CONDITIONAL USE PERMIT - ENTRANCE CANOPY
Proposed Action,
Staff recommends the following motion: Move to adopt Resolution 05-51. approving an
entrance canopv at 620_12th Avenue South,
At the Zoning and Planning meeting Ms, Aristy moved and Mr. Aamess seconded a motion
to adopt Resolution RZ05-14, recommending approval of an entrance canopy at 620-12'h
Avenue South, The motion was approved unanimously,
Overview,
The applicant, Finke Associates, wants to construct an entrance canopy at 620-12'h Avenue
South, The ordinance requires a 20- foot front yard setback in the I -I zoning district. The
canopy will be located six feet into the front yard setback, The ordinance allows canopies in
the setback area with a conditional use permit.
The building has one canopy into the setback area on the building, and the proposed canopy
would be a second for another entrance, Both the canopies will match,

Primary Issues to Consider.
· What is the zoning of the property, and how has the Comprehensive Plan
designated the subject site?
The subject property is zoned I-I, Industrial, The Comprehensive Plan has designated the
site as Industrial.
. What does the ordinance require?
The ordinance requires the following:
Canopies. marquees and fixed awnings, Canopies, marquees and fixed awnings are an
integral part of the structure to which they are attached, If they proj ect into the required yard
or public right-of way, a conditional use permit is required provided:
a. An awning, canopy or marquee may not project into the public right-of-way nearer
than 30 inches to the street curb or curb line;
b, Awnings, canopies or marquees may have no part of the structure other than supports
nearer the ground surface than seven feet;
c, The architectural style of the awning, canopy or marquee may be consistent with the
building being served;
d, Awnings, canopy or marquees projecting into the required yards may not be enclosed
except with a transparent material permitting through vision; and
e, Awnings, canopies or marquees built over the public right-of-way must be included
in a liability insurance policy holding the city free of all responsibility,
The proposed canopy complies with the above requirements,
. What are the specifics of the canopy?
The canopy will be 6' x II '6" and 8' 6" to the bottom ofthe roof, There will be two support
columns and a sign surface. The total height with the sign will be 12'6",
· What was the discussion at the Zoning and Planning meeting?
Ms, Anderson reviewed the proposed entrance canopy, Roger Finke, the applicant, appeared
before the Commission. Mr. Finke reviewed the proposed entrance canopies, No one
appeared at the public hearing,
Alternatives.
1. Approve the conditional use permit. By approving the conditional use permit, the
applicant will be able to construct the canopy as proposed,
2. Deny the conditional use permit. By denying the conditional use permit, the applicant

will not be able to construct the canopy as proposed, If the City Council considers this
alternative, findings will have to be identified that support this alternative,
3, Continue for further information, If the City Council indicates that further information is
needed, the item should be continued,

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A CONDITIONAL USE
PERMIT TO CONSTRUCT A CANOPY
WHEREAS, an application for Conditional Use Permit CUP05-3 has been made by Finke
Associates;
WHEREAS, the procedural history of the application is as follows:
I. That an application for a conditional use permit was made by Finke Associates,
on April 27, 2005;
2, That the Hopkins Zoning and Planning Commission, pursuant to mailed and
published notice, held a public hearing on the application and reviewed such
application on May 31,2005: all persons present were given an opportunity to be
heard;
3. That the written comments and analysis of City staffwere considered; and
4, A legal description of the subject property is as follows:
Lots 6-9, Block 56, West Minneapolis
NOW, THEREFORE, BE IT RESOLVED that the application for Conditional Use Permit
CUP05-3 is hereby approved based on the following Findings of Fact:
1. That the canopy meets the requirements for a conditional use permit.
