WAIVER OF PLAT - HARLEY HOPKINS
Proposed Action.
Staff recommends approval of the following motion: "Move to adopt
Resolution No: Z89-26 approving the waiver of the plat to divide the
Harley Hopkins site. "
Approval of this resolution will divide the existing lot into two
parcels.
Overview.
The City recently purchased the east part of the Harley Hopkins site
for construction of a storm water retention pond. The site needs to
be divided because there are now two owners of this property.
Staff is recommending approval of the wavier of the plat because the
City is now the owner of the storm water retention pond on the east
side of the property.

Primary Issues to Consider.
o Do the new lots conform to the R-1-A district requirements?
The Zoning Ordinance requires that all school buildings have a 50 foot
setback from all lot lines. The existing building will be 50 feet
from the east lot line. All other lot lines will not be affected by
this lot split. The minimum lot size in an R-1-A district is 6000
square feet, which both lots will have.
The new lots created will meet the minimum lot requirements and the
zoning requirements.
Alternatives.
l. Approve the wavier of the plat. By approving the wavier, the
City will have a separate lot which is the new storm water
retention pond that the City recently purchased from the
School District.
2. Deny the wavier of the plat. By denying the wavier of the
-� plat, the City will not have a separate lot for the storm
water retention pond.
3. Continue for further information. If the Commission feels
that more information is needed, the item should be continued.

RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL
OF APPLICATION FOR WAIVER OF PLAT WVR89-3
WHEREAS, an application for a Waiver of the Plat entitled
WVR89-3 made by the City of Hopkins to divide the
Harley Hopkins property into two parcels is
recommended for approval.
WHEREAS, the procedural history of the application is as
follows:
1. That an application for Waiver of Plat WVR89-
3 was filed with the City of Hopkins on
September 29, 1989.
2. That the Hopkins Planning Commission reviewed
such application on October 31, 1989.
3. That the Hopkins Planning Commission,
pursuant to mailed notices, held a public
—� hearing on October 31, 1989; all persons
present at the hearing were given an
opportunity to be heard.
4. That the written comments and analysis of the
City Staff and the Planning Commission were
considered.
NOW THEREFORE BE IT RESOLVED, that application for Waiver of
Plat WVR89-3 is hereby recommended for approval
subject to the following Findings of Fact:
1. That the proposed lots meet the minimum
requirements for an R-1-A district.
2. That the existing school will have the minimum
setback from the new lot line.
BE IT FURTHER RESOLVED, that application for Waiver of Plat
WVR89-3 is hereby recommended for approval subject
to the following Conditions:
1. That Hennepin County Recorder accepts the waiver.

hold a hearing on Tuesday, October 31, 1989, at 7:30 p.m., in the Raspberry Room
of City Hall, lower level, to consider dividing the Harley Hopkins site, 137 Monroe
Avenue South, into two parcels. The City will own the east half of the site for a
storm water retention pond/recreation area. The School District will continue to
own the existing structure.

RESOLUTION NO: 89-95
RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR WAIVER OF PLAT WVR89-3
WHEREAS, an application for a Waiver of the Platting
Requirements entitled WVR89-3, made by the City of
Hopkins to divide the Harley Hopkins property into
two parcels is approved.
WHEREAS, the procedural history of the application is as
follows:
l. That an application for Waiver of the Plat
WVR89-3 was filed with the City of Hopkins
on September 29, 1989.
2. That the Hopkins Planning Commission reviewed
such application on October 31, 1989.
3 . That the Hopkins Planning Commission,
pursuant to mailed notices, held a public
hearing on October 31, 1989: all persons
present at the hearing were given an
opportunity to be heard.
4. That the written comments and analysis of the
'~ City Staff and the Planning Commission were
considered.
NOW THEREFORE BE IT RESOLVED, that application for Waiver of
Plat WVR89-3 is hereby approved subject to the
following Findings of Fact:
l. That the proposed lots meet the minimum
requirements for an R-1-A. district.
2. That the existing school will have the
minimum setback from the new lot line.
BE IT FURTHER RESOLVED, that application for Waiver of Plat
WVR89-3 is hereby approved subject to the
following Conditions:
1. That the Hennepin County Recorder accepts the
waiver.
