This permit is not valid until it has been recorded at the Office of the County Recorder . A true and correct copy of the full legal description of the affected property must be attached to this document . 2 . This permit does not constitute a building permit , sewage system permit , grading permit , land alteration permit , well permit or the like . A Conditional IIse Permit expires one year after it has been issued unless the use for which the permit has been granted is in effect . Extensions may be granted provided the applicant submits a letter to the Zoning Administrator requesting an extension 30 days before the expiration of said approval . The letter shall state the facts of the request , showing a good-faith attempt to utilize the Permit , and it shall also state the additional time being requested to begin the proposed construction . Use Permit entitled CUP88-12 , made by William H . MeCoy , 1102 Second Street N .E . , to allow a 10 foot front yard setback for a 69 square foot pylon sign is approved . WHEREAS , the procedural history of the application is as follows : 1 . That an application for Conditional Use Permit CUP88-12 was filed with the City of Hopkins on July 26 , 1988 . 2 . That the Hopkins Planning Commission reviewed such application on August 30 , 1988 • 3 . That the Hopkins Planning Commission , pursuant to published and mailed notices , held a public hearing on August 30 , 1988 ; all persons present ^ at the hearing were given an opportunity to be heard . �1 . That the written comments and analysis of the City Staff and the Planning Commission were considered . NOW THEREFORE BE IT RESOLVED , that the Hopkins City Council makes the following Findings of Fact in respect to CUP88-12: 1 . That the proposed sign will be an identification sign . 2 . Mr. MeCoy stated that the old price sign Would be painted to match the new sign . Mr. Hurtz did state that a new priee sign Would cost approximately $1500 additional . . The conditional use permit may require periodic reviews and may be canceled for cause. " The proposed sign will be 4 '4" x 16 ' and 21'5" in height. A 250 square foot sign is allowed in an I-1 district. The sign will be internally lit. There is no other signage on the site except for the gas price sign. The gas price sign is a legal non-conforming sign. There is no record of when the sign was erecte�. The proposed sign will have a red background with white letters. � The subject sign is surrounded by Medalist to the west, a City well and the Hopkins Arches to the north, Fina Gas station to the east and the applicants gas station to the south. Analysis. - Is a lesser setback needed? The sign setback in this district is 20 feet. Every business owner wants to place their sign to be visible to the public. The building setback is also 20 feet in this district. This 20 foot setback has been a problem in the past since visibility of a sign is so important to a business. The staff is recommending at this meeting to change many of the sign setbacks to a more realistic setback. A 10 foot setback is recommended for a front yard setback in industrial districts. There will not be a traffic visibility problem with the proposed sign. - Will the new sign improve the property? The proposal as requested in the staffs' opinion will not improve the property. The existing gas price signs are old and putting a new sign over the old gas price sign will not improve the property. The two � signs will appear disjointed.
