Staff recommends the following motion: Move to approve Resolution RZ93-6 recommending approval of a conditional use permit to construct a 10' x 30' buildinct at 111522 Minnetonka Boulevard. � overview. � Minnegasco is proposing to construct a 10' x 30' building to house a natural gas district regulator station at 11522 Minnetonka Boulevard. The subject site is located in the City of Hopkins but owned by the City of Minnetonka. Part of the site is used for a Minnetonka lift s,�ation. Minnetonka has approved the proposed building. The purpose of the regulator station is to reduce the gas pressure for transmission pipeline pressures to a lower ^ pressure that can be used in neighborhood distribution systems. The Zoning Ordinance requires a conditional use permit for public or private utility structures within the residential district. The Zoning Ordinance does not detail any specific conditions. The site is zoned R-1-D, single family low density. o What is the site desiqnated in the Comprehensive Plan? The site is designated as open space in the Comprehensive Plan. Most of the area is open space. o What are the specifics of the site plan? Access • The access to the site will be from the parking lot of the City of Minnetonka Maintenance Building. There will be no access from Minnetonka Boulevard to this facility. Landscapinq � The applicant will be putting in no additional landscaping. The Zoning Ordinance allows a credit for existing landscaping. The existing landscaping provides more than the requirements and will screen the building from '� Minnetonka Boulevard in the summer. DrainaQe The Watershed District has approved the proposed building subject to the City of Hopkins approving the proposed building. The building will be constructed at 2 .5 feet above the flood elevation. The flood plain ordinance requires at least one foot above the flood elevation. Fire marshal The Fire Marshal has reviewed the proposed building and has found the preliminary plans acceptable. ParkinQ There will be a driveway on the north side of the proposed building. If more than one space is needed the parking lot to the west will provide additional parking. Exterior The exterior will be concrete block. The exterior is proposed to match the exterior of the Minnetonka Operations and Maintenance Building. The exterior of the operations and maintenance building is painted white. The staff at Minnetonka has recommended that the building is painted an earth tone color, to match the surrounding area. � CUP93-3 Page 3 � o What is the staff recommendation? Staff is recommending approval of the conditional use permit to construct a gas regulator station. Alternatives. 1. Recommend approval of the conditional use permit. By recommending approval of the conditional use permit, the City Council will consider a recommendation of approval of the conditional use permit. 2 . Recommend denial of the conditional use permit. By recommending denial of the conditional use permit the City Council will consider a recommendation of denial of the conditional use permit. 3 . Continue for further information. WHEREAS, the procedural history of the application is as follows: 1. That an application for a conditional use permit CUP 93-3 was filed with the City of Hopkins on February 25, 1993 . 2 . That the Hopkins Planning Commission, pursuant to published and mailed notices, held a public hearing on the applicati�on and reviewed such application on March 30, 1993 : all persons present at the hearing were given an opportunity to be heard. 3 . That the written comments and anaysis of the City staff and the "� Planning Commission were considered. 5. That the legal description of the property is as follows: That part of Tract C, Registered Land Survey number 291, according to the plat thereof on file and of record in the Office of the Registrar of Titles in and for said Hennepin County, as memorialized on Certificate of Title number 642115, described as: Beginning at the Southwest corner of said Tract C; thence Northerly along the West line of said Tract C, a distance of 82 . 83 feet; thence Easterly, measured at right angles, a distance of 101. 00 feet; thence Southerly, measured at right angles, to the intersection with the Southerly line of said Tract C, said point also being the Northerly right-of-way of County State Aid Highway number 5 (A.K.A.
