AMEND CONDITIONAL USE PERMIT - 420 MAINSTREET
Proposed Act�ion.
Staff recommends the following motion: Move to approve
Resolution RZ93-5 recommending approval to amend the
conditional use permit
overview.
Minnetonka Motors received a conditional use permit to
operate an auto sales lot at 420 Mainstreet in 1989.
Minnetonka Motors has vacated the site and a new tenant,
Inver Hills Mazda is now occupying the site. The new
tenant, Inver Hills Mazda is requesting to use the east 50
feet of the site for car display. The former operator used
this area without approval. The area that the applicant is
requesting to be used for additional display cars is vacant
and owned by the adjacent car wash.
Minnetonka Motors, the former tenant was permitted to have
24 display cars. The new tenant is requesting that the
display cars are increased to 42 cars. The additional
^ display cars will be located on the east side of the 24
display cars.
Minnetonka Motors also received an amendment to their
conditional use permit to expand to the west. The expansion
to the site was approved on March 2, 1992 . If this area is
not used within a year of the granting of the conditional
use permit for the purpose it was approved, the conditional
use permit will expire.

Primary Issues to Consider
The following are the conditions for a conditional use
permit:
1. the sales lot shall not be larger in square footage
than the square footage of the building devoted to the
related business;
2 . a 20 foot front yard setback for auto parking;
3 . lighting of the sales lot shall be totally from
indirect lighting;
4 . should the lot abut an R district an acceptable design
of screening fence five feet in height shall be
construct along the abutting lot line;
5. the auto sales lot shall not include vehicles over a
9, 000 lb. rated weight.
The applicants operation will meet all of the above
requirements with the additional property to be used as
"-` display vehicles.
o What are the specifics of the site plan?
The site will remain the same as it exists today with the
except the east 50 feet will be used for car display. The
site will have 7500 square feet of vehicle and office
showroom. 7500 square feet will allow the site to have 42
display vehicles.
When Minnetonka Motors requested an expansion to their
conditional use permit the appearance of the landscaping was
discussed. At that time Mr. Traiser stated they would add
additional plantings to the existing landscaping along
Mainstreet, plus provide additional landscaping in the new
area. Staff would recommend that additional landscaping is
added along Mainstreet. Staff has notified the applicant of
this recommendation and advised the applicant to bring a
landscape plan with the additional planting to the meeting.
The applicant has stated he would be willing to plant
additional plantings. If the applicant does not bring a
landscape plan with the addition�l plantings to the meeting,
the staff would recommend an additional condition to the
added to the resolution regarding the additional
landscaping.

Alternatives
1. By recommending approval of the amendment to the
conditional use permit, the City Council will consider
a recommendation of approval for the conditional use
permit.
2 . Recommend denial of the amendment to the conditional
use permit. By recommending denial of the conditional

3 . Continue for further information. If the Commission
indicates that further information is needed, the item

This application is basically intended to attach the easterly 50 ft. to
the use that is approved for 420 Main Street.
This has been the site of Minnetonka Motors for the past three(3)
years. They lost their line of credit and were forced out of business.
The new tenant is Inver Hills Mazda. Principals are as follows:
Owner: Paul Walser
President: Charles Hirsch
Manager: Douglas Sprinthall
� Minnetonka l�lotors and Trakup did obtain a conditional use permit
amendment in 1992, but then the tenant backed out the lease.
Nature of this An�lication
♦ The property at 420 Main (legally described in Exhibit A) has a
current permit for 24 cars.
♦ Building area is 7,500 SF so code permits 42 cars (7500 - 180 per car)
♦ Previously Minnetonka Motors used Lot 12 (legally described in
Exhibit B), however the conditional use permit did not cover that lot.
This application is intended to cover this Lot 12 and establish 42 cars
as the allowed use.
♦ Applicant will provide landscaping in front of lot comparable to
existing landscaping.
Trakup is a partnership of William Traiser and Donald Soukup. They have owned this
property for the past 15 years. In the last 12 months, they have invested in a great
deal of money in exterior building appearance, including blacktop, paint and facia
improvements and the like.

RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING
APPROVAL OF AN APPLICATION FOR A VARIANCE
WHEREAS, an application for a conditional use permit CUP 93-2
made by Minnetonka Motors is recommended for approval. ,
WHEREAS, the procedural history of the application is as follows:
1. That an application for a conditional use permit CUP 93-2 was
filed with the City of Hopkins on January 20, 1993 .
2 . That the Hopkins Planning Commission reviewed such application on
February 23 , 1993 .
3 . That the Hopkins Planning Commission, pursuant to published and
mailed notices, held a public hearing on the application on
� February 23 , 1993 : all persons present at the hearing were given
an opportunity to be heard.
4. That the written comments and anaysis of the City staff and the
Planning Commission were considered.
NOW THEREFORE, BE IT RESOLVED that the application for
conditional use permit CUP 93-2 is hereby recommended for approval
based on the following Findings of Fact:
1. That the applicant meets the requirements for a conditional
use permit for an auto sales lot.
BE IT FURTHER RESOLVED, that application for CUP 93-2 is hereby
recommended for approval based on the following conditions:
1. All previous conditions required as part of CUP 89-17 are
still in effect.
2 . That additional landscaping be provided in the front yard
setback.
Adopted this 23rd day of February, 1993 .
