Approval of this motion will allow the City to continue to have access to a portion of public parking. Overview. The City and Merriam Park Company are proposing a land exchange on two adjacent parcels of land. The City is proposing to deed the southerly two feet of it's property at 9 - 9th Avenue South to the property to the south, 15 - 9th Avenue South. In return, Merriam Park will deed the east six feet of 15 - 9th Avenue South abutting the public parking. This exchange of property is taking place because of the access to the public parking. The aisle to the public parking is behind the City lot and Merriam Park Company. If a fence was put on the east lot line of Merriam Park Company property, the aisle to the public parking ^ would be narrow and difficult to maneuver a car in and out of the parking spaces. Staff is recommending approval because without the additional 6 feet of land, aCcess to the public parking in the future could be restricted. Staff reviewed , the proposal with the Commission. There was little discussion on tY�e proposal. The Commission felt it was an appropriate exchange of property. This property was acquired by the City because of the deteriorated building on the site. This site is currently being used as a parking lot and will continue with that use unless there is a redevelopment opportunity. The land the City is exchanging is indicated on the attached survey as parcel A. The land Merriam Park is exchanging is indicated as parcel B. Parcel C has nothing to do with this exchange. Primary Issues to Consider. . o Do the new lots conform with the B-2 district requirements? The new lots will conform with the B-2 district requirements. The minimum lot width for a lot in the B-2 district is 20 feet. The City parcel will be 28 feet in width and the Merriam Park parcel will be '� approximately 72 feet. The only other concern is the rear yard setback for the existing building on the Merriam Park property. The required setback is 10 feet, which the building will have. Alternatives. l. Approve the Wavier of Plat as recommended by staff to allow the exchange of property. By approving the Wavier of Plat the City will be assured of access to the abutting public parking. 2. Approve the Wavier of Plat with additions/changes. If the Commission feels that additional conditions should be added, it should be done at this time. 3 . Deny Wavier of Plat for the exchange of land. By denying the Wavier of Plat, the City in the future may not have access to a portion of the public parking area behind 15 9th Avenue. 4. Continue for further information or analysis. WHEREAS, the procedural history of the application is as follows: 1. That an application for Waiver of Platting Requirements WVR89-1 was filed with the City of Hopkins on August 4, 1989. 2 . That the Hopkins Planning Commission reviewed such application on August 29, 1989. 3 . That the Hopkins Planning Commission, ""1 pursuant to mailed notices, held a public hearing on August 29, 1989: all persons present at the hearing were given an opportunity to be heard. 4. That the written comments and analysis of the City Staff and the Planning Commission were considered. NOW THEREFORE BE IT RESOLVED, that application for Waiver of Plat WVR89-1 is hereby recommended for approval subject to the following Findings of Fact: 1. That the new lots will meet the minimum requirements for the B-2 district. 2 . That the additional six feet is needed to assure access to the public parking lot.
