CR 05-068 Adopt Assessment Roll-street proj C iT Y O/, May 17, 2005 m NOPKiNS Council Report 2005-068 ADOPT ASSESSMENT ROLL AND A WARD OF BID 2005 STREET AND UTILITY IMPROVEMENT PROJECT AND LOT 800 RECONSTRUCTION CITY PROJECTS 04-10 & 04-11 Proposed Action Staff recommends the following motion; "Move that Council adopt Resolution 2005-047, Resolution AdOPting Assessment Roll. 2005 Street and Utility Improvement Proiect. City Proiect 04-10 and Resolution 2005-048, Resolution for Award of Bid, 2005 Street and Utility Improvement Proiect and Lot 800 Reconstruction, City Proiects 04-10 & 04-11." This action continues an assessable project for street upgrading and a non-assessable parking lot improvement. Overview The bid opening for the 2005 Street and Utility Improvement Project and Lot 800 Reconstruction was held on April 12, 2005. The low bid was $954,510.18, which is 14% below the final engineer's estimate. In all, 5 bids were opened indicating a competitive construction market. Assessment calculations were prepared based on the low bid submitted by Northwest Asphalt Inc. At its April 19, 2005, meeting, the Hopkins City Council accepted the bids and considered the assessment roll for the street improvements on Madison Circle, Madison Avenue N, Monroe Avenue N, Monroe Place, Jackson Avenue N, Sunnyside Lane, Van Buren Avenue N, and Shadyside Circle. At that same meeting, the Council ordered an assessment hearing for the project to be held May 17, 2005. This assessment hearing sets in motion levying of assessments against benefiting properties. A public hearing notice has been published and mailed, along with an assessment statement to every affected property owner. As of this writing, no written objection contesting the proposed assessments has been submitted, Written objections to Council must be submitted no later than the hearing date. Appeal procedure: Property owners are given the opportunity to approach Council with their objections to the proposed assessments during the public hearing. Standard fonns for written objections have been available at City Hall and need to be submitted no later than the hearing date. . Project costs and assessments: Based on the low bid, 25% overhead costs (engineering, admin, legal), and a 10% construction contingency the total estimated project cost is $1,288,588.74, The assessable amount is calculated based on 70% of the assessable roadway costs of$760,471.07. The total amount to be assessed on this project is $478,766.75. Staff recommends applying an annual interest rate of 7% to this assessment. This interest rate was set in 2002 and is scheduled to be reviewed every 3 years. The following table shows the anticipated assessment rate for each segment. The proposed rates shown in the table above were used to calculate the total assessment rate of$I,208.07 per interior unit. This is approximately $760 less than the preliminary assessments, . Water Services The homeowner cost for the water service replacements will be $24 per foot of service pipe plus $647 for the curb stop & box. This is approximately $150 more than the preliminary estimate. Final amounts for each resident have been calculated and included in the final assessment role. Council Report 2003-43 Page 3 The project is proposed to be funded through a number of sources beyond special assessments. Northwest Asphalt, Inc. is a reputable and responsible contractor and has completed similar projects within the metro area. Sometimes staff will recommend waiting with the award of a contract until the 30 day filing period for appeals has expired. In this instance, due to the extremely good bids the City received, and because limited appeals are anticipated, staff is recommending award of the project contract to Northwest Asphalt, Inc. at this time unless any significant and unforeseen appeals are submitted at the Council meeting. . Project Schedule: Assessment Hearing May 17,2005 Award Contract May 17, 2005 Residential Construction Begins June 2005 Lot 800 Construction Begins July 18, 2005 Construction Ends October 2005 CITY OF HOPKINS HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 2005-047 RESOLUTION ADOPTING ASSESSMENT ROLL 2005 STREET AND UTILITY IMPROVEMENT PROJECT CITY PROJECT 04-10 WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for the improvement of Madison Circle, Madison Avenue N, Monroe Avenue N, Monroe Place, Jackson Avenue N, Sunnyside Lane, Van Buren Avenue N, and Shadyside Circle, as described in the files of the City Clerk as Project 04-10. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hopkins, Minnesota: 1. Such proposed assessment, as may be amended and a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it 2. Such assessment shall be payable in equal annual installments extending over a period of ten years, the first of the installments to be payable on or after the first Monday in January 2007, and shall bear interest at the rate of 7 percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from May 17, 2005, until December 31, 2006. To each subsequent installment when due shall be added interest from one year on all unpaid installments. 3. It is hereby declared to be the intention of the Council to reimburse itself in the future for the portion of the cost of this improvement paid for from municipal funds by levying additional assessments, on notice and hearing as provided for the assessments herein made, upon any properties abutting on the improvement but not made, upon any properties abutting the improvement but not herein assessed for the improvement, when changed conditions relating to such properties make such assessment feasible. 4. To the extent that this improvement benefits non-abutting properties which may be served by the improvement when one or more later extensions or improvements are made, but which are not herein assessed, therefore, it is hereby declared to be the intention of the Council, as authorized by Minnesota Statutes Section 420.051, to reimburse the city by adding any portion of the cost so paid to the assessments levied for any of such later extension or improvements. 5. The clerk shall forthwith transmit a certified duplicate of the assessment to the County Auditor to be extended on the property tax lists of the County, and such assessments shall be collected and paid over in the same manner as other municipal taxes. As described in my February 7, 2005 letter; your final costs for water service rep!acement are based on the length of water service pipe, the unit prices and curb stop and pipe connection prices used by the contractor that submitted the lowest overall contract bid. Northwest Asphalt submitted the lowest overall bid. Northwest Asphalt's water service replacement prices were $24/foot and $647 for curb stop and pipe connections. My estimate for this work was $25/foot and $400 for curb stop and pipe connections. As a result, the final costs are about $150 more than I estimated. Example: If you live on the south side of Shadyside Circle, the estimated homeowner cost for water service replacement was $600. This was based on an estimated 20' service pipe length x $25/foot + $400 (curb stop replacement) minus the 1/3 city contribution toward the cost = $600 total homeowner cost. The actual homeowner cost for the same property is 20' x $24/foot + $647 (contractor prices) minus the 1/3 city contribution = $751 (see backside of this letter for spreadsheet showing estimated costs from 'my February 7 letter and the actual costs based on contractor's bid prices). Accordingly, the actual cost for your water service replacement has been added to your street assessment amount and is shown separately on the enclosed assessment notice. Specifically, for the 30 interior units being assessed for the 2005 street improvements, the assessment amount dropped from the preliminary amount of $1 ,968.69 to a final amount of $1 ,208.07. For the 12 units fronting directly on Van Buren Avenue the assessment amount dropped from $2,276.64 to $1,697.40. For the two units fronting directly on Jackson Avenue the assessment amount dropped from $2,144.16 to $ 1,420.20. The reasons for the decreased assessments are: 1) at the March 8 City Council Worksession, City Council approved use of an assessment cap in determining the per unit assessment for each of the Regency neighborhood properties, thus the city assessment policy was applied the same for all residential properties within this project area, regardless of Regency's unique PUD zoning designation; and 2) the construction cost based on the low bid received is less than estimated costs - the result is that Jackson Avenue and Van Buren Avenue assessment rates were reduced by 30% and 15.5%, respectively.
