RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR WAIVER OF PLATTING REQUIREMENTS
WVR86-1
WNEREAS, an application for a Waiver of the Platting Requirements has
been made by Perkl/Mason, 921 Mainstreet, to divide said lot for addition
to building attached to adjacent lot.
WHEREAS, the procedural history of the application is as follows :
1. That an application for Waiver of Platting Requirements WVR86-1
was filed with the City of Hopkins on December 26, 1985.
2. That the Hopkins Planning Comnission reviewed such application
on January 28, 1986.
3. That the Hopkins Planning Commission, pursuant to mailed notices ,
held a public hearing on January 28, 1986; all persons present at
the hearing were given an opportunity to be heard.
^ 4. That the written comments and analysis of the City Staff and the
Planning Corm�ission were considered.
NOW THEREFORE BE IT RESOLVED, that the Hopkins City Council makes the
following Findings of Fact in respect to WUR86-1 :
1. That the Waiver of the Platting Requirements will form two conforming
lots.
2. That the building as proposed may be built on the proposed lot.
3. That the proposed lots conform to all requirements of the City' s
zoning ordinance.
BE IT FURTHER RESOLVED, that application for Waiver of Platting Require-
ments is hereby approved subject to the following condition:

Recorder. —

WAIVER OF PLATTING REQUIREMENTS
921 MAINSTREET
PLANNING COMMISSION
REPORT N0. WVR86-1 JANUARY 16, 1986
PURPOSE: To review and recommend action on a waiver of the platting requirements
to divide the lot at 921 Mainstreet.
BACKGROUND:
Nature of Request: To divide a single lot of approximately 3640 square feet
into two separate lots of approximately 1782 and 1858
square feet.
Name of Applicant: Bob Mason
Address of Property: 921 hlainstreet
Present Zoning: B-2
Reason for Request: To build a building as part of adjacent lot in conjunction
with purchase of land.

The applicant is proposing to divide a single parcel of land into two separate
parcels at the current site of Preferred Travel . The applicant was approved
for a Conditional Use Permit for construction on this site and the adjoining
property and a variance to locate the building one foot from the lot line at the
trash dumpster. A B-2 district does not have a minimum lot area, however, there
is a minimum lot width of 20 feet, which both lots will have. The applicant will
have access to the subject property from the alley.
It has been usual policy for the Commission to grant a waiver of the plat on a
single division provided the lots created are legal and with approval contingent
upon acceptance by Hennepin County Recorder of the division.
ANALYSIS: The applicant has requested a waiver of the plat to construct a building
in conjunction with the building on the adjacent lot. The proposed lots will com-
ply with the minimum lot requirements for a B-2 district.
RECOMMENDATION: I recommend approval of the waiver of the platting requirements
based on the fact that two conforming lots will be created. The following findings
of fact are suggested should the commission recommend approval :
