Staff recommends the following motion: "Move to approve Resolution No• 89-84B at�provinct the waiver of plat of Hawthorne Road with a cul de sac with a 50 foot radius. " This action will allow the applicant to divide the property as proposed with a cul-de-sac meeting the ordinance requirements of a 50 foot radius. " Overview. The applicant has also requested a vacation of the southerly part feet of Hawthorne Road, which includes a 25 foot radius cul-de-sac. The waiver of plat involves the following: o combining of the vacated sections of Hawthorne Road with the adjoining lots, parcel 2 and 3. o parcel 3 will be made larger by adding the vacated Interurban Street and part of lot 15. The area that will be added to ^ parcel 3 is now part of parcel 4. o adding the vacated Interurban Street to parcel 2 from parcel 1 The Commission on a 5-0 vote (Mr. Woodrich abstained) approved Resolution No. Z89-20 approving the waiver with the smaller cul-de- sac. Staff is not recommending the site plan as approved by the Commission because the approved site plan does not meet the minimum requirements of Section 500. 27 of the City Code. Since the Zoning and Planning meeting the staff is continuing to work out a compromise to meet the needs of the City and the concerns of the residents. Anderson, Planner �� WAIVER OF PLAT - HAWTHORNE ROAD � CR: 89-262 Page 2 Detailed Background Mr. Bush had originally submitted a site plan for the vacation and waiver of plat that had a cul-de-sac with a 25 foot radius. This site plan was reviewed by the Public Works Department and was not approved because it did not meet the minimum standards. The staff inet Mr. Bush and Mr. Thorp on site and reviewed what the City would require. Mr. Bush was concerned with keeping large oak trees on the west side of the road. To keep the oak trees the cul-de- � sac was set to the east side of the property. Mr. Bush then submitted another site plan with the off-set larger cul-de-sac. Both site plans are attached for your review. This item was continued from the September meeting because of objections from the residents over the increased size of the cul-de-sac as recommended by staff. Paul Thorp and Walter Bush appeared before the Commission and reviewed the proposal. Jon Thiel, Public Works Director, was at the meeting and reviewed the ordinance requirements. Mr. Thiel stated that Section 500.27 of the City Code required minimum standards for cul-de- ^ sacs and that the larger off-set cul-de-sac meets those requirements. The minimum standard for a cul-de-sac is a 50 foot radius. Several residents had submitted letters opposing the 50 foot radius. Several residents spoke objecting the large cul-de-sac. The Commission had considerable discussion about the size of the cul-de- sac. Primary Issues to Consider o Will the new lots meet the minimum requirements for the R-1-C district? The following are the minimum requirements for the R-1-C district: - lot area 12, 000 square feet - lot width 80 feet The proposed lots will have the minimum lot area and width. The lot with the existing home will be made smaller but the lot will still exceed the minimum requirements for the R-1-C district. The setback from the home to the lot line is 12 feet. The minimum requirement is 12 feet. Al1 three vacant lots will be buildable from a zoning perspective with ^ either site plans. � 1 r� WAIVER OF PLAT - HAWTHORNE ROAD CR: 89-262 � Page 3 Alternatives. 1. Approve the wavier of the plat with a 50 foot radius. By approving the wavier the applicant will have three buildable lots with a cul-de-sac at the end of Hawthorne Road which meets the City Code requirements. 2. Approve the waiver of the plat with a 25 foot radius. by approving the waiver the applicant will have three buildable lots with a cul-de-sac at the end of Hawthorne Road which does not meet the City Code requirements. 3. Deny the wavier of the plat. By denying the wavier, the vacated road cannot be added to the end lots and the vacated interurban street also cannot be added to the end lots. 4. WHEREAS, the procedural history of the application is as follows: l. That an application for Waiver of Plat WVR:89-2 was filed with the City of Hopkins on August 16, 1989. 2. That the Hopkins Planning Commission reviewed such application on September 26, 1989. 3. That the Hopkins Planning Commission, pursuant to published and mailed notices, held a public hearing on September 26, 1989; all persons present at the hearing were given an opportunity to be heard. 4. That the written comments and analysis of the � City Staff and the Planning Commission were considered. NOW THEREFORE BE IT RESOLVED, that application for Waiver of Plat WVR:89-2p is hereby approved subject to the following Findings of Fact: l. That the new lots created meet the minimum lot requirements. 2. That a large cul-de-sac would not fit with the character of the neighborhood. 3. That the existing streets do not have cul-de-sacs. BE IT FURTHER RESOLVED, that application for WVR:89-1 is hereby approved subject to the following Conditions: 1. That a cul-de-sac with a 25 foot radius is constructed. 2. " Approval of this motion will combine the vacated Hawthorne Road with parcels 2 and 3, add part of lot 15 and the vacated interurban street to parcel 3, and add the vacated interurban street to parcel 2. overview. The applicant has also requested a vacation of the southerly part feet of Hawthorne Road. The following are the minimum requirements for the R-1-C district: - lot area 12, 000 square feet - lot width 80 feet The proposed lots will have the minimum lot area and width. The lot with the exising home will be made smaller but the lot will still exceed the minimum requirements for the R-1-C district. The setback from the home to the lot line is 12 feet. The minimum requirement is 12 feet. All three vacant lots will be buildable from a zoning perspective. Alternatives. � 1. Approve the wavier of the plat. By approving the wavier the applicant will have three buildable lots with a cul-de-sac at the end of Hawthorne Road. 2. Deny the wavier of the plat. By denying the wavier, the vacated road cannot be added to the end lots and the vacated interurban street also cannot be added to the end lots. 3 . Continue for further information. WHEREAS, the procedural history of the application is as follows: 1. That an application for Waiver of Plat WVR:89-2 was filed with the City of Hopkins on August 16, 1989. 2 . That the Hopkins Planning Commission reviewed such application on September 26, 1989 . 3. That the Hopkins Planning Commission, pursuant to published and mailed notices, held a public hearing on September 26, 1989; � all persons present at the hearing were given an opportunity to be heard. 4. That the written comments and analysis of the City Staff and the Planning Commission were considered. - NOW THEREFORE BE IT RESOLVED, that application for Waiver of Plat WVR:89-20 is hereby recommended for approval subject to the following Findings of Fact: 1. That the new lots created meet the minimum lot requirements. BE IT FURTHER RESOLVED, that application for WVR:89-1 is hereby recommended for approval subject to the following Conditions: 1.
