RESOLUTION NO: 05-005
RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING A CONDITIONAL USE PERMIT FOR AN OPEN STORAGE LOT
WHEREAS, an application for Conditional Use Permit CUP04-14 has been made by Warburg
StorageMart Partners LP;
WHEREAS, the procedural history of the application is as follows:
1. That an application for a conditional use permit was made by Warburg
StorageMart Partner LP, on November 26, 2004;
2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and
published notice, held a public hearing on the application and reviewed such
application on December 28, 2004: all persons present were given an opportunity
to be heard;
3. That the written comments and analysis of City staff were considered; and
4. A legal description of the subject property is as follows:
All that part of the following described land lying west of a line parallel with and
distant 836.46 feet measured at right angles from the east line of Section 25,
Township 117, Range 22:
That part of the Northwest Quarter of the Northwest Quarter of Section 25,
Township 117, Range 22, described as follows: Beginning at a point on the
northerly boundary line of the right-of-way of the Minneapolis and St. Louis
Railway Company, which point is 356 feet east of, measured at right angles from
the west line of Section 2; thence north parallel with said west line to the north
line of Section 25; thence east along the north line of said Section 25 to the
northeast comer of said Northwest Quarter of the Northwest Quarter; thence south
along the east line of the said Northwest Quarter of the Northwest Quarter, 632.4
feet more or less, to the northerly boundary line of the Minneapolis and St. Louis
Railway Company right of way; thence southwesterly along the northerly line of
said railway right-of-way line to the point of beginning.
NOW, THEREFORE, BE IT RESOLVED that the application for Conditional Use Permit
CUP04-l4 is hereby approved based on the following Findings of Fact:
1. That the storage area meets the requirements for a conditional use permit.
BE IT FURTHER RESOLVED that application for a Conditional Use Permit CUP04-14 is
hereby approved subject to the following conditions:
1. That the site plan is approved.
