Staff recommends the folloWing motion: That a Conditional Use Permit be approved by Resolution No: 88-42 to allow a 10 foot front yard setback and an 8 foot side yard setback for the mini-storaqe sign . " Approval of this motion Will allow the applicant to place the proposed sign with a 10 foot front yard setback and an 8 foot side yard setback . OvervieW. The applicant is presently constructing a mini-storage facility at 114u Seventh Street South . He is now requesting approval of a Conditional IIse Permit to locate a sign With a lesser setback than required by the zoning ordinance . The sign as proposed would have a 10 foot front yard setback and an 8 foot side yard setback . The � proposed sign Will be located on the northeast corner of the site . Paul Steiner , the applicant , appeared before the Commission . He stated that the lesser setback was needed for visibility. It was noted that the sign would face east/West and not be visible to the Westbrooke Patio homes . There was very little discussion about this item . No one appeared regarding this item . Ordinance 570 .47 states " Applications for other proposed sign permits involving a lesser setback than that required by the zoning code may be granted only by and under a conditional use permit and under the applicable provisions and regulations of conditional use requirements set forth in the zoning code. The conditional use permits may require periodic revieWs and may be canceled Por cause. " The proposed sign Will be 12 ' x 6 ' and 35 ' in height. A 250 square foot sign is a1loWed in an I-1 district . The sign will be internally lit . There xill be no other signage on the site. Analysis . - Is a lesser setback needed? .•• The building setback and sign setbacks are both 20 feet. A sign --� setback should be less than the building setback since it is logical to believe that the sign for a building is placed in front of the building. If this sign Were to be setback 20 feet from the front and side property lines the visibility from the intersection of 7th Street and 11th Avenue would be very poor. The gas station to the east Will be planting trees along their north property line on 7th Street Which will further reduce sign visibility. Staff Will be recommending an ordinance change for sign setbacks in the near future . - Will the proposed sign have an adverse affect on the surrounding parcels? Industrial uses are to the north of the applicants site and the neW gas station to the east , Westbrooke patio homes are to the south and the landfill is to the west . The proposed sign should have no affect on any of the surrounding parcels . If the Conditional Use Permit is granted the sign uill be moved further from the residential area. The sign Will be located closer to the gas station but this side is the rear of the station so the sign Will not block the vieW from the station . � . • . ; ---� CIIP88-7 Page 3 Alternatives . 1 . Approve the Conditional Ose Permit for a front and sideyard setback. By_ granting the Conditional Use Permit the applicant Will be able to erect the sign With a 10 foot front yard setback and an 8 foot sideyard setback. 2. Deny the Conditional Use Permit for a lesser setback. By denying the Conditional Use Permit the applicant Will have to set the sign 20 feet from each lot line . 3 . Approve the Conditional Use Permit for another setback than proposed . If the Commission feels that there is a need to have the sign setback further than requested then it should be moved . 4 .
