Approval of this motion will allow a final plat to be prepared for the development of 5 townhomes. The Commission unanimously approved the Preliminary Plat of. West Oak Third Addition. overview. In conjunction with the Conditional Use Permit to construct 5 townhomes, the applicant is also requesting to plat this area. Each townhouse owner will own the land under their home with the other area being common ground. -� Staff is recommending approval of this motion because the preliminary plat meets the requirements as specified in the Subdivision Regulations and the requirements for the R-3 district. Dan Herbst representing Pemtom appeared before the Commission. Discussion of the Preliminary Plat and Conditional Use Permit were held together. There was little discussion regarding the preliminary plat. The discussion centered on the proposed development and access onto County Road #73. Subd. 21. "Subdivider" means a person having sufficient proprietary inter— est in land in order to subdivide the same under this section. Subd. 22, "Subdivision" means any arrangement, revision, rearrangement, or other division of land by platting, registered land survey or conve��ance, on the part of any subdivider, into two or more separate parcels, each of uhich has an area as defined and regulated in Minnesota Statutes, sections 462.351 through 462.365. 500.03. Data for preliminary plat. Subdivision 1. ScT ale_ The preliminary plat shall be clearly and legibl}- drawn at 1" equals 100 or at some other scale approved by the city engineer. Subd. 2, Identificztion and descri tion. The preliminary plat shall contain or have attached thereto, tt�e folloking information: a) the proposed name of subdi��ision� s:hich name shall not duplicate or be alike in pronunciation of the name of any plat theretofore recorded in ,--. the county;, b) the legal description of property according to the records in the office of the register of deeds; �) the names and addresses of the o�✓ner, o�.mer's agent� subdivider, surveyor and designer of the plat; � d) graphic scale; e) nor[h point; and f) date of preparation. -Snbd. 3. Existin� conditions. The preliminar}• plat sha1L contain or have attached thereto� the following information: a) boundary line surve}� of proposed subdivision clearly indicated; b) existing zoning classifications; �) total acreage; + d) location, widths and names of existing or previously platted streets or other public ways, parks and other public lands, pet�anent build— ings and structures, easements and section and corporate lines within ---� the preliminary plat and [o a distance 100 feet beyond the boundary line; �.- Hopkins City Code ^ . 500.03, Subd. 4 . e) location and size of existing sewers, vater mains, culverts or oth underground facilities. both public and private, within the prelimir nary plat area and to a distance of 100 feet beyond. Such data as grades, invest elevations, and locations of catch basins, manholes, and hydrants shall also be shown; f) boundary lines of adjoining unsubdivided or subdivided land, within 100 feet, identifying by name and ounership; S) topographic data, including contours at vertical intervals of not more than tWo feet, except Where the horizontal contour interval is 100 feet or more, a one foot vertical in[erval shall be shown: water courses, marshes, Wooded areas, rock outcrops. power transmission poles and lines, and other significant features shall also be shown; and h) soil borings as may be required by the cit}� engineer. Subd. 4. Subdivision design features. The prelioinary plat shall contain or have attached thereto, the following information: �� a) layout of proposed streets, shoc,�ing right-of-way widths and proposed names of stree[s: the name of an�• street heretofore used in the city or its environs shall not be used� unless the proposed street is an -1 extension of an already named streets, in which event the name shall be used; b) location and widths of proposed alleys, pedestrian ways and utilit�• easements; �) typical cross-sections of proposed improvements upon streets and alleys, together with an indication as to the method of disposing of the proposed storm water runoff; d) appro�;imate center line gradients of proposed s[reets and alleys; e) _ location, size and approximate gradient of proposed sewer lines and - �ater mains; f) layout, numbers and preliminary dimensions of lots and blocks, and building set-back lines; g) areas, other than streets, alleys, pedestrian ways and utility ease- ments, intended to be dedicated or reserved for public use, including the size of such area or areas in acres; Subd. S. Tentative plan required. Whenever a portion of a tract is proposed for platting and it is intended or large enough for future enlargement of such platted portion from time to tim�, a tentative plan for the future subdivision of the entire tract shall be submitted to the commission. ---� � ) � . . Procedure for reliminar�• lat, filin and fee. Before subdividing any tract of land, a subdivider shall file With [he clerk: a) an application in c.�riting together with such filing fee as may be established by this code; and b) four copies of the preliminar�- plat and accompanying data as set forth in subsection 500.03. 500.07: Preliminarv lat, zonin administrator duties. The �reliminary plat shall be submitted to the zoning administrator who shall ascertain whether said plat complies with this section and all regulations issued thereunder. When the administrator finds such compliance, the administrator shall: a) refer two copies of the preliminary plat to the zoning and plannin commission for its examination and report and one co g engineer for his exami�ation and report. Copies of the reporthof cthe engineer shall be given to the zoning and planning commission at least 15 days prior to the hearing required b�• b); and b) set a public hearing for the next regular meeting of the zoning and --- plannin€ commission on the preliminar , ciithin 45 days of filing with notice pofC hearingh publ s hed bin htha � official newspaper at least ten days pribr to the date of the hearing. -+ . The commission shall conduct hearing on the preliminary plat, make its report, findings and recomrmendations to the council on or before the next regular meeting of the council following the public hearing unless an extension is granted, but in no event later than 80 days from date of hearing. 500. 11. Procedure for final Iat. Subdivision 1. Anderson SUBJECT: Plat approval - West Oaks Third Addition Objections were heard at the Zoning and Planing hearing from residents in Minnetonka on North Oakvale Drive. The new access road to West Oaks Third Addition will be opposite the entrance onto Hopkins Cross Road from North Oakvale Drive. The objections were that there would be a significant increase of traffic at a 'busy' intersection. North Oakvale Road serves about 21 homes west of Hopkins --� Crossroad (County Road #73) . West Oaks Third Addition will add five residences on the east side of Hopkins Crossroad. The speed limit on Hopkins Crossroad is 40 miles an hour. The 1985 traffic count was 11,200 vehicles per day. The 1987 traffic count was 10, 100 vehicles per day. There is open visibility to the north and south on Hopkins Crossroad. A lilac hedge in the northwest quadrant of the � intersection at 1120 North Oakvale Drive could be trimmed to allow for better visibility. A suggestion was made at the hearing that traffic signals should be installed at this intersection. The present traffic does not warrant the installation of a signal. We find that the addition of 5 residences more coming onto Hopkins Crossroad at North Oakvale Drive will not create a significant traffic hazard increase.
