RESOLUTION MAKZNG FINDINGS OF FACT AND APPROVING
WAIVER OF PLATTING REQIIIREMENTS WVR87-1
WHEREAS � an application for a Waiver of the
Platting Requirements WVR87-1 , to divide Lots 3 , 4 & 5 ,
Block 1 � Uppal' s Addition , has been made by Sohan Uppal , for
the purpose of construeting a four family dWelling on each
lot .
WHEREAS , the procedural history of the application
is as folloWs :
1 . That an application for Waiver of the Platting
Requirements WVR87-1 , was filed With the City of
� Hopkins on March 12 � 1987 •
2 . That the Hopkins Planning Commission reviewed such
application on March 31 , 1987 •
3 . That the Hopkins Planning Commission , pursuant to
mailed notices , held a public hearing on March 31 ,
1987 ; all persons present at the hearing were
given an opportunity to be heard .
� . That the Written comments and analysis of the City
Staff and the Planning Commission Were considered .
NOW THEREFORE BE ZT RESOLVED , that the Hopkins
City Council makes the folloWing Findings of Fact in respect
to WVR87-1 :
1 . That the sub,ject lots meet the minimum lot
requirements for an R-2 District.
BE IT FURTHER RESOLVED , that application for
Flaiver of the Platting Requirements WVR87-1 is hereby

PURPOSE: To review and recommend action on an
application for a Waiver of the Platting Requirements .
BACKGROUND: See staff report to Zoning and Planning
Commission . The applicant � Sohan Uppal , appeared
before the Commission . Mr . Uppal stated that he Wants
to build tWo � four family dwellings on the site . He
also noted that no variances are being requested .
RECOMMENDATION: The Commiss.ion voted unanimously to
recommend approval to waive the platting requirements
� �+ith the following Findings of Fact:
1 . That the sub,ject lots meet the minimum lot
requirements for an R-2 Distriet .

PURPOSE: This report is to review and recommend action on an
application for a Waiver of the Platting Requirements .
BACKGROUND ;
Name of Applicant: Sohan Uppal
Address of Property: Lots 3 , 4 and 5 � Uppals
Addition
Present Zoning: R-2
Reason for Request : Building tWo � - four family
dWellings instead of previously approved ten
units .
' Nature of Request : To divide 3 lots into 2 lots of
20 ,2�2 square feet and 20 ,3�7 square feet .
The applicant is proposing to divide three existing lots
into two for the purpose of constructing txo � four family
dwellings .
In July 1985 , the applicant applied for and was granted
sideyard variances and a Conditional Use Permit to construct
10 toWnhomes on the three sub�ect lots . The Conditional Use
Permit was granted a one year extension on July 1 � 1986 .
Since the granting of the extension � the applicant wishes to
construct two , four family dWellings instead of the 10
townhome units . A 2-4 family dWelling is permitted within
the R-2 Distriet .
The applicant would not be required by the Zoning Ordinanee
to obtain a Conditional Use Permit for construction of the
pro�ect• because 1 thru 4 family structures do not require
one . The applicant has not applied for any variances in .
connection with the construetio❑ of the 4-plexes , these
dwellings Kill have to comply Kith the minimum requirements
of the zoning distri.ct .

The area around the sub�ect site consists primarily of
apartments and other multiple family type dWellings .
The sub,jeet property boarders Nine Mile Creek . Any building
will require an approved plan from the Nine Mile Creek
Watershed District as Well as final review by the Director
of Engineering for Flood Plain encroachment and drainage .
Aecess to the lots will be from 9th Avenue .
ANALYNSIS: The Hennepin County Recorder has told the
applieant the waiver Would be acceptable . Both lots meet
---� the minimum requirements for an R-2 District . The
Commission does have the option of requiring the applicant
to go through the formal platting procedures � but the
results xould be the same since the lots are conforming to
the disrict . Past policy is to grant a r+aiver from the
platting process on a simple division .
The Commission also has the option of continuing the
application . This does not seem logical since it appears
all necessary information has been provided by the
applicant .
ALTERNATIVES•
1 . Approve• the Waiver of the plat uith the condition
it is accepted by the Hennepin County Recorder.
2 . Require the applicant to go through the regular
subdivision procedure .
3 . Continue the waiver for further information .
RECOMMENDATION: I recommend Alternative #1 . The folloKing
are Findings of Fact and Conditions should the commissison
recommend approval :
1 . That the sub�eet lots meet the minimum lot
requirements for an R-2 Distriet .
