom face the neighbors home.
The neighbors driveway is ten feet from the applicants home.
There is approximately a foot difference in elevation between the
applicants home and the neighbors home. The proposed fence will not
appear to be a 6 foot fence but a 5 foot fence. If the applicant was
only able to construct a 3 1/2 foot fence it would appear as a 2 1/2
foot fence because of the change in elevation.
The neighbor did contact me about the fence. The neighbor was upset
that the Wellens did not discuss this with them. The neighbor did not
state her feelings for or against.
Alternatives.
� l. Approve the Conditional Use Permit to construct a 6 foot
cedar fence between two homes. By approving the
Conditional Use Permit the applicants will be able to
construct a 6 foot cedar fence starting at their front
building line.

2 . Deny the Conditional Use Permit. This will allow the
applicant to construct a 3 1/2 fence between the two
homes.
3 . Continue for further information. If the Commission
feels that more information is needed, the item should be
continued.

Dear Members of the Zoning and Planning Commission,
Please consider approving our request for a Special Purpose Fence,
scheduled to be reveiwed the evening of Tuesday, August 30, 1988.
Approving the installation of an attractive, cedar fence will benefit
and enhance our property in four ways. (1 ) It will provide a Noise Buffer
between our private spaces and our neighbors public spaces. (2) It will benefit
us with Visual Privacy since our neighbors property is elevated above our own.
(3) It will Protect the north side of our home from snow build-up; blown from
the adjacent driveway and (4) Enhance the Aesthetics of the north side of
our home by allowing us to grow shade-loving iv,y and therefore provide that
side of the house with some greenery.
Because of the proximity and layout of our two homes, noise bounces
�` between the homes creating an amplified effect in our bedroom spaces. We have
an infant in one of those rooms who's sleep patterns, since the time she was
born, have been affected by the neighbor's barking dog, the children playing
in the driveway and the car doors slamming by her bedroom window. Every
family's situation is differant. We have an infant now and plan on another
in the next year. We are not against the neighbors having a dog and we
certainly believe the boys and their friends have a riqht to play in their
own driveway. All we ask is that we are able, at our own expense, to protect
those bedroom spaces with a fence that will buffer those noises.
Because of the proximity and layout of the two homes, we have a Visual
Privacy problem as well . Our home sits below our neighbors and the bedroom
and bath windows only exposure/view is along a very public driveway.
In addition, because the neighbor's driveway is ten(10) feet away from
the side of our house and runs the length of our home, winter snow is blown
from their driveway up against the house causing the siding to buckle because
of frost action. The fence would protect this damage from progressing.

Lastly, it is impossible to grow anything of height on the north side
of our home, but a fence would provide the structure for English Ivy to grow
upon� and enhance the aesthetics of the north side greatly.
We respectfully ask that our request for a Conditional Use Permit be
accepted and want to thank all of the Commission for the time they have sperit
in reviewing our case.

Proposed Action.
Staff recommends approval of a special purpose fence to be located
between two homes.
Approval of this motion will allow the applicants to construct a 6
foot cedar fence between two homes.
Overview.
The applicants want to build a 6 foot cedar fence between their home
and their neighbors home. This fence would start at the front of the
applicants home and run the distance of the sideyard. The applicants
are proposing to place the fence 40" from their home.
The ordinance allows a 3 1/2 foot fence between homes (this is
^ currently proposed to be 4 feet) .
Staff is recommending approval because the fence will protect and
buffer the applicants home. The proposed fence will be close to the
applicants home and is at a lower elevation than the neighbors
property.

Detailed Background.
The ordinance states "fences for special purposes and fences differing
in construction, height or length may be permitted in any district in
the City by the issuance of a Conditional Use Permit and by the
Council upon proof and reasons submitted by the applicant and upon the
signing by said bodies that such special purpose is necessary to
protect, buffer or improve the premises for which such fence is
intended. The special fence permit, if issued, may stipulate and
provide for the height, location, construction and type of special
fence thereby permitted. "
The subject fence will run in line with the eaves of the applicants
home. The original building permit shows a 5 foot setback from the
side lot line. The fence will be 20" from the property line.
The applicants neighbors home is at an elevation of approximately 1
foot above the applicants home.

o Does the subject fence meet the requirements for a special purpose
fence?
The ordinance requires that a special purpose fence may be permitted
if the fence is necessary to protect, buffer or improve. The proposed
fence will protect and buffer the applicants home. The homes are
close together in Park Valley. The applicants home is situated in
such a way that the bedrooms and bathroom face the neighbors home.
The neighbors driveway is ten feet from the applicants home.
There is approximately a foot difference in elevation between the
applicants home and the neighbors home. The proposed fence will not
appear to be a 6 foot fence but a 5 foot fence. If the applicant was
only able to construct a 3 1/2 foot fence it would appear as a 2 1/2
foot fence because of the change in elevation.
The neighbor did contact me about the fence. The neighbor was upset
that the Wellens did not discuss this with them. The neighbor did not
state her feelings for or against.
Alternatives.
1. Approve the Conditional Use Permit to construct a 6 foot
cedar fence between two homes. By approving the
� Conditional Use Permit the applicants will be able to
construct a 6 foot cedar fence starting at their front
building line.
