WAIVER OF PLAT - HARLEY HOPKINS
Proposed Action
Staff recommends approval of the following motion: Approve Resolution
No. 90-89 makina Findincts of Fact and Approvinq the Waiver of Plat at
125 Monroe South and Resolution No. 90-97 Dividin the Pro ert into
Two Parcels.
Approval of this motion will allow a 50 foot setback in all yards for
the new building as required by the ordinance.
Overview.
This waiver of plat is in conjunction with the conditional use permit
to construct a new school building at 125 Monroe Avenue. Last year
the City purchased the east half of the Harley Hopkins school property
to construct a retention pond. This retention pond was constructed to
eliminate flooding in the area. When the property was purchased from
the school district a waiver of the plat was granted to divide the
property. On July 10, 1990 the City CoUncil approved the sale of land
at Harley Hopkins to the School District.
Now the School District wants to demolish the existing school and
construct a new school which will be more efficient and serve the
District's needs better. The ordinance requires a 50 foot setback in
'��11 yards for schools. Without the waiver of plat the east lot line
�ill not have the required 50 foot setback.
Staff is recommending approval because the new building will meet the
ordinance requirements.
Staff explained why the waiver of plat was requested. The discussion
about the waiver was held in conjunction with the Conditional Use
Permit for the proposed school. -
The Commission unanimously approved Resolution No: Z9d-13 recommending
approval of the Waiver of Plat.

The following are the minimum lots requirements for the R-1-A
district:

Primarv Issues to Consider
o Do the new lots meet the minimum requirements for R-1-A districts?
A minimum lot size of 20, 000 squa�e feet is required. Both lots have
over 20, 000 square feet.
o Why is a waiver of the plat needed? �
The zoning ordinance requires a 50 foot setback on all sides for a
school. The waiver of the plat will give the school a 50 foot setback
on all sides. The City will maintain an easement on some of this
^property for maintenance and construction of public improvements.
Alternatives.
l. Approve the waiver of plat. By approving the waiver of plat,
the Schoo� District can construct a new school.
2 . Deny the waiver of plat. By denying the waiver of plat, the
School District will not be able to construct a new-school.
The School District could request a variance for the'setback.
If the Commission denies the request, the Commission must
state findings of fact to support that decision.
3 . Continue for further information. If the Commission feels
that further information is needed, the item should be

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
WAIVER OF PLAT WVR90-2
WHEREAS, an application by Hopkins School District #270
for a Waiver of Plat WVR90-2 to divide the
property at 125 Monroe Avenue South to allow
construction of a new facility is hereby approved.
WHEREAS, the procedural history of the amendment is as
follows:
1. That the application for Waiver of Plat was
filed with the City of Hopkins on August 6,
1990.
2 . That the Hopkins Planning Commission reviewed
such application on August 28, 1990.
3 . That the Hopkins Planning Commission,
pursuant to published and mailed notices,
held a public hearing on August 28, 1990; all
persons present at the hearing were given an
opportunity to be heard.
4 . That the written comments and analysis of the
� City Staff and the Planning Commission were
considered.
NOW THEREFORE BE IT RESOLVED, that application for Waiver of
Plat WVR90-2 is hereby approved subject to the
fo�lowing Findings of Fact:
1. That the new lots meet the minimum

INTO TWO PARCELS
WHEREAS, Hopkins School District No. 270 has applied to the City
Council of Hopkins for approval of a division of Lots 13 through
24 , Block 34 , West Minneapolis Center, (PID 19-117-21 34 0141)
County of Hennepin, State of Minnesota.
PARCEL 1
That part of Lots 1 through 12 , inclusive, Block 34 ,
lying westerly of the following described line:
Commencing at the southeast corner of Lot 13 , Block 35,
said West Minneapolis Center; thence South 87 degrees
34 minutes 17 seconds West, on an assumed bearing along
the South line of said Lot 13 and its westerly
extension, a distance of 233 . 15 feet to the point of
beginning of the line to be hereinafter described;
