� STREET VACATION - 3RD STREET NORTH
Proposed Action.
Staff recommends approval of the following motion: Move to adopt
Resolution No: 90-01 approvinct for first reading Ordinance 90-668
vacatina the north lj2 of 3rd Street North between Lot 16, Block 3
and Lot 30, Block 6 of West Minneapolis.
Approval of this resolution will recommend adoption of the ordinance
to vacate approximately the north 134 feet of 3rd Street North.
Overview.
The applicant is proposing to construct a single family home on the
vacant lots at the northeast corner of 20th Avenue and 3rd Street
North abutting Hilltop Park. The applicant has also applied for a
variance and removal of the lots from the official map.
The vacation of 3rd Street North will make construction of a single
family home easier on the two abutting lots. The difference in
elevation between the north and south lot lines of the property is 24
^ feet. Because of this great change in elevation the home is proposed
to be constructed on the hill with access to the home from 20th
Avenue. The Staff is recommending to modify the applicant's request.
The staff is recommending that only the north 1/2 of 3rd Street be
vacated to allow construction of a hammerhead turn-around and access
to the park from the north.
Staff is recommending the vacation of 3rd Street to facilitate
construction of a single family home.
Daniel Reinhold appeared before the Commission and stated that he has
a purchase agreement on the property and wants to construct a single
family home. It was noted that only the north 1/2 of Third Street
will be vacated. The south 1/2 will allow public access to the park.
The Planning Commission unanimously approved Resolution: RZ89-28
recommending approval of Ordinance No: 90-668.

Primary Issues to Consider.
o Is 3rd Street North needed for future public use?
The south 1/2 of 3rd Street is used now by the public for access to
the park and should not be vacated. Also, there should be the
capabilities for a turn-around in the future.
When the abutting lots were removed from the Official Map the Council
was concerned with access to the park if 3rd Street was vacated. Dick
Wilson did confirm that children do use 3rd Street for access to the
park. The staff is recommending that only the north 1/2 of 3rd Street
be vacated to allow access to the park from the east.
20th Avenue does not have a cul-de-sac. Because of the excessive
grades in the area a cul-de-sac would involve a major construction
project. However the west 30 feet of the south 1/2 of Third Street
should be retained for a hammerhead turn-around.
Attached is a memo from Jim Gessele, Engineering Supervisor stating
� that the Engineering Department has no objections to. the vacation of
3rd Street. The grades are as such that it would be very difficult or
impossible to construct a road. There are no utilities in 3rd Street.
Access to the existing homes will not be affected by the vacation.
The lots to the south of 3rd Street have access to their homes from
20th Avenue. The two homes to the north of the subject property have
access to their homes from an alley off of 3rd Street. All the
surrounding area to the north with the exception of the two homes is
park area.
The situation the applicant is in is unique. However, the applicant
only needs the north 1/2 of 3rd Street for construction of the
proposed home. The grades on the subject property are steep and
access is difficult since the right-of-ways are not improved. The
vacation of the north 1/2 of 3rd Street will allow easier construction
of a single family home.

THE COUNCIL OF THE CITY OF HOPKINS DOES HEREBY ORDAIN
AS FOLIAWS:
That the following described thoroughfare in the
following designated area of the City of Hopkins, viz:
The North one-half of Third Street North between Block
• 3 and Block 6 as dedicated in the plat of West
Minneapolis Third Division, according to the plat
thereof on file and of record in the Office of the
County Recorder, Hennepin County, Minnesota, lying
between the extension across it of the West lines of
said Block 3 and 6 and the extension across it of the
^ West lines of the north/south alleys of said Blocks 3
and 6.

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR VACATION OF A PORTION OF THIRD STREET NORTH
VAC:89-2
WHEREAS, an application for vacation of a portion of Third Street
North entitled VAC:89-2 made by Daniel Reinhold, is
hereby approved.
WHEREAS, the procedural history of the application is as
follows:
1. That an application for Street Vacation VAC:89-2
was filed with the City of Hopkins on September
14, 1989.
2. That the Hopkins Planning Commission reviewed such
application on November 28, 1989.
3. That the Hopkins Planning Commission, pursuant to
published and mailed notices, held a public
hearing on November 28, 1989, continued to
December 26, 1989; all persons present at the
^ hearing were given an opportunity to be heard.
4. That the written comments and analysis of the City
Staff and the Planning Commission were considered.
NOW THEREFORE BE IT RESOLVED, that application for vacation of a
portion of Third Street North VAC89-2 is hereby
approved subject to the following Findings of Fact:
1. That Third Street North between Lots 16, Block 1
and Lot 30, Block 1 of West Minneapolis Third
Division is not needed for public use.
2. That the vacation of Third Street North will still
allow access to all the existing homes.
BE IT FURTHER RESOLVED, that application for vacation of a
portion of Third Street North VAC89-2 is hereby approved
subject to the following Condition:
1. That 30 feet of the south 1/2 of Third Street is retained
for a hammerhead turn-around.

ORDINANCE VACATING A PART OF
3RD STREET NORTH
THE COUNCIL OF THE CITY OF HOPKINS DOES HEREBY ORDAIN
AS FOLLOWS:
That the following described thoroughfare in the
following designated area of the City of Hopkins, viz:
The North one-half of Third Street North between Block
3 and Block 6 as dedicated in the plat of West
Minneapolis Third Division, according to the plat
thereof on file and of record in the Office of the
County Recorder, Hennepin County, Minnesota, lying
between the extension across it of the West lines of
-- said Block 3 and 6 and the extension across it of the
West lines of the north/south alleys of said Blocks 3
and 6.
be and the same is hereby vacated as a public thoroughfare.

RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL
OF APPLICATION FOR VACATION OF A PORTION OF THIRD STREET
NORTH - VAC89-2
WHEREAS, an application for vacation of a portion of Third
Street North entitled VAC89-2 made by Daniel
Reinhold is recommended for approval.
WHEREAS, the procedural history of the application is as
follows:
1. That an application for Street Vacation
VAC89-2 was filed with the City of Hopkins
on September 14, 1989.
2 . That the Hopkins Planning Commission reviewed
such application on November 28, 1989.
3 . That the Hopkins Planning Commission,
pursuant to published and mailed notices,
held a public hearing on November 28, 1989
and continued on December 26, 1989 ; all
"� persons present at the hearing were given an
opportunity to be heard.
4 . That the written comments and analysis of the
City Staff and the Planning Commission were
considered.
NOW THEREFORE BE IT RESOLVED, that application for Vacation
of a portion of Third Street North VAC89-2 is
hereby recommended for approval subject to the
following Findings of Fact:
1. That Third Street North between Lots 16,
Block 1 and Lot 30, Block 1 of West
Minneapolis Third Division is not needed for
public use.
2. That the vacation of Third Street North will
still allow access to all the existing homes.
BE IT FURTHER RESOLVED, that application for vacation of a
portion of Third Street North VAC89-2 is hereby
recommended for approval subject to the following
condition:
1. That 30 feet of the south 1/2 of Third Street is
retained for a hammerhead turn-around.
