RESOLUTION NO: 88-45
RESOLUTION MAKING FINDINGS OF FACT AND DENYING
APPLICATION FOR WAIVER OF PLATTING REQUIREMENTS WVR88-2
WHEREAS, an application for a Waiver of the
Platting Requirements has been filed by the City of Hopkins
to add additional area for the parking facility between lOth
& llth Avenues South and north of the Norwest Bank.
WHEREAS, the procedural history of the application
is as follows:
l. That an applcation for a Waiver of the Platting
Requirements was filed with the City of Hopkins
on June 6, 1988 .
2 . That the Hopkins Planning Commission reviewed
such application on June 28, 1988.
3. That the Hopkins Planning Commission, pursuant
to mailed notices, held a public hearing on
^ June 28, 1988 ; all persons present at the
hearing were given an opportunity to be heard.
4. That the written comments and analysis of the
City staff and the Planning Commission were
considered.
NOW THEREFORE BE IT RESOLVED, that the Hopkins
City Council makes the following Findings of Fact in respect
to Waiver WVR88-2
l. That the new lots created meet the lot area for
the B-2 district.
2. That the existing setbacks will not be affected
by the new division line.

WAIVER OF PLATTING REQUIREMENTS - CITY OF HOPKINS
Proposed Action.
Staff recommends the following motion: That the recruest for a Waiver
of the Plattinct Requirements bv the Citv of Hopkins to add additional
area for the parkinq facilitv be at�broved.
Approval of this motion will allow the City to obtain title to four
additional parking spaces.
Overview.
Norwest Bank has agreed to transfer to public ownership a 44 'x37 '
parking area just east of the other land which the bank transferred
with the parking ramp. In the original plan the City was to have an
easement for puhlic parking on this property. With this additional
land the City will have title to all the parking area that was owned
._ by the bank.
Staff explained that this parking area was originally proposed to be a
parking easement to the City It was later decided that the City
should own this area to ensure uniformity and control of all the
parking at the ramp and bank site.
The Commission had very little discussion on this matter.
The Commission voted unanimously to approve the Waiver of the Plat to
add a 44'x37 ' area to the parking ramp facility by Resolution 88-45.

Detailed Backqround.
The subject parcel which the bank is proposing to transfer to the City
consists of 4 parking spaces.
The existing setbacks will not be affected.
- What is the impact of allowing this waiver?
The new lots created will not change any existing conditions except to
make one lot smaller and the other larger. The ordinance requirements
are all met.
The original land obtained by the City included all the parking spaces
along the north side of the site except these four spaces on the east.
It was felt by the staff and the bank that the City should have title
to all the parking to insure uniformity and control of all the parking
._._ at the ramp and the bank site.
The only obligation of the City as a result of the trts
ansfer will be to maintain this property, ie: snow removal, seal coat.
This should create no problem as athe City will be doing this work for
the ramp and adjacent surface parking in this area.
Alternatives.
l. Approve the Waiver of Plat. By granting the Waiver the
City will obtain title to the subject area.
2. Deny the Waiver. By denying the Waiver, the bank will
reatin possession of four parking spaces.
3 . Deny the Waiver but have the applicant subdivide the
property. This alternative will have the same results as
a Waiver, but add an additional cost.
4. Continue for further information. If the Commission
feels that more information is needed, the item should be
continued.
