ZONING AND PLANNING COMMISSION MINUTES
January 30,2007
A regular meeting of the Hopkins Zoning and Planning Commission was held on Tuesday,
January 30, 2007, at 6:30 p.m. in the Council Chambers of Hopkins City Hall.
Present were Commission Members Kathy Newcomb, Kyle Skiermont, Virgil Aarness,
Bob Hatlestad, Linda Flynn and Peter Sholtz. Jannina Aristy was absent.
Also present was City Planner Nancy Anderson.
CALL TO ORDER
Mr. Sholtz called the meeting to order at 6:30 p.m. in the Council Chambers.
APPROVAL OF MINUTES
Mr. Aarness moved and Ms. Newcomb seconded the motion to approve the minutes of
the December 26, 2006, regular meeting. The motion was approved unanimously.

CASE NO. VAC07-1 VACATE STREET, UTILITY AND RIGHT TO ENTER
EASEMENT—EXCELSIOR CROSSINGS
Ms. Anderson reviewed the proposed easements to be vacated. Ms. Anderson also
reviewed the procedure to sell the property and stated that restrictive covenants would be
placed on the property when it was sold.
The public hearing was opened at 6:35 p.m. Mr. Hatlestad moved and Ms. Newcomb
seconded a motion to close the public hearing. The motion was approved unanimously.
The public hearing was closed at 6:36 p.m. No one appeared at the public hearing.
Mr. Aarness moved and Mr. Skiermont seconded a motion to adopt Resolution RZ07-1,
recommending approval of the vacating of street, utility and right to enter easements for
Excelsior Crossings. The motion was approved unanimously.
CASE NO. ZN07-1 REZONING—FORMER SURGE PROPERTY
Ms. Anderson reviewed the rezoning of the former Surge property. Ms. Anderson also
reviewed the procedure to sell the property and stated that restrictive covenants would be
placed on the property when it was sold.
� The public hearing was opened at 6:45 p.m. No one appeared at the public hearing. Ms.
Flynn moved and Ms. Newcomb seconded a motion to close the public hearing. The

`" motion was approved unanimously. The public hearing was closed at 6:46 p.m.
Mr. Hatlestad moved and Mr. Aarness seconded a motion to adopt Resolution RZ07-3,
recommending approval of rezoning the former Surge property. The motion was approved
unanimously.
CASE NO. SUBD07-1 PRELIMINARY/FINAL PLAT—FORMER SURGE
PROPERTY
Ms. Anderson gave an overview of the preliminary/final plat. Ms. Anderson also
reviewed the procedure to sell the property and stated that restrictive covenants would be
placed on the property when it was sold.
The public hearing was opened at 6:47 p.m. No one appeared at the public hearing. Mr.
Skiermont moved and Ms. Newcomb seconded a motion to close the public hearing. The
motion was approved unanimously. The public hearing was closed at 6:48 p.m.
Ms. Flynn moved and Mr. Skiermont seconded a motion to adopt Resolution RZ07-2,
recommending approval of a preliminary/final plat. The motion was approved
unanimously. �
CASE NO. CUP07-1 DAY CARE

Ms. Anderson stated that a day care in the B-3 zoning district requires a conditional use
permit. Ms. Anderson reviewed the conditions for a conditional use permit for a day care.
Jennifer Halberg, the applicant, appeared before the Commission. Mr. Halberg reviewed
the three programs she is proposing. The Commission indicated that it was a good location
for this type of use
The public hearing was opened at 6:55 p.m. No one appeared at the public hearing. Mr.
Aarness moved and Ms. Flynn seconded a motion to close the public hearing. The motion
was approved unanimously. The public hearing was closed at 6:56 p.m.
Mr. Skiermont moved and Mr. Aarness seconded a motion to adopt Resolution RZ07-0,
recommending approval of a preliminary/final plat. The motion was approved
unanimously.
ITEM: JUNK VEHICLES DISCUSSION
Ms. Anderson discussed the proposed language for junk cars in the B-3 zoning district.
The Commission reviewed the proposed language and had no additional language to be
added. The language will be reviewed by the City Attorney and then the Planning
Commission will hold a public hearing.

ITEM: CONDITIONAL USE PERMITS IN THE I-2 ZONING DISTRICT
Ms. Anderson reviewed the proposed language for amendments in the I-2 zoning district.
Staff will review other cities ordinances for other uses that may be added as conditional
uses in the I-2 zoning district.
ITEM: FORMER TOWN AND COUNTRY DODGE PROPERTY
There was a discussion on various uses for the former Town and Dodge property.

Mr. Sholtz moved and Mr. Aarness seconded a motion to adjourn the meeting. The
motion was approved unanimously. The meeting was adjourned at 7:25 p.m.
