Memo - Proposed Vacations - Unimproved Alley Right of Way Public Works Department Memorandum To: Honorable Mayor and Members of the City Council Copy: Rick Getschow, City Manager coth From: Steven J, Stadler, Public Works Director Date: June 23, 2005 Subject: Proposed Vacations - Unimproved Alley Rights-of-way This worksession item is specifically in regards to the unimproved alley rights of way between 19th and 21st Avenues North and 2nd and 3rd Streets North, In November 2004 staff approached City Council about vacating several unimproved alley rights of way, Letters were sent to affected property owners informing them of the proposed vacation and requesting comments, On March 15, 2005 City Council held a public hearing on the vacation of the alley rights-of-way, Two residents spoke regarding concern with existing alley ROW encroachments and a driveway conflict. Ultimately, City Council authorized vacation of the alley ROWs along Excelsior Boulevard between Monroe and Harrison Avenues but deferred further action on the others until the property owner issues could be addressed in more detail. Since that meeting staff has completed a survey of encroachments to better quantify the concerns, Encroachments include fences, retaining walls and one garage, There is clearly no public purpose for retaining these rights of way, other than the existing overhead electrical utility lines that would remain within a utility easement. Staff would prefer that the city transfer ownership and maintenance responsibilities of these areas, The problem is in how to handle the existing encroachments, State Statute allows the city to vacate the property without regard to adjacent property owner encroachments; however, proceeding in that manner.could create property disputes between these residents, There is one resident on 21st Avenue that contends that the current condition of the right of way (steep, unstable slope) threatens their property and lowers its value, City ownership of the right of way will continue to carry city liability, potentially increasing liability, in spite of the fact that many residents are using and benefiting from the right of way, Clearly, vacation is the "cleanest" option resulting in diminishing concern regarding city liability over time, Options for proceeding include: 1, Do not proceed with vacation but deal with issues of right of way condition or setback rules as they come up, 2, Proceed with vacation after notifying affected property owners of city intent and informing them of the potential for encroachment issues with abutting property owners, 3, Send letters to property owners whose encroachments extend beyond the ROW centerline that they must be corrected within one year and then proceed with vacation, This could be costly for one owner that has a garage encroaching beyond the centerline, Staff recommends option 3, :,~ :-:;}\~~~.\:/_.
