CR 05-037 Vacation of Alleys and Goodrich CITY OF m HOPKINS March 10, 2005 Council Report 2005-037 Public Hearing Vacation of Various Unimproved Alley Rights of Way and Vacation of portion of Goodrich Street Right of Way Proposed Action. Staff recommends adoption of the following motion: Move that Council adopt Resolution 2005-025 Resolution to vacate various unimproved allev riqhts of way. as described and shown bv staff. and the vacation of a portion of the Goodrich Street Riqht of Way. Overview. There is resident interest in the vacations of certain unimproved alley rights of way and the vacation of a portion of the 80' wide Goodrich Street right of way. Staff has discussed these vacations with City Council at worksession; sent preliminary letters to affected property owners, (except the owners affected by the Goodrich Street ROW partial vacation), published the public hearing notice and sent notice of the public hearing to all affected property owners and public utility companies. Minnesota State Statutes allow cities to vacate public rights of way when they have determined it to be in the best interest of the public. In accordance with City Charter and Minnesota State Statutes the vacations are accompli!?hed by resolution and ordinance after a public hearing is held. If City Council proceeds with the vacation by approving the proposed resolution, a second reading of the vacation ordinance will be held on April 5. If approved, the vacation resolution will be recorded at Hennepin County and become effective. Public comments received are summarized in the report. Resident comments and concerns Staff has not heard many comments regarding the unimproved alley vacations. The owner at 10 Van Buren Avenue South is opposed to the proposed vacation. She does not want to own or maintain the additional property. The owners at 205 20th Avenue North are concerned as at least part of their current driveway is on what will be their neighbor's property if the vacation is approved. By State Statute, an abutting property owner who suffers specific and unique damages as the result of vacating a street or alley may be entitled to damages, but no damages are awarded if the vacation merely requires the property owner to travel a farther route to access his property or over an inferior road. If City Council decides this owner does suffer damages and desires to proceed with the vacation, it may consider a damage award. Some property owners are in favor because the additional private property created by the vacation wlll give them the ability to better protect or buffer their property from abutting land uses. Staff took many calls regarding the Goodrich Street partial right of way vacation. What follows is a summary of the concerns expressed from those homeowners. The 10' vacation will mean there may be boulevard trees currently maintained by the city that would become private trees for homeowners to maintain. Staff has not determined the number or species of trees that fall within the proposed area to be vacated. However, there are elm trees along this corridor and at least one that is currently marked for removal. Given the number of tree removals this past year due to disease, it's understandable that this is a concern of homeowners. If City Council decides these trees cause the abutting property owners damage, one remedy could be that the city would continue to maintain these trees for a period of time, say until January 1, 2007. The 80' wide right of way js an historical part of what creates the Interlachen neighborhood character and should be protected. A few homeowners were concerned about the impact on property values and taxes. Staff referred this question to our residential appraiser, Rob Winge. His opinion is that the additional 10' wide strip of land will not affect values as market values are primarily based on sales of similar residential properties, not specific lot size or lot dimensions. . Vacation Schedule April 5: Second Reading, Vacation Ordinance April 20: Date of Publication April 20: Date vacation ordinance takes effect CITY OF HOPKINS HENNEPIN COUNTY MINNESOTA RESOLUTION NO. 2005-025 RESOLUTION FOR VACATING A PARTIAL STREET RIGHT OF WAY AND SEVERAL UNIMPROVED ALLEY RIGHTS OF WAY BE IT RESOLVED BY THE CITY COUNCIL OF HOPKINS, MINNESOTA, WHEREAS, the City Council of Hopkins has determined to vacate all or portions of several street or alley rights of way (described below); AND WHEREAS, a public hearing was held on March 15, 2005 before the City Council in the city hall after due published and posted notice had been given by the clerk, a reasonable attempt was made to give personal notice to all affected property owners, and all persons interested were given an opportunity to be heard; AND WHEREAS, any person, corporation or city owning or controlling easements contained upon the property vacated, reserves the right to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove or otherwise attend thereto; AND WHEREAS, any public utility with existing facilities within the vacated rights of way reserves the right to obtain easements equal in area to the right of way vacated and to enter upon such way or portion thereof vacated to maintain, repair, replace remove or otherwise attend thereto; AND WHEREAS, the City Council has adopted ordinance 2005-946, ordinance vacating various street and alley rights of way; AND WHEREAS, it appears that it will be in the best interest of the city to vacate such street and alley rights of way; AND WHEREAS, four-fifths of all members of the City Council concur in this resolution; NOW, THEREFORE, BE IT RESOLVED, that the following unimproved alley public rights of way and partial street right of way are hereby vacated: . In this case, the city is considering abandoning a 10' portion on the north and south side of the existing 80' wide Goodrich Street public right-of-way; the resulting right-of- way would then be 60' wide. If your property abuts Goodrich and City Council approves the vacation, you would own an additional 1 0' strip of land. The city really doesn't need an 80' wide ROW (most city ROWs are 50' - 66' wide for local roads) and the wide ROW can prevent certain property improvements such as home or garage additions because the homeowner can't meet the setback criteria from the property line.
