Approve Pavilion Construction Contract
ProDosed Action
Staff recommends adoption of the following motion: Move that Council adopt
Resolution 2005-063 resolution for award of contract. Hopkins Pavilion Mezzanine
Proiect.
Overview
The Pavilion Mezzanine Project is a joint development project with the Hopkins School
District to accommodate a growing Hopkins Alternative Program/Off Campus Pavilion
Program and improve the space for City and community usages. The Pavilion
Mezzanine Project consists of installation of a folding panel and sheetrock wall in the
multi-purpose room, constructing a sheetrock wall and door enclosing a nook in the
office area creating a private office, cabinets installed in the office area and installation
of an under counter refrigerator and food warmer in the multi-purpose room. These
improvements were recommended in a needs assessment completed by City and
School District staff.
There were three quotes received for this work with the low quote of $43,629 coming
. from Rutledge Construction Company. Rutledge is an experienced and qualified
contractor. The City will fund the project through a loan to the Pavilion Enterprise Fund
from the Equipment Replacement Fund. The Pavilion Mezzanine lease rate to the
school district will be amended with the school district to offset the loan and loan
interest over the course of the lease. Construction will begin with the award of the
contract.
Staff recommends the award of the project to Rutledge Construction Company.

RESOLUTION FOR AWARD OF CONTRACT
HOPKINS PAVILION MEZZANINIE PROJECT
BE IT RESOLVED, by the City Council of the City of Hopkins, Minnesota that the
lowest quote of Rutledge Construction Company in the amount of $43,629 is the lowest
responsible quote for the Hopkins Pavilion Mezzanine Improvement Project, and the
Mayor and City Manager are hereby authorized and directed to enter into a contract with
Rutledge Construction Company for and on behalf of the City.
Adopted by the City Council ofthe City of Hopkins this 19th day ofJuly 2005.

Dear Sir:
Rutledge Construction Company will furnish labor, materials, tools and equipment necessary for the
timely construction and completion of this project. The construction of this facility shall be in
accordance with standard construction practices of the industry and shall be performed in a workman
like manner. The following specifications shall apply to this project.
GENERAL CONDmONS:
Des4m: Rutledge Construction Company will prepare a set of working drawings in
accordance with this outline and applicable building codes.
Pennits: Rutledge Construction Company shall obtain required building permits necessary for
the construction of this project.
Supervision: Rutledge Construction Company shall assign a Project Manager/ Superintendent
to this project who shall be responsible for the complete execution of the work.
Responsibilities include coordinating the project with City of Hopkins personnel; scheduling
and direct supervision of field forces; interfacing with building officials;. and ensuring
compliance of work with drawings.
Clean-up: Rutledge Construction Company will be responsible for construction trash and will
at all times keep the construction area free from accumulation of debris. Upon completion the
area shall be in a clean condition.

Limited Warranty: All work shall be free from defects of workmanship and materials for a
period of one year from the date of substantial completion of the work. Substantial completion
shall be defined as the date an occupancy permit is issued by the city.
Insurance: Rutledge Construction Company shall maintain Workmen's Compensation
Insurance, Comprehensive Public Liability Insurance, and Builder's Risk Insurance for this
project for the duration of the work.
Record Documents: Upon completion of the project, the Contractor shall provide the Owner
with a complete set of record documents including a complete set of record drawings, a list of
Subcontractors used on the project, manufacturer's warranties, operation and maintenance
manuals for major pieces of equipment.
Progress Schedule: The Contractor shall prepare a progress schedule for the project. This
schedule shall indicate the dates for starting and completion of the various stages of
construction, and shall be updated on a regular basis to reflect the actual progress of the work.
Temporarv Barriers: Temporary enclosures shall be constructed as necessary to limit dust and
debris to construction areas.
Claims for Concealed or Unknown Conditions: If conditions are encountered at the site which
are subsurface or otherwise concealed physical conditions which differ materially from those
indicated in the contract documents, then notice by the observing party shall be given to the
other party promptly. The owner and contractor will promptly investigate such conditions and,
if they differ and cause an increase or decrease in the Contractor's cost of any part of the work,
an equitable adjustment in the Contract Sum shall be made.
Hazardous Materials: The removal and disposal of hazardous materials, unless specifically
described, is not included in this proposal. Upon discovery of such items, contractor will not:i1Y
owner and clean up of the hazardous materials will be arranged by Change Order. Removal,
containment, and disposal of hazardous materials shall be completed by a licensed abatement
company. Hazardous Materials are considered a concealed or unknown condition and
contractor will not be penalized for construction delays due to such materials being discovered
after the date of this proposal.
Change Orders: For alterations, unforeseen conditions, or city requirements change orders may
be initiated and/or approved verbally by the owner to the project manager, superintendent, or
company president, however they shall be confirmed in writing. A summary of the change
orders and their status will appear with every billing.

Winter Conditions: Rutledge Construction has not included charges for winter conditions.
Following is a list of such conditions that would result in an additional charge. This list is not
intended to be complete, but informative of most likely charges. An additional cost could
occur for concrete material; temporary heat for concrete and masonry work including such
items as: tenting, propane, curing blankets and labor to install these items; temporary heat for
building including equipment and gas and snow removal. Generally, winter conditions start on
or about November 101.
Bi11in~!Payment Terms: All invoices are due within 15 days of invoice. Overdue invoices will
be charged 1.5 % per month service charge. Depending on the length of the project, partial
billings may occur. In the event that the owner's breach of any of the provisions of this.
contract requires the contractor to commence any legal action to enforce any of the contractual
provisions, owner agrees to pay contractor the costs of such actions, including reasonable
attorney's fees, costs, and disbursements.
Lien Notice: In compliance with Minnesota Statute (M.SA 514.011 Sub Div 2) contractors
. may file a lien on the property described above if not paid for their work within 120 days of
completion of said work. In order to protect those rights many subcontractors will send out
pre-lien notices to the owner prior to the start of their work.
Co~encies: All agreements are contingent upon strikes, accidents or delays beyond our
control.
CONSlRUCTION:
Demolition:
- Remove ceiling tile and grid as needed and save to reinstall.
Miscellaneous Metals:
- Furnish and install uni-strut material necessary to hold up door.
- This proposal includes adding steel to strengthen existing bar joists, but does not include
beams and columns if needed.
CaqJent1y:
- Remove laminate counter top and replace after wall is built.
Doors and Wmdows:
- Furnish and install one wood door with metal frame to match existing.
- Door to have a 2'x2' window.
- Key office door to match building key system.

Acoustical:
- Patch back ceiling tile and grid after door installation.
Floor Base:
- Fwnish and install new vinyl floor base to match existing.
Painting:
- Paint all new walls to match existing colors.
- Paint door frame and stain oak door.
Fire Protection:
- Relocate sprinkler heads as required.
HVAC:
- Relocate existing HV AC supply into new office.
Electrical:
- Remove 5 fluorescent fixtures from ceiling and save for owner.
- Fwnish and install seven 2' x 2' fluorescent 3-lamp fixtures to match existing.
- Relocate one fire strobelalann.
Contingency Items:
- This proposal contains an allowance of $1,500.00 as a contingency factor for items not
envisioned or noted at this time.
Total Cost of This Work Is:

- Stain, seal and varnish all cabinets to match existing doors.
