STREET VACATION - HAWTHORNE ROAD
Proposed Action.
Staff recommends approval of the following motion: "Move to adopt
Resolution No: 89-83B anprovina the vacation of the south part of
Hawthorne Road with a cul-de-sac with a 50 foot radius. "
Approval of this resolution will vacate approximately the south 67
feet of Hawthorne Road with a cul-de-sac meeting the ordinance
requirements of a 50 foot radius.
Overview.
The applicant owns 4 lots at the end of Hawthorne Road. Only one lot
currently has a home constructed on it. The applicant is requesting
to vacate approximately south 90 feet of Hawthorne Road to facilitate
the development the lots to the south. The two lots at the end of
Hawthorne Road currently have no access. The improved Hawthorne Road
ends to the north of the southerly lots.
The City staff is recommending the vacation of the south end of
Hawthorne Road to facilitate construction of a cul-de-sac with a 50
^ foot radius.
The Commission on a 5-0 vote (Mr. Woodrich abstained) approved
Resolution Z89-21 approving the vacation of Hawthorne Road with a 25
foot radius cul-de-sac.
Since the Zoning and Planning meeting the staff is continuing to work
out a compromise to meet the needs of the City and the concerns of the
residents. Staff will be presenting this compromise at the Council
meeting.

Detailed Backqround.
Mr. Bush had originally submitted a site plan for the vacation and
waiver of plat that had a cul-de-sac with a 25 foot radius. This site
plan was reviewed by the Public Works Department and was not approved
because it did not meet the minimum standards.
The staff inet Mr. Bush and Mr. Thorp on site and reviewed what the
City would require. Mr. Bush was concerned with keeping large oak
trees on the west side of the road. To keep the oak trees the cul-de-
sac was set to the east side of the property. Mr. Bush then submitted
another site plan with the off-set larger cul-de-sac.
Both site plans are attached for your review. This item was continued
from the September meeting because of objections from the residents
over the increased size of the cul-de-sac as recommended by staff.
Paul Thorp and Walter Bush appeared before the Commission and reviewed
the proposal. Jon Thiel, Public Works Director, was at the meeting
and reviewed the ordinance requirements. Mr. Thiel stated that
^ Section 500.27 of the City Code required minimum standards for cul-de-
sacs and that the larger off-set cul-de-sac meets those requirements.
The minimum standard for a cul-de-sac is a 50 foot radius.
Several residents had submitted letters opposing the 50 foot radius.
Several residents spoke objecting to the large cul-de-sac. The
Commission had considerable discussion about the size of the cul-de-
sac.
Primarv Issues to Consider.
o Is the southerly part of Hawthorne Road needed by the City?
The vacation of the southerly ends of the streets in Interlachen was
done at two other occasions. Oakwood and the west half of Maple Hill
were vacated in the past.
The south unimproved end of Hawthorne Road abuts Interlachen golf
course. Because Hawthorne Road abuts Interlachen golf course the road
cannot go further south.
The public works department has reviewed the plans and would permit
the southerly portion of Hawthorne Road to be vacated. The applicant
has revised the plans to meet the requirements of the public works
department. The public works department requires a cul-de-sac large
� '� enough to allow the turning around of City vehicles. The other
streets that were vacated in Interlachen present a problem to the
public works department because they cannot provide good service to
the residents because there is not enough space at the end of the
road to turn around a truck. This application provides a good
opportunity to upgrade the street.

Alternatives.
1. Approve the vacation of Hawthorne Road with a 50 foot radius
cul-de-sac. By approving the vacation a cul-de-sac will be
constructed to properly serve the lots at the end of Hawthorne
Road.
2. Approve the vacation of Hawthorne Road with a 25 foot radius
cul-de-sac. By approving the vacation a cul-de-sac will be
constructed as requested by the applicant which does not met
the City Code requirements.
3 . Deny the vacation of Hawthorne Road. By denying the vacation,
access will be limited to the undeveloped lots and make it
difficult for the City to provide adequate service to the lots
once they are developed.
4 . Continue for further information. If the Commission feels
more information is needed, the item should be continued.

Subject: Hawthorne Ave. S. Proposed cul-de-sac
It has been brought to our attention that the city is proposing a cul-
de-sac at the end of Hawthorne Ave. S. The fire department feels this
would be a benefit since it would allow emergency vehicles including
large fire trucks to turn around in the street. We would recommend
that turn arounds be placed at the end of all fire department access
roads with a dead end in excess of 150 ft.

WHEREAS, an application for Vacating a portion of Hawthorne
Road VAC: 89-1 made by Walter Bush Jr. of 249
Hawthorne Road is hereby approved.
WHEREAS, the procedural history of the application is as
follows:
1. That an application for Vacation of Hawthorne
Road VAC:89-1 was filed with the City of
Hopkins on August 17, 1989.
2. That the Hopkins Planning Commission reviewed
such application on September 26, 1989.
3. That the Hopkins Planning Commission,
pursuant to published and mailed notices,
held a public hearing on September 26, 1989:
all persons present at the hearing were given
an opportunity to be heard.
4. That the written comments and analysis of the
^ City Staff and the Planning Commission were
considered.
NOW THEREFORE BE IT RESOLVED, that application for Vacation
of a portion of Hawthorne Road is hereby approved
subject to the following Findings of Fact:
l. That the approximately 90 feet of Hawthorne
Road is not needed by the City.
2. That the vacation of Hawthorne Road will
provide the City an opportunity to construct
a cul-de-sac at the end of Hawthorne.
BE IT FURTHER RESOLVED, that application for VAC:89-1 is
hereby approved subject to the following
Conditions:
l. That the cul-de-sac have a radius of 25 feet which
does not meet the requirements of the City Code.

ends to the north of the southerly lots.

Primary Issues to Consider.
o Is the southerly part of Hawthorne Road needed by the City?
The vacation of the southerly ends of the streets in Interlachen was
done at two other occasions. Oakwood and the west half of Maple Hill
were vacated in the past.
The south unimproved end of Hawthorne Road abutts Interlachen golf
course. Because Hawthorne Road abutts Interlachen golf course the
road cannot go further south.
The public works department has reviewed the plans and would permit
the southerly portion of Hawthorne Road to be vacated. The applicant
has revised the plans to meet the requirements of the public works
department. The public works department requires a cul-de-sac large
enough to allow the turning around of City vehicles. The other
streets that were vacated in Interlachen present a problem to the
public works department because they cannot provide good service to
the residents because there is not enough space at the end of the
^ road to turn around a truck. This application provides a good
opportunity to upgrade the street.
Alternatives.
1. Approve the vacation of Hawthorne Road. By approving the vacation
a cul-de-sac will be constructed to properly serve the lots at the end
of Hawthorne Road.
2. Deny the vacation of Hawthorne Road. By denying the vacation,
access will be limited to the undeveloped lots and make it difficult
for the City to provide adequate service to the lots once they are
developed.
3 . Continue for further information. If the Commission feels more
information is needed, the item should be continued.

RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL
OF APPLICATION VAC89-1 VACATING A PORTION OF HAWTHORNE ROAD
WHEREAS, an application for Vacating a portion of Hawthorne
Road VAC: 89-1 made by Walter Bush Jr. of 249
Hawthorne Road is hereby recommended for approval.
WHEREAS, the procedural history of the application is as
follows:
l. That an application for Vacation of Hawthorne
Road VAC:89-1 was filed with the City of
Hopkins on August 17, 1989.
2 . That the Hopkins Planning Commission reviewed
such application on September 26, 1989.
3 . That the Hopkins Planning Commission,
pursuant to published and mailed notices,
held a public hearing on September 26, 1989 :
^ all persons present at the hearing were given
an opportunity to be heard.
4. That the written comments and analysis of the
City Staff and the Planning Commission were
- considered. -
NOW THEREFORE BE IT RESOLVED, that application for Vacation
of a portion of Hawthorne Road is hereby
recommended for approval subject to the following
Findings of Fact:
l. That the southerly end of Hawthorne Road is
not needed by the City.
2 . That the vacation of Hawthorne Road will
provide the City an opportunity to construct
a cul-de-sac at the end of Hawthorne.

THE COUNCIL OF THE CITY OF HOPKINS DOES HEREBY ORDAIN AS
FOLLOWS:
That the following described thoroughfare in the following
designated area of the City of Hopkins, viz:
That part of the abandoned right-of-way of the
Minneapolis and St. Paul Suburban Railroad in the
Northwest Quarter of the Northwest Quarter of
Section 29, Township 117, Range 21, lying between
the southerly extension of the easterly line of
Lot 16, Block 10, and the westerly line of Lot 15,
Block 9, both in F. A. Savages Interlachen Park,
according to the recorded plat thereof.
