Proposed Action.
Staff recommends adoption of the following motion: Move that Council adopt Resolution 2005-
095. Resolution for Adoption of Assessment Roll. 2005 Miscellaneous Special Assessments.
Overview.
The proposed special assessments as described in Exhibit A are for delinquent utility bills,
citations, and invoices. Notices of this hearing have been published, and both notices and
assessment statements have been mailed to all affected property owners.

Refer to attached Exhibit A. Property owners who have paid their proposed assessment
between the time of notification and the Assessment Hearing date have been deleted from
the assessment roll.
. Appeal process
If residents have not waived their rights to appeal, they are given the opportunity to
approach Council during the public hearing. Standard appeal forms have been available
at City Hall and need to be submitted no later than the public assessment hearing date.
Should there be appeals presented to Council during the public hearing, Council may
continue the hearing to the following Council meeting to allow staff to examine the
appeals and make a recommendation. This would still meet the statutory requirement of
allowing the 30-day interest free period for payments prior to certification on November
30,2005.

RESOLUTION NO. 2005-095
ADOPTION OF THE ASSESSMENT ROLL
2005 MISCELLANEOUS SPECIAL ASSESSMENTS
WHEREAS, pursuant to proper notice duly given as required by law, the City Council
has met and heard and passed upon all objections to the proposed assessment for delinquent
utility bills, citations, and delinquent invoices, all as more fully set forth and described in Exhibit
A as attached to this resolution, and has amended such proposed assessment as it deems just,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HOPKINS,
MINNESOTA:
1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is
hereby accepted and shall constitute the special assessment against the lands named therein, and
each tract ofland therein included is hereby found to be benefited by the proposed improvement
in the amount of the assessment levied against it.
2. Such assessments shall be payable in equal, annual installments extending over the
periods of years set forth in Exhibit A, the first ofthe installments to be payable on or after the
first Monday in January of2006. Any deferred installments shall bear interest at the rate set
forth in said Exhibit A from the date of the adoption ofthis assessment resolution. To the first
installment shall be added interest on the entire assessment from October 4, 2005, until
December 31, 2006. To each subsequent installment when due shall be added interest for one
year on all unpaid installments.
3. The owner of any property so assessed may, at any time prior to certification of the
assessment to the county auditor, pay the whole or a partial payment of at least 25% of the
assessment on such property, with interest accrued to the date of payment, to the city treasurer,
except that no interest shall be charged ifthe entire assessment is paid within 30 days from the
adoption of this resolution; and he may, at any time thereafter, pay to the city treasurer the entire
amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in
which such payment is made. Such payment must be made prior to November 15 or interest will
be charged through December 31 of the next succeeding year.
4. The clerk shall forthwith transmit a certified duplicate of this assessment to the county
auditor to be extended on the property tax lists of the county. Such assessments shall be
collected and paid over in the same manner as other municipal taxes.
5. It is hereby declared to be the intention ofthe Council to reimburse itself in the future for
the portion of the cost of this improvement paid for from municipal funds by levying additional
assessments, on notice and hearing as provided for the assessments herein made, upon any
properties abutting on the improvement but not made, upon any properties abutting on the
improvement but not herein assessed for the improvement, when changed conditions relating to
such properties make such assessment feasible.
6. To the extent that this improvement benefits nonabutting properties which may be served
by the improvement when one or more later extensions or improvements are made, but which are
not herein assessed, therefore, it is hereby declared to be the intention of the Council, as
authorized by Minnesota Statutes Section 420.051, to reimburse the City by adding any portion
of the cost so paid to the assessments levied for any of such later extension or improvements.
7. The clerk shall forthwith transmit a certified duplicate of this assessment to the County
Auditor to be extended on the property tax lists of the County, and such assessments shall be
collected and paid over in the same manner as other municipal taxes.

NOTICE OF ASSESSMENT HEARING
NOTICE IS HEREBY GIVEN that the City Council of Hopkins, Minnesota, will meet in
the Council Chambers of the Hopkins City Hall, 1010 1st Street South, Hopkins, Minnesota at
7:30 p.m. on Tuesday, October 4,2005, to pass upon the proposed special assessments for the
costs of delinquent utility bills, for delinquent invoices, and for delinquent citations. Please see
the enclosed Statement of Assessment for vour propertY.
Except for petitioners who have waived their right to notice or objection, all persons who
wish to be heard, or to object with reference to this matter may present their cases at this hearing
either orally or in writing. No appeal may be taken as to the amount of any assessment adopted
unless a written objection signed by the property owner is filed with the Special Assessment
Clerk prior to the assessment hearing or presented to the presiding officer at the hearing. Even
though appeals are due by the hearing date on October 4, 2005, the City Clerk strongly
recommends that appeals be submitted to the Special Assessment Clerk's office by September 30,
2005. Appeal forms will be available at the assessment hearing or at the Special Assessment
Clerk's office at the Hopkins City Hall, 1010 1 st Street South, Hopkins, Minnesota.
An owner may appeal an assessment to district court pursuant to MSA Section 429.081
by serving notice of the appeal upon the Mayor or City Clerk of the City of Hopkins within thirty
(30) days after the adoption of the assessment and by filing such notice with the district court
within ten (10) days after service upon the Mayor and City Clerk.
Under provisions of Minnesota Statutes Section 435.193 to 435.195 the City may, at its
discretion, defer the payment of assessments for any homestead property owned by a person 65
years of age or older for whom it would be a hardship to make the payments. The procedures to
apply for such deferment are available from the Special Assessment Clerk. Deferment
applications should be submitted to the Special Assessment Clerk by September 30,2005.
The following information shall also apply:
1. The property owner shall have the right to prepay the entire assessment. Your
assessment mav be paid withont interest from October 4. 2005 to November 3. 2005. to the
Special Assessment Clerk at City Hall, 1010 1st Street South, Hopkins, Minnesota. You may at
any time thereafter and prior to November 30, 2005 pay to the Special Assessment Clerk the
entire amount of the assessment remaining unpaid, with interest accrued from October 4,2005 to
the date in which such payment is made. Such payment must be made prior to November 30,
2005 or interest will be charged through December 31 of the succeeding year.
2. Partial prepayment of the assessment in excess of25 percent of the total
assessment has been authorized by ordinance. A partial prepayment can only be made prior to
November 30, 2005 with interest accmed to the payment date, except that no interest shall be
charged on said partial payment if such partial payment is made by November 3, 2005.
3. In the case where accmed interest applies, the rate of interest to be accmed, if the
assessment is not prepaid within the required time period, is proposed to be 7 percent
commencing on the date of adoption by the City Council. Assessments shall be payable in one
annual installment.
4. The amount to be specially assessed against your property is shown on the
enclosed Statement of Assessment.
5. A $50,00 service charge has been added to the amount to be assessed for all
delinquent bills.
This is an important hearing because this is your last opportunity to be heard on the
matter of this assessment, which affects your property. If you have any questions regarding this
assessment, please call the Special Assessment Clerk at 952-548-6310.

INFORMATION ON SPECIAL ASSESSMENTS
HOW ARE SPECIAL ASSESSMENTS PAID?
1. If the assessment is not paid prior to November 30, 2005, it will automatically be included
with the real estate taxes payable in 2006. The actual terms of financing are set by the City
Council at the Public Hearing. The interest rate is proposed to be 7%.
2. The assessment can be paid off in full or in part (at least 25%) to avoid the interest charges or
to keep them as low as possible, the procedure and deadline for payments will be as follows:
October 4. 2005 to November 3. 2005 (assuminl! adoption on October 4. 2005) - 30 dav
interest free.
During this period, the owner may pay all or part of the total, interest free.
Partial payments must be at least 25% of the assessment.
November 4. 2005 throul!h November 29. 2005 - interest accrues from date of adoption.
After the 30-day period, the total may be paid with interest prorated from
the date of adoption to the date of payment, until November 29,2005.
Partial payments of at least 25% are still accepted, although interest charges
will apply to the payment.
November 30. 2005 - assessments are certified to Hennepin County.
Payments can no longer accepted by the City of Hopkins.
On November 30, 2005, the assessment is certified to Hennepin County for
collection with the property taxes payable in 2006.
15 months of interest is added to the miscellaneous assessments certified to
the property taxes payable in 2006.
NOTE: Pursuant to State Statutes, the City is required to follow the procedure and deadlines
listed above.
SPECIAL ASSESSMENT DEFERMENTS
The City Council may in its discretion defer payment of special assessments upon request. The property
must be homesteaded by the property owner. Also the property owner must be 65 years of age or older
or retired by virtue of a permanent and total disability. The income is not to exceed $30,105 as of
January 1, 2005. Income verification is required. Application for deferment must be made no later than
the hearing date.

Possible Appeal for property at 1201~ 1203 Oxford Street,

Assessment is $450.00 issued to Robert Samaroo, previous property owner. We waived
the assessment service charge of$50 for each citation, $150 total, because there is a new
property owner. We also voided a fourth citation in the amount of $200.00 because it
was issued a few days after the property was sold.
Robert Samaroo was issued three citations ($1150 total) and has a remaining balance of
$450.00. The citatious were issued for failure to remove brush, litter, garbage, and open
storage, and for failure to remove and replace broken windows, failure to repair gutter,
failure to install backflow preventer on hose spigot, failure to repair front storm door.
This case was initiated by a complaint that was received on January 18,2005. The
complainant stated there was junk at the property, a broken handrail, the front door
slamming in the wind, there is garbage by driveway, garage in bad shape, and there is
storage of brush behind garage. All of these were valid and found to be true complaints.
Our office notified the owner of the violations and gave him a first notice and then a final
notice. He was then issued four citations. Several re-inspections were made. On March
21,2005 Mr. Samaroo contacted our office (after the second citation was issued). I
transferred him to Terry Obermaier, City Clerk, to request an appeal, but he did not
request an appeal; he made a partial payment.
Robert Samaroo sold the property in June without bringing the property into compliance
and without fully notifYing the new property owner of the outstanding orders.
This property has been brought into compliance by the new owner, Gary Speese. The
outstanding orders at the property when he sold it were: to scrape / paint garage;
remove/repair fence (gates were falling off and there were missing slats); missing screens
for the windows and doors; open storage - overflowing garbage; litter, deteriorating
driveway, tall weeds, broken basement window.
I would recommend that the assessment be imposed because of the amount of staff time
spent on this case and the non-compliance of Robert Samaroo.

RESOLUTION NO. 2005-095
ADOPTION OF THE ASSESSMENT ROLL
2005 MISCELLANEOUS SPECIAL ASSESSMENTS
WHEREAS, pursuant to proper notice duly given as required by law, the City Council
has met and heard and passed upon all objections to the proposed assessment for delinquent
utility bills, citations, and delinquent invoices, all as more fully set forth and described in Exhibit
A as attached to this resolution, and has amended such proposed assessment as it deems just,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HOPKINS,
MINNESOTA:
1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is
hereby accepted and shall constitute the special assessment against the lands named therein, and
each tract ofland therein included is hereby found to be benefited by the proposed improvement
in the amount of the assessment levied against it.
2. Such assessments shall be payable in equal, annual installments extending over the
periods of years set forth in Exhibit A, the first of the installments to be payable on or after the
first Monday in January of2006. Any deferred installments shall bear interest at the rate set
forth in said Exhibit A from the date of the adoption of this assessment resolution. To the first
installment shall be added interest on the entire assessment from October 4, 2005, until
December 31, 2006. To each subsequent installment when due shall be added interest for one
year on all unpaid installments.
3. The owner of any property so assessed may, at any time prior to certification of the
assessment to the county auditor, pay the whole or a partial payment of at least 25% of the
assessment on such property, with interest accrued to the date of payment, to the city treasurer,
except that no interest shall be charged if the entire assessment is paid within 30 days from the
adoption of this resolution; and he may, at any time thereafter, pay to the city treasurer the entire
amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in
which such payment is made. Such payment must be made prior to November 15 or interest will
be charged through December 31 of the next succeeding year.
4. The clerk shall forthwith transmit a certified duplicate of this assessment to the county
auditor to be extended on the property tax lists of the county. Such assessments shall be
collected and paid over in the same manner as other municipal taxes.
5. It is hereby declared to be the intention of the Council to reimburse itself in the future for
the portion of the cost of this improvement paid for from municipal funds by levying additional
assessments, on notice and hearing as provided for the assessments herein made, upon any
properties abutting on the improvement but not made, upon any properties abutting on the
improvement but not herein assessed for the improvement, when changed conditions relating to
such properties make such assessment feasible.
6. To the extent that this improvement benefits nonabutting properties which may be served
by the improvement when one or more later extensions or improvements are made, but which are
not herein assessed, therefore, it is hereby declared to be the intention ofthe Council, as
authorized by Minnesota Statutes Section 420.051, to reimburse the City by adding any portion
of the cost so paid to the assessments levied for any of such later extension or improvements.
7. The clerk shall forthwith transmit a certified duplicate of this assessment to the County
Auditor to be extended on the property tax lists of the County, and such assessments shall be
collected and paid over in the same manner as other municipal taxes.
