ORDINANCE AMENDING SECTION 400
OF THE HOPKINS CITY CODE
Proposed Action.
Staff recommends that the Council approve the following motion: Move to approve
Ordinance 2003-90 I for first reading.
Overview.
Ordinance No. 2003-901 revises Section 400.03 Adoption of the Minnesota State Building
Code. Adoption of the State Building Code is required by MS 16B.59 to 16B.75. This
ordinance:
. Adopts the new Minnesota State Building Code.
. Authorizes issuance of permits and collection of fees.
Provides for violations and penalties.

Analvsis of the Issues:
. Why is a new code being adopted?
The adoption of the State Building Code at this time is truly a unique occurrence since this
marks the adoption of the International Family of Codes. The International Codes are a
compilation of the three previous model codes used in the U.S. and parts of the world.
The publishing of the 2000 International Codes is the culmination of several years of work
by the three model code groups, the construction industry, and cities and other
governmental groups.
The result of all of this work is a single national model building code that is intended to
make life easier for the builders, designers, and cities yet maintains the standards of
building safety that we all expect.

There will be some changes that builders and homeowners will need to adjust to. But in
most cases, the rules will be less strict in the past since the goal in combining the three
previous codes was to take the least restrictive application of each code as it pertained to
specific issues.
To aid the transition to the new codes, our office has developed a number of new handouts
to address code requirements. Also, the State Building Codes Division and local building
official groups have had numerous classes and seminars for contractors and building
designers to speed the learning process.
The City does have the opportunity to adopt an optional fire sprinkler section of the
building code. The adoption of this optional chapter is not being proposed at this time.
Fire Marshal George Magdal will be researching this issue and if it is felt that this optional
chapter should be considered by the City Council, it will be submitted for discussion at a
work session and possible amendment of this section at a later date.

An ordinance amending section 400 of the Hopkins city code
adopting the Minnesota state building code. This ordinance:
provides for the application, administration, and enforcement of
the Minnesota state building code by regulating the erection,
construction, enlargement, alteration, repair, moving, removal,
demolition, conversion, occupancy, equipment, use, height, area,
and maintenance of all buildings and/or structures in this
municipality; provides for the issuance of permits and
collection of fees thereof; provides penalties for violation
thereof; repeals all ordinances and parts of ordinances that
conflict therewith.
The City Council of the ~ity of Hopkins does hereby ordain:

400.03, Adoption of the Minnesota State Building Code.
Subdivision 1. Application, Administration and Enforcement. The
application, administration, and enforcement of the code shall
be in accordance with Minnesota Rule Chapter 1300. The code
enforcement agency of this municipality is called the
Inspections Division. This code shall be enforced by the
Minnesota Certified Building Official designated by this
Municipality to administer the code (Minnesota statute 16B.65)
subdivision 1.
Subdivision 2. Permits and Fees. The issuance of permits and the
collection of fees shall be as authorized in Minnesota Statutes,
16B.62, subdivision 1. Permit fees shall be assessed for work
governed by this code in accordance with the fee schedule
adopted by the City of Hopkins in Ordinance #899. In addition, a
surcharge fee shall be collected on all permits issued for work
governed by this code in accordance with Minnesota statute
16B.70.
Subdivision 3. Violations and Penalties. A violation of the code
is a misdemeanor (Minnesota statute 16B.69).
Subdivision 4. Building Code. The Minnesota State Building Code,
established pursuant to Minnesota Statutes 16B.59 to 16B.75 is
hereby adopted as the building code for the City of Hopkins. The
code is hereby incorporated in this ordinance as if fully set
out herein.
