WAIVER OF PLAT - 250 INTERLACHEN ROAD
Proposed Action.
Staff recommends the following motion: Move to adopt Resolution 05-45. approving of a
waiver of plat at 250 Interlachen Road.
At the Zoning and Planning meeting Ms. Aristy moved and Mr, Sholtz seconded a motion to
adopt Resolution RZ05-7, recommending approval of a waiver of plat at 250 Interlachen Road,
The motion was approved unanimously.
Overview.
Greg Narr is proposing to divide the lot at 250 Interlachen Road, Mr. Narr owns the vacant lot
south of 250 Interlachen Road and 250 Interlachen Road and wants to add more property to the
vacant lot to make it buildable. Because the division is a single line, the applicant can do a
waiver of plat.
When a house footprint is decided upon there is an issue with the south property line, The City
has a 20-foot utility easement. The problem is that the utility is on the north side of the
easement. In talking with the City Engineer he would like 10 extra feet, but is willing to settle
for 7.5. Mr. Narr would like a lO-foot front yard variance. If in the future Mr. Narr requests a
front yard variance, staff would support a variance for the additional setback from the easement.

Primarv Issues to Consider.
· Do the new lots meet the zoning requirements?
The zoning of the property is R-I-C, Medium Density Single Family. The minimum lot
size is 12,000 square feet. The ordinance also requires that all lots have 35 feet of
frontage on an improved right-of-way. Interlachen Road will have to be improved
approximately 18 feet to the south.
· Do the new lots meet the requirements for a waiver of plat?
The following are the waiver of plat requirements:
a. the lot(s) involved in the proposed division are platted
b. the division required is substantially a single line
c. that the division will not create more than one additional lot
d. that the division will not require the dedication of a public right-of-way or extension
of utilities in a public right-of-way
e. that the new lots created conform to all standards of the appropriate district
The proposed lots meet the above requirements,
· Is a park dedication fee required?
A park dedication fee is not required because a new lot is not created.
· What was the discussion at the Zoning and Planning meeting?
Ms. Anderson reviewed the waiver of plat. Greg Narr, the applicant, appeared before the
Commission. Mr. Narr noted that once a floor plan has been decided on for a home he
will probably request a front yard setback variance because of the additional setback from
the utility easement. The Commission discussed the easement to the south and the
construction ofthe road.
Alternatives.
I, Approve the waiver of plat. By approving the waiver of plat, the applicant will be able to
construct a home on the vacant lot.
2. Deny the waiver of plat. By denying the waiver of plat, the applicant will not be able to
build on the lot without receiving variances. If the City Council considers this
alternative, findings will have to be identified that support this alternative.
3. Continue for further information. If the City Council indicates that further information is
needed, the item should be continued.

RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING A WAIVER OF PLAT
WHEREAS, an application for Waiver of Plat WVR05-1 has been made by Greg Narr;
and
WHEREAS, the procedural history of the application is as follows:
1. That an application for Waiver of Plat WVR05-1 was made by Greg Narr
on February 28,2005;
2. That the Hopkins Zoning and Planning Commission, pursuant to mailed
notice, held a meeting on the application and reviewed such application on
April 26, 2005: all persons present were given an opportunity to be heard;
3. That the written comments and analysis of the City staff were considered;
and
4. Legal descriptions ofthe parcels are as follows:
NORTHERLY PARCEL
Lots 18, 19,20, and that part of Lot 17, Block 13, and of vacated street adjoining,
"FA SAVAGE'S INTERLACHEN PARK" which lies Northerly of a line
running from a point on the East line of said Lot 17 distant 35.00 feet North of the
Southeast comer of said vacated street to appoint in the west line of said vacated
street distant 20.00 feet North of the Southwest comer of said vacated street.
SOUTHERLY PARCEL
That part of lot 17, Block 13, and of vacated street adjoining "FA SA V AGE'S
INTERLACHEN PARK" which lies southerly of a line running from a point on
the East line of said Lot 17 distant 35.00 feet North of the Southeast comer of said
vacated street to a point on the West line of said vacated street distant 20.00 feet
North of the Southwest comer of said vacated street, and that part of the North
75.00 feet of the NE Y. of the NE Y. of Section 30, Township 117, Range 21 lying
between the Easterly and Westerly boundary lines extended Southerly of Lot 17,
Block 13, "FA SAVAGE'S INTERLACHEN PARK".
NOW, THEREFORE, BE IT RESOLVED that application for Waiver of Plat WVR05-1
is hereby approved, based on the following Findings of Fact:

I. That the lots meet the requirements for a waiver of plat.
BE IT FURTHER RESOLVED that application for Waiver of Plat WVR05-1 is
hereby approved based on the following conditions:
1. That Hennepin County accepts the waiver of plat.
2. That Interlachen Road is extended and improved to the required 35 feet of
frontage for the southerly lot to the City's specifications.
