Vacation of Unimproved Alley Rights of Way
Proposed Action.
Staff recommends adoption of the following motion: Move that Council adopt Resolution
2005-032 Resolution to vacate various unimproved allev riqhts of wav and approve
Ordinance No. 2005-948 for first readinq,
Overview.
At the April 13 City Council Work session, Council decided to proceed at this time with
vacating only the unimproved alley segments created as a result of the Excelsior Boulevard,
Phase II reconstruction. Namely, the east-west alley segments located just south of
Excelsior Boulevard and between Monroe Avenue and Harrison Avenue. On March 15,2005
City Council held the required public hearing on the vacation of several alley rights-of-way,
including these alley segments, and a portion of the Goodrich Street right-of-way. The work
to identify and describe existing encroachments along the proposed unimproved alley ROWs
between 19th Ave N and 21st Ave N and 2nd St Nand 3rd St N. is nearly completed. Staff will
schedule discussion on potential vacation of these unimproved alley ROWs for an upcoming
work session.

RESOLUTION FOR VACATING SEVERAL UNIMPROVED ALLEY RIGHTS OF
WAY
BE IT RESOLVED BY THE CITY COUNCIL OF HOPKINS, MINNESOTA,
WHEREAS, the City Council of Hopkins has determined to vacate all or portions
of several alley rights of way (described below);
AND WHEREAS, a public hearing was held on March 15, 2005 before the City
Council in the city hall after due published and posted notice had been given by
the clerk, a reasonable attempt was made to give personal notice to all affected
property owners, and all persons interested were given an opportunity to be
heard;
AND WHEREAS, any person, co"rporation or city owning or controlling
easements contained upon the property vacated, reserves the right to continue
maintaining the same or to enter upon such way or portion thereof vacated to
maintain, repair, replace, remove or otherwise attend thereto;
AND WHEREAS, the City of Hopkins reserves public utility easements over the
vacated rights-of-way to enter upon such easement area to maintain, repair,
replace, remove, install or otherwise attend to public utilities;
AND WHEREAS, the City Council has adopted ordinance 2005-948, ordinance
vacating various alley rights of way;
AND WHEREAS, it appears that it will be in the best interest of the city to vacate
such alley rights of way;
AND WHEREAS, four-fifths of all members of the City Council concur in this
resolution;
NOW, THEREFORE, BE IT RESOLVED, that the following unimproved alley
public rights of way are hereby vacated:
The alley right-of-way segments located between Monroe Avenue South and
Harrison Avenue South and between 1st Street South and Excelsior Boulevard as
shown and described on the attached exhibits.

NARRATIVE
KEY GROWTH INDICATORS
The most wearing hurdie we have faced this year is a drop in earned income - ticket income for our concert
series is well below the anticipated level, art sales are down and for a while it seemed like memberships would
also flag. Whiie memberships are once again climbing if modestiy, low ticket income has created a cash flow
chalienge this spring. We had thought we had programmed the season so that we had sure-fire money-makers
loaded at the front end to help cash flow the year. But, outside of the Michael Johnson concert, ali the fall con-
certs either broke even or lost money - there was nothing to carry forward. This, aiong with the ups and downs
of contributed support, points to our need to build a second line of earned income.
We welcomed 3 new event sponsors during second and third quarters - Shurgard Self Storage is a sponsor of
The Edge, UBS Financiai Services has become a long-term partner, and Wealth Enhancement sponsored Tri-
ple Play, the Chris Brubeck Trio,

We picked up two new community partners this period and see potential in this area, We received a MRAC grant
that enabled us to hire a marketing intern to specifically work on community partnerships, group sales and elec-
tronic communicationslsales for next season over the spring and summer. We also have a short-term intem working
on marketing a Golden Strings concert in May which should be a money maker for us.
COMMUNITY PARTICIPATION
The only program to grow in audience participation this year has been The Edge. We are looking at ways to in-
crease our presence in the community beyond the programs we offer at the Center this summer. We will again pre-
sent a free public concert in Downtown Park this June. The Center will have a float in the Raspberry Parade this
year Ooint project of the Center partners). Our visual artists will have a booth at the Hopkins Farmer's Market. We
are exploring other ideas as well.
PROGRAMMING
Our visual arts program continues to mature. HCA, Inc. only had 2 visual arts exhibitions in second quarter as the
school district and Stages both had exhibition time reserved- Painting Without Paint, a show of conceptual art pre-
sented as part of a regional conference orchestrated by the UofM, and a show by Center volunteers which included
a reception honoring all HCA, Inc. volunteers. In third quarter we held our biennial Postal Impressions show which
is open to anyone who wishes to participate. We also hosted the Twin Cities Undergraduate Showcase, a show we
created to explore the range of work being done by young artists. We had a good response for the first year- par-
ticipants included the UofM, MCAD, College of Visual Arts, Augsburg College, Metropolitan State University,
Macalester College, College of St. Catherine, Northwestem University and Concordia College, Currently our mem-
bers nonjuried show is up with over 90 artists participating, our largest group to date.
In third quarter we revised our performing arts schedule for next year, taking film and Edge to festival-style formats.
We are also exploring fee-based summer programs that can generate earned income. And we are looking at ex-
panding partnerships with other organizations so that we are able to offer diverse programming without overextend-
ing our financial or human resources.
FINANCE & ADMINISTRATION
An ongoing project has been to get a webstore up and running. At this point it is in place except for a user-friendly
way to handle season subscriptions. We will have the webstore active by the time we announce our next season in
May. Our marketing committee is also looking at more effective use of e-mail communications and how to leverage
advertising impact by getting people onto our website through ticket give-aways and other promotions.
We are also revamping our communications plan for next season going with a season brochure including all our
programs with a pull-out calendar and then augmenting this with regular postcard and e-mail updates.
LOOKING AHEAD-FOURTH QUARTER 04-05:
Projects for fourth quarter include:
. Kick-off our 05/06 concert season on May 14
. Prepare our season brochure and sell ads to cover the cost (halfway to goal with ad sales at this time)
. Pilot 112 day events for young children in the visual arts
. Hold a well-attended Mainstreet Jazz event on June 19
. With the help of interns, work on marketing for next season
