RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR WAIYER OF PLATTING REQQIREMENTS
WHEREAS, an application for a Waiver of the
Platting Requirements entitled WYR87-2 has been made by Jon
Schxartzman , 417 Cottage DoWns , to divide tWo existing
parcels .
WHEREAS , the procedural history of the application
is as follows:
1 . That an application for Waiver of Platting
Requirements WVR87-2 Was filed With the City
of Hopkins on April 10 , 1987 .
2 . That the Hopkins Planning Commission revieWed
such application on April 28 , 1987 •
3 . That the Hopkins Planning Commission �
pursuant to mailed notices , held a public
hearing on April 28 , 19a7 ; all persons
-� present at the hearing Were given an
opportunity to be heard .
4 . That the written comments and analysis of the
City Staff and the Planning Commission Were
considered .
NOW THEREFORE , BE IT RESOLYED , that the Hopkins
City Couneil makes the folloWing Findings of Fact in respect
to WVR87-2 :
1 . That the lots meet the minimum lot size for an R-
1 -D District .
2 . That the existing setbacks xill not be decreased
by the Naiver.
3 . That the Commission has previously granted Waiver
of the Plat for a single property division .
BE IT FURTHER RESOLVED „ that application WVR87-2
is hereby approved sub�ect to the folloWing Conditions:
1 . That the Waiver is accepted by the Hennepin County
Reoorder.

PURPOSE: To revieW and recommend action on a request
for a Waiver of the Platting Requirements .
BACRGROIIND: See staff report to Zoning and Planning
Commission . The applicant � Jon Sehwartzman , appeared
before the Commission . He stated that the netr lot line
Would give him a greater side yard because he was
intending to sell the vacant parcel .
RECOMMENDATION: The Commission voted unanimously to
recommend approval of the Waiver of the Platting
^ Requirements With the following Findings of Fact:
1 . That the lots meet the minimum lot size for
an R-1 -D District .
2 . That the existing setbacks Will not be
decreased by the Naiver.
3 . That the Commission has previously granted
Waiver of the Plat for a single property
division .

PLANNING COMMISSION
REPORT N0: WVR87-2 APRIL 17 , 1987
PURPOSE: To review and recommend action on a request
for a Waiver of the Platting Requirements .
BACKGROUND•
Name of Applicant : Jon Schwartzman
Address of Property: 417 Cottage Downs
Present Zoning: R-1 -D -
Nature of Request : To divide two existing
parcels into 20 ,000 square feet and 24 ,500
^ square feet
Reason for Request : To sell vacant lot
The applicant is proposing to add a 15 foot wide strip
to the west side of his property at 413 Cottage Downs ,
from the vacant abutting lot . The applicant owns both
lots .
The east parcel will contain 24 ,450 square feet and the
westerly parcel will have 20 ,000 square feet . An R-1 -D
district has a minimum lot size of 20 ,000 square feet .
ANALYSIS: Both lots will conform With the minimum lot
requirements for the R-1 -D district . The easterly
parcel has an existing dwelling on the lot . The
westerly setback will be increased to 27 . 15 feet , all
other setbacks will remain the same . The westerly
parcel is a vacant lot which the applicant has stated
he probably will be selling . Both lots presently have
aceess off of cottage Downs .
A Waiver of the Plat is the usual procedure with a
simple lot division because of the expense to the
applicant and the creating of new small plats .
