Proposed Action.
Staff recommends approval of the following motion: Move to adopt
Resolution No: 90-63 approving a waiver of plat to allow the division ,
of Lot 23 to combine with lots 24 and 22 . � ;

Approval of this motion will create two conforming lots.
overview.
The subject properties are 3 parcels on the southeast corner of 17th
Avenue and 3rd Street. The three parcels are vacant. The applicant
is proposing to divide the middle lot and combine the divided lot with
the lot on either side.
The existing parcels are 38.92, 40 and 50 feet wide. The new parcels
will be 61.89 and 66.73 feet wide.
Staff is recommending approval because the new parcels will conform
with the R-1-A minimum requirements.
Mike Schatz representing the owner of the property appeared before the
� Commission. Mr. Schatz stated that there would probably be a two
family home constructed on each lot. A few surrounding neighbors were
concerned with the additional traffic in the alley and where the
access to the garages would be. There was little discussion on this
item.
The Commission unanimously approved Resolution No: Z90-10 approving
the waiver of the plat to divide Lot 23 and combine with Lots 22 and
24 to create two lots.

The minimum lot size for a lot in the R-1-A district is 6000 square
feet and the minimum width is 50 feet. Both lots will exceed the
minimum requirements.
o What can be constructed on the new lots?
The R-1-A district allows both single family and two family homes.
With the division of the lots two doubles or two singles can be
constructed on the lots.
o If the lots are not divided, what can be constructed on the lots?
If the lots are not divided, a single family home can be built on each
� lot. A single family home can be built on each lot even though the
lots do not meet the minimum requirements because the ordinance has a
grandfather clause that would allow the construction of single a
family home.
o Why is a waiver of the platting process being proposed?
In the past the City has allowed a waiver of the platting requirements
instead of a subdivision because a waiver of plat costs less to the
applicant. Hennepin County has accepted the waiver of plat if it is a
simple division.
Alternatives. -
l. Approve the request for a waiver of the plat. By approving
the request the applicant will have two lots that meet the
minimum requirements.
2 . Deny the request for a waiver of the plat. By denying the
wavier of plat, three lots will remain with the ability to
construct 3 single family homes.
3 . Continue for further information. If the Commission feels

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
AN APPLICATION FOR WAIVER OF PLAT WVR: 90-1
WHEREAS, an application by Haller Properties for a Waiver of the
Platting Requirements WVR:90-1 to divide Lot 23 thus
creating Parcels 'A' and 'B' as described below is hereby
approved.

Parcel 'A' : Lot 22 and the south 12 feet of Lot 23 , Block 3 ,
Gibbs First Addition to West Minneaplis, Hennepin County,
Minnesota, according to the recorded plat thereof.
Parcel 'B' : Lot 24 and that part of Lot 23 lying north of
the south 12 feet of Lot 23 , Block 3 , Gibbs First Addition
to West Minneaplis, Hennepin County, Minnesota according to
the recorded plat thereof.
WHEREAS, the procedural history of the amendment is as follows:
1. That the application for Waiver of the Platting
Requirements was filed with the City of Hopkins on May
11, 1990.
2 . That the Hopkins Planning Commission reviewed such
-1 application on May 29, 1990.
3 . That the Hopkins Planning Commission, pursuant to
mailed notices, held a public hearing on May 29 , 1990;
all persons present at the hearing were given an
opportunity to be heard.
4 . That the written comments and analysis of the City
Staff and the Planning Commission were considered.
NOW THEREFORE BE IT RESOLVED, that application for Waiver of the
Platting Requirements is hereby approved subject to the
following Findings of Fact:
1. That the new lots meet the minimum requirements for the
R-1-A District.
2 . That a single family home or a two family home can be
constructed on each lot.
BE IT FURTHER RESOLVED, that application for Waiver of the Platting
Requirements is hereby approved subject to the following
Conditions:
1. That the Hennepin County Recorder accepts the Waiver of
Plat.

WHEREAS, an application for a Waiver of the Platting �
Requirements WVR:90-1, made by Haller Properties
is recommended for approval.
WHEREAS, the procedural history of the application is as
follows:
1. That an application for Waiver of the
Platting Requirements WVRR:90-1 was filed
with the City of Hopkins on May 11, 1990.
2. That the Hopkins Planning Commission reviewed
such application on May 29, 1990.
3. That the Hopkins Planning Commission,
pursuant to mailed notices, held a public
hearing on May 29, 1990: all persons present
at the hearing were given an opportunity to
be heard.

4 . That the written comments and analysis of the
City Staff and the Planning Commission were
considered. _
NOW THEREFORE BE IT RESOLVED, that application for Waiver of
Platting Requirements WVR:90-1 is hereby
recommended for approval subject to the following
Findings of Fact:
l. That the new lots meet the minimum
requirements for the R-1-A disrict.
2 . That a single family home or a two family
home can be constructed on each lot.
BE IT FURTHER RESOLVED, that application for WVR:90-1 is
hereby recommended for approval subject to the
following Conditions:
1. That the Hennepin County Recorder accepts the
Waiver of Plat.
