CONDITIONAL USE PERMIT -ZERO LOT LINE HOME
Proposed Action.
Staff recommends the following motion: Move to a�prove Resolution RZ93-26
recommendin� aQproval of a conditional use �ermit to construct a zero lot line home on the
two southerly lots at 234 18th Avenue North.
Overview.
The applicant owns three 40 foot lots at 234 18th Avenue North. Last month the applicant
was granted a waiver of plat to create one 44 foot lot, and two 38 foot lots. On the 44 foot
lot the applicant will be constructing a single family home. On the two 38 foot lots, the
applicant is proposing to construct two zero lot line homes. A zero lot line home requires a
conditional use permit.
^ The applicant is proposing to construct two 4 level, 3 bedroom/2 baths homes with a 2 sta11
attached garage. The homes will be owner occupied. The existing home presently located on
the subject lots will be razed for the construction of the new homes.
Without a conditional use permit, the applicant would have the ability to construct a duplex or
two single family homes.

Primary Issues to Consider.
o What are the specifics of the applicant's request?
The applicant is proposing to construct two zero lot line homes on the two southerly lots, at
234 18th Avenue North. The two homes will have a common lot line between the two homes.
Because there will be a common lot line between the two homes, the homes being proposed
can be larger. If the applicant were to build two single family homes an 8 foot side yard
setback is required, which would reduce the size of the homes.
o What is a zero lot line home?
A zero lot line home is a home that is on a lot in such a manner that one side of the home rests
directly on a lot line. A zero line home is similar to a duplex except for the fact that each
property owner owns the lot where the home is constructed. In the case of a duplex, the
person living in the unit does not own the property. Also, the homes have separate utilities.
o What are the Ordinance requirements for a zero lot line home?
Section 5390.09 subd. lu of the Zoning Ordinance states the following:
Zero lot line dwellings may be erected in such a manner that the single family dwellings share
.� common side walls or that four single family dwellings share two common walls with other
dwellings and said walls are located on the rear and side lot lines, provided such dwellings are
compatible with the surrounding land uses. At a minimum, the zoning standards shall be
proportionate to the minimum standards for single family attached dwellings in the relevant
zoning district. Each dwelling unit will have separate utilities. An as-built survey will be
taken after completion of the units and filed with the City.
Zero lot line homes are allowed in all single family zoning districts within the City. The
proposed homes will meet all the zoning requirements for the R-1-A district.
o Are the proposed homes compatible with the neighborhood?
The proposed homes are single family homes. The neighbor is a single and two family homes.
The proposed homes are compatible with the neighborhood.
Alternatives.
1. Recommend approval of the conditional use permit to construct a zero lot line home.
By recommending approval of the conditional use permit, the City Council will
consider a recommendation of approval.

2. Recommend denial of the conditional use permit to construct a zero lot line home. By
recommending denial of the conditional use permit, the City Council will consider a `�
recommendation of denial. If the Planning Commission chooses this alternative,
findings of fact must be stated which support this alternative. If the conditional use
permit is denied, the applicant can construct two single family homes or a dupleY on
the site.
3. Continue for further information. If the Planning Commission indicates that further
information is needed the item should be continued.

RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING
APPROVAL OF CONDITIONAL USE PERMIT AT 234 - 18TH AVENUE NORTH
WHEREAS, an application for a conditional use permit, CUP93-12 ,
made by Phil Hines to allow him to construct two zero lot line homes
on the two southerly lots at 234 - 18th Avenue North.
WHEREAS, the procedural history of the application is as follows:
1. That an application for a conditional use permit CUP93-12
was filed with the City of Hopkins on November 25, 1993 .
2 . That the Hopkins Planning Commission, pursuant to mailed
notices, held a public hearing on the application and
reviewed such application on December 28 , 1993 : all persons
present were given an opportunity to be heard.
3 . That the written comments and analysis of the City staff and
the Planning Commission were considered.
NOW THEREFORE, BE IT RESOLVED that the application for
conditional use permit CUP93-12 is hereby recommended for approval �
based on the following Findings of Fact:
l. That the applicant meets the requirements for zero lot
line homes as outlined in Section 530. 9 Subd. lU.
BE IT FURTHER RESOLVED, that application for CUP93-12 is
hereby recommended for approval based on the following
conditions:
1. That the applicant provide an as-built survey after the
completion of the homes.
2 . That the homes have separate utilities. Applicant
shall receive necessary permits from City to extend
sewer and water utilities into the lots.
Adopted this 28th day of December, 1993 .
