CR 05-024 Fee Increases February 10, 2005 Council Report 2005-024 Approve Additional Fees And Increases to Certain Fees Proposed Action Staff recommends adoption of the following motion: Move to adopt Ordinance 2005- 942. Ordinance amendinq Section 355,15. Administrative Citation Fine Schedule. and Section 925.49 of the Hopkins City Code for first readinq; and adopt Resolution 2005- 017, resolution settinq various fees in Section 1010 and 1020 of the Hopkins City Code. Overview This action will increase very few fees and add fees for specific services that are not currently listed in the fee schedule. Animal boarding fees increase around this time of year every year. It is difficult to keep the changes current in the ordinances. The boarding fees would be dropped from the schedule. Section 925 of the City Code would be revised to reflect the owner's responsibility for resulting charges from the designated pound or boarding facility. Truth in Housing evaluator license fees have not gone up in the past few years. An increase of $5.00, from $30 to $35, would cover increased costs of processing the applications and verifying licensure, . New Fees A fee for Motor Vehicle BrokerlWholesaler/Auctioneer would be added to Chapter Ten under the Business and Regulatory heading. Section 1115.05 of the Hopkins City Code specifies that no person shall engage in the business of: a) New motor vehicle dealer, b) Used motor vehicle dealer, c) Motor vehicle broker, d) Motor vehicle wholesaler, or e) Motor vehicle auctioneer, without first obtaining a license from the City of Hopkins. The fee for a motor vehicle dealer is $400. This license fee takes into consideration that a motor vehicle dealer will have a car sales lot, which requires a greater number of police patrols/hours. A fee for a broker, wholesaler, or auctioneer has not been established in the fee schedule. A broker, wholesaler, or auctioneer would not have an outdoor car sales lot. A fee of $400 is difficult to justify, The suggested fee is $50.00. A rental housing re-inspecting fee is being requested. The fee of $35.00 would be charged on the third inspection or appointment. On the initial inspection, the inspector writes orders that the owner must comply with, The second inspection is to verify that the work orders have been completed. If they are not, the inspector must make a third inspection, Also, often times the owner of the building will make an appointment to meet the inspector for the first or second re-inspection. When the owner of the building is a no-show for the appointment, the $35 fee would be charged. It is hoped that this fee will cut down on the number of re-inspections that are currently being made, A change is being made to Section 1020.29 - 9 to indicate that the City cannot give out information on topographic map information that is newer than 1998. Only Hennepin County can give information from 1999 to the present. The Engineering department provides standard colored CAD plots. A fee has not been established for that service. The suggested fee is $10. The fee for custom CAD Plots Council Report 2002- Page 3 will be based on the materials used and on the staff time to prepare the information. The fee schedule does not currently indicate this. Currently, when a citation is issued for failing to obtain a truth in housing evaluation, the fine for failure to obtain the evaluation is not listed specifically in the schedule in Section 355.15, so it falls under "Code violations not listed" and the fine is $100. A truth in housing evaluation costs the homeowner an average of $150, Staff believes that the fine should not be an advantage to the homeowner that fails to obtain an evaluation. Staff is recommending that a specific listing be added to Section 355.15 designating the fine for failure to obtain a truth in housing evaluation to be $200. This would make it more advantageous for the homeowner to pay for the evaluation. Alternatives 1. Adopt Ordinance 2005-942 for first reading without changes. 2, Adopt Ordinance 2005-942 with changes to be made before second reading. 3. Do not adopt Ordinance 2005-942. Staff recommends alternative one.
