Approve Liquor License Applications for the License year 2005/2006
Staff recommends approval of the following motions: Move to approve the attached
Liquor License renewals for 2005/2006 along with their supporting licenses, contingent
on Police Approval, receiving certificates of insurance, and payment of all fees; and
Move to approve the extended service areas for Lindee's Saloon and Eatery, the Hopkins
VFW, Tavern on the Main, Camille's Sidewalk Cafe, and Tuttle's Hopkins Bowl to be
effective immediately with the conditions as outlined by staff .
This action will allow the applications to be processed and mailed to Liquor Control for
approval and issuance as the insurance companies release certificates of insurance. The
second motion will allow those establishments that wish to serve in outdoor areas to
begin doing so immediately.
Overview
As of this date, all liquor license renewal applications are in except for Jack Yee's
Restaurant.
The Hopkins Police Department has reviewed most of the applications.
Typically, the insurance companies fax the certificates of insurance directly to the office.
Sometimes they are slow about faxing them. Others will not fax the certificate until all
premiums are paid. They are always here in time to certify or send to the State Liquor
Control.

Primary Issues to Consider
. Changes in the past year
There are some changes that have taken place since the last license renewals. Those
changes are as follows:
Best Buy Liquor Warehouse was sold and is being operated under new owners
China Royal Restaurant has been sold. The restaurant is currently closed for
remodeling_ The new owners are not intending to serve wine and beer.
Munkabean's will not be renewing their liquor license.
Hopkins Best Steak House has closed. At this time, no one has requested a
license to operate as a restaurant at that location.
Because of these changes, the City will issue two fewer wine licenses and three fewer
3.2 beer on sale licenses this year.
. Extended service areas to outdoor areas
Because of the recent smoking ban in bars and restaurants in Hennepin County, several
licensees have requested outdoor areas where liquor can be served.
The following two paragraphs are from State Statute defining licensed areas:
Subd. 15. Licensed premises_ "Licensed premises" is the premises described in the approved license
application, subject to the provisions of section 340A.410, subdivision 7. In the case of a restaurant. club, or
exclusive liquor store licensed for on-sales of alcoholic beverages and located on a golf course, "licensed
premises" means the entire golf course except for areas where motor vehicles are regularly parked or operated.
Subd. 7. License limited to space specified. A licensing authority may issue a retaii alcoholic beverage
license only for a space that is compact and contiguous. A retail alcoholic beverage license is only effective for
the licensed premises specified in the approved license application.
The City Council may extend the service area to any structure that is "connected" to the
business that the license was granted to. The structure may be a concrete slab or
sidewalk, an erected fence, or an erected deck. All of the licensees that are requesting
extended service areas have submitted a diagram of the areas.
Staff is recommending that two conditions be placed on any outdoor service areas. The
two conditions are: 1} the area must be cordoned off with a fence or rope, and 2} the
licensee must provide a staff person that will stay in the outdoor area to monitor the
area at all times when alcohol is being served or consumed in that area with the
exception of Tavern on Mainstreet. They have constructed a walled area with an exit
that requires the bartender to hit a switch to open the exit and the bartender can view
the area at all times. Staff recommends that they not be required to have a staff person
in the outdoor area.
The City is allowed to issue ten on-sale liquor licenses. With this action, the City is
issuing six on-sale liquor licenses.
There is not limit on off-sale licenses, on-sale wine or 3.2 beer.
Alternatives
1. Approve the liquor license renewals and supporting licenses and the extended service
areas.
2_ Approve the liquor license renewals and some extended service areas.
3. Approve the liquor license renewals and none of the extended service areas.
4. Deny the liquor license renewals.
Staff recommends alternative one.
