CITY OF HOPKINS '� Hennepin County, Minnesota RESOLUTION N0. 86-17 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION FOR SUBDIVISION APPROVAL SUBD86-2 WHEREAS, an application for Subdivision Approval entitled SUBD86-2 has been made by Oakwood Development Company, to divide the property at Smetana Road and Feltl Court into two separate lots. WNEREAS, the procedural history of the application is as follows: 1. That an application for Subdivision Approval SUBD86-2 was filed with the City of Hopkins on February 28, 1986. 2. That the Hopkins Planning Commission reviewed such application on hlarch 25, 1986. 3. That the Hopkins Planning Commission, pursuant to published and mailed notices, held a public hearing on March 25, 1986; all persons present at the hearing were given an opportunity to be heard. 4. That the written comments and analysis of the City Staff and the ^ Planning Commission were considered. NOW THEREFORE BE IT RESOLVED, that the Hopkins City Council makes the following Findings of Fact in respect to SUBD36-2: 1. That the subdivision conforms with the requirements of an R-6 District. 2. Address of Property: Smetana Road & Feltl Court Present Zoning: R-6 Nature of Request: To divide property in two lots of 507 ,655 square feet and 375,853 square feet. Reason for Request: To meet HUD requirements regarding separate lots and mortgages for each building. The applicant is proposing to build a 324 unit apartment complex at this � site. The Conditional Use Permit to build this complex was approved last month. Parcel 'A' will be developed first, consisting of 174 units, fol- lowed by Parcel 'B' with 150 units. It also should be noted tha t Feltl is spelled wrong on the preliminary plat, it should be changed prior to the final plat. ^ The Assistant City Engineer has noted there should be sewer easanent in the southwest corner of the site also if it is the desire of the appli- cants to have the City maintain the water and sewer on the site, ease- ments will have to be shown on the plat. ANALYSIS: The applicant has requested a subdivision to meet the HUD requirements. Both lots will comply with the minimum requirements for an R-6 district. RECOMMENDATION: I recomnend approval of the subdivision with the following conditions: 1. A favorable outcome of the Environme�tal Assessment Worksheet. 2. Securing a driveway easement 3.
