CR 05-138 Final Plat Oak Ridge PL II CITY OF m September 28, 2005 J.fOPKINS Council Report 05-138 FINAL PLAT-OAK RIDGE PLACE II Proposed Action. Staff recommends the following motion: Move to apProve Resolution 05-97, approving a final plat for the Eisenhower Communitv Center propertv. At the Zoning and Planning meeting, Ms. Halverson moved and Ms. Hatcher seconded a motion to approve Resolution RZ05-3l, recommending approval of a final plat for the Eisenhower Community Center property. The motion was approved unanimously. Overview. Mike Halley, the applicant, is proposing to construct a 14-16 unit condo building on the property just west of the condo building Mr. Halley is constructing north of the United Methodist Church. The proposed building will be located on property that was owned by the School District on the northeast side of the Eisenhower Community Site. The proposed building would be five stories and have underground and surface parking. In order for the condos to be constructed on the northeast side of the lot, the lot needs to be divided into two lots, The applicant was granted a rezoning, Comprehensive Plan amendment, variance for a lot with no frontage on a public right-of-way, preliminary plat, and a site plan review to construct the building. The zoning of the property is R-5. The Comprehensive Plan was amended to high density residential. . Do the lots meet the zoning requirements? The minimum lot size in an R-5 zoning district is 24,000 square feet; the new lot will be 51,896 square feet. The minimum lot size for an institutional zoning district is 20,000 square feet; the lot on which the school will be located is well over 20,000 square feet. The school will have the minimum setbacks on the northeast side when the lot is divided. . What are the specifics ofthe plat? The lot will be divided into two lots. The new lot will be an approximate triangle lot with a 47 40-square- foot outlot access to the frontage road to be used in the future if a road is needed. The City property on the north side of the lot will be an exception to the plat. . Does the proposed plat meet the subdivision requirements? The proposed plat meets the subdivision requirements with the exception of frontage on a right-of-way. The applicant was granted a variance. . Will a park dedication fee be required? A park dedication fee will be required. The fee is $800 per unit. · What was the discussion at the Zoning and Planning meeting? Ms. Anderson reviewed the final plat. Ms. Anderson stated that the plat was almost identical to the preliminary plat. Ms. Anderson also noted that a utility easement will be vacated and a condition will be added that the City Engineer must approve the relocation of the water main easement and facilities. No one appeared at the meeting regarding this issue. Alternatives. 1. Approve the final plat. By approving the final plat, the applicant will be able to divide the property as proposed. 2. Deny the final plat. By denying the final plat, the applicant will not be able to divide the property as proposed. If the City Council considers this alternative, findings will have to CR05-138 Page 3 be identified that support this alternative. 3. Continue for further information. If the City Council indicates that further information is needed, the item should be continued. That an application for a final plat was made by Mike Halley, on August 26, 2005; 2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on September 27,2005: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of City staff were considered; and NOW, THEREFORE, BE IT RESOLVED that the application for a preliminary plat SUBD05-5 is hereby approved based on the following Findings of Fact: 1. That the final plat meets the subdivision requirements. 2. That the final plat meets the zoning requirements. BE IT FURTHER RESOLVED that application for final plat SUBD05-5 is hereby approved based on the following conditions: 1.
