MORATORIUM ON THE ISSUANCE OF NEW
CHARITABLE GAMBLING PREMISES PERMITS
Proposed Action
Staff recommends approval of the following motion: Move that the Hopkins City Council adopt
Resolution 2003-023 establishing a moratorium on the issuance of new Lawful Gambling
premises permits.
Approval of this motion will establish a moratorium on any new premises permit applications
and begin the process of revising the City's policy on Lawful Gambling.
Overview
The City Council has before it an application for a premises permit from the Hopkins Youth
Hockey Association. It has become apparent, during the discussion of this application, that the
current City policy on Lawful Gambling contains language that is unclear and open to various
interpretations.
Staff is recommending that the City Council establish a moratorium on new premises permits in
order to allow the Council time to address the issues that have been raised concerning the policy
on lawful gambling. This moratorium would not apply to any applications that are currently
before the City Council.
Primary Issues to Consider
. Is a moratorium necessary?
Without a moratorium the Council could be faced with the need to act on an application
during the study process.
. How long will the moratorium last?
The moratorium is set to expire after 90 days. It can be extended by the City Council. If the
study is completed sooner than 90 days the moratorium can be ended earlier through the
adoption of another resolution.

RESOLUTION 2003-023
WHEREAS, the City of Hopkins has an existing policy regarding Lawful Gambling; and
WHEREAS, the Hopkins City Council believes that it is prudent to review its policy dealing
with Lawful Gambling to determine whether any revision is necessary; and
WHEREAS, there is a need to restrict permits for Lawful Gambling until a study has been
completed and any modifications to the City's policy have been adopted;
NOW THEREFORE BE IT RESOLVED, that the City Coundl of the City of Hopkins hereby
declares that it will not consider any appliciltion for a premises permit to conduct Lawful
Gambling until the City policy on Lawful Gambling has been revised and adopted. The
moratorium period will expire on June 29, 2003 or upon the adoption the revised
gambling policy whichever occurs first. This moratorium will not effect any applications
that are currently before the City Council
