Staff recommends the following motion: Move to a�prove Resolution RZ95-25 a�provin�a Registered Land Survey for the Hopkins Activitv Center located at 33 14th Avenue North. Overview. In 1979, the City of Hopkins purchased the Hopkins Activity Center at the Renaissance Apartments. The executed deed was never submitted to the Hennepin County Recorder's Office for recording. The City's attorney has drafted a new deed, but the Hennepin County Recorder's Office has not approved it because the legal description is deemed to be too complicated to be incorporated in a quit claim deed. The County is requiring a plat or a registered land survey (RLS). The City staff has had an RLS completed and the Hennepin County Recorder's Office has reviewed it to ensure its correctness. The RLS document must � now be approved the City Council and the Zoning and Planning Commission. NOW, THEREFORE, BE IT RESOLVED by the Zoning and Planning Commission of the City of Hopkins, Minnesota: 1. The registered land survey hereto attached is approved. � 2. Staff recommends adoption of the following motion: Move that Council .- ado�t Resolution 95-88. Resolution ADvrovinQ ReQistered Land Survev, Ho�k.ins Activitv Center. Overview. . Since 1991 the City has attempted to establish an official recording of the City's deeded interest in the activity center at the Renaissance Apartment site. Staff has encountered numerous obstacles in getting a deed recorded and the commissioning of a registered land survey appeared to be an ultimate solution. An RLS has been completed and reviewed by the Hennepin County Recorders Office and is now presented to Council for approval. Primarv Issues to Consider. • Background — A 1979 agreement with the National Housing Partnership set in motion the purchase of the current Hopkins Activity Center at the Renaissance Apartments. The fully executed deed concerning this purchase was never submitted for recording by the attorney who drafted the document. This came to light in 1991 after the City had completed a remodeling project at the center. The City's attorney drafted a new docwnent, and approval was granted by NHP in 1992. Since that time the City's attorney has been negotiating with the County Recorder's Office to get the document recorded. Approval has not been forthcoming because the legal description is deemed to be too complicated to be incorporated in a quit claim deed. The County has insisted on either a platting procedure or a registered land survey and has not relented. The City eventually agreed to an RLS and one was drawn up with constant review by the County Surveyor to avoid any pitfalls. The document before Council stems from that draft procedure and review. • Recommendation Staff recommends adoption of Resolution 95-88.
